Information on how to enter the Promotion forms part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.

The Promotion commences at 12:01am (AEST) on 24h June 2010 and ends at 11:59pm (AEST) on 30 September 2010 ('The Promotion Period').

Entry is open to:
 
Any Australian resident who is validly registered as a member of www.paypal.com.au (operated by PayPal Australia Pty Ltd); AND
who successfully lists and sells an item on www.ebay.com.au, using PayPal during the Promotion Period ("Eligible Entrants"). In order to be eligible, the transaction has to be completed through the checkout process on eBay.com.au. Transactions cancelled, reversed partially or totally will not be eligible. Each eligible transaction will give one entry into the draw.

Employees (and their immediate family members) of eBay, PayPal, and agencies/companies associated with the conduct of this Promotion, and persons whose eBay or PayPal accounts have been temporarily or indefinitely suspended or made inactive by eBay or PayPal during the Promotion Period, are not eligible to enter the Promotion. Entrants under the age of 18 must seek permission from a parent or a guardian prior to entering the promotion. If the winner of a prize is under the age of 18 years, the prize may be awarded to the winner's nominated parent or guardian.

Eligible Entrants are responsible for ensuring that all their contact details registered with PayPal are correct. Eligible Entrants will forfeit their right to claim a prize in the event that their contact details are inaccurate. Eligible Entrants may check or update their contact information with PayPal by visiting the Profile tab on the PayPal site at http://www.paypal.com.au.
Eligible Entrants will gain one entry in the draw each time they successfully sell an item on www.ebay.com.au and collect payment via PayPal, provided the transaction is completed through the checkout process on eBay.com.au. Transactions cancelled or reversed - partially or totally - will not be eligible.

The computerised random draw will take place at 2pm (AEST) on 14 October 2010 at MDSA, 15 Grosvenor Street, Neutral Bay, NSW 2089. The winner will be randomly drawn from the pool of Eligible Entries. Prize value is correct as at 28 May 2010. Promoter accepts no responsibility for any change in prize value after that date.
 
Prize details. The winner of the computerised random draw and a guest will be flown to Sydney from their nearest capital city and transported to the PayPal office at 1 York Street in Sydney. The winner may then select one envelope from a choice of 100 and receive the value of that envelope's contents ie. either a AU$10,000 or a AU$3,000,000 cheque. 99 envelopes contain a cheque for AU$10,000 and 1 envelope contains a cheque for AU$3,000,000. Total maximum prize value is AUD $3,002,520. The prize value is correct as at 28 May 2010. The contents of all envelopes will be revealed to the winner after they have chosen and received their prize. The chance of a winner selecting the AU$3,000,000 prize cheque is one in one hundred. The chance of being drawn as the winner much greater. In the case that a winner is unable to attend the 'choosing of the envelope' at the PayPal office at Level 23, 1 York Street in Sydney NSW 2000, they may appoint a proxy to attend and choose an envelope in their absence, or may request that a representative of the promoter choose the envelope on their behalf.

The winner will be notified via email and phone of their prize. The winner's name will be published on http://forums.ebay.com.au/forum/Promotions/500000006 and in The Australian newspaper on 28 October 2010.
The prize is not exchangeable for goods and services.
If the prize or receipt of it incurs a tax liability, the winner is liable for payment of such tax.
In the event that any component of a prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that prize component with another prize or component of equal value and the winner will be notified accordingly. If the winner is a resident of the Sydney metropolitan area, the winner will forfeit the airfare portion of the prize, and a return transfer from the winner's residential address to the office of the Promoter will be provided. No additional compensation will be given in lieu.
The Promoter accepts no responsibility for any variation in the prize values. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
The Promoter reserves the right to require the winner to provide proof of identity and/or proof of age. Identification considered suitable for verification is at the discretion of the Promoter.
If the prize is unclaimed by 10am (AEST) 14 January 2011, an unclaimed prize draw will take place at 2pm (AEST) on 14 January 2011 at 15 Grosvenor Street, Neutral Bay NSW 2089, in order to distribute any prize unclaimed by that date, subject to State regulations. The winner, resulting from the unclaimed prize draw will be notified via email and telephone of their prize and their name will be published on http://forums.ebay.com.au/forum/Promotions/500000006 and in The Australian newspaper on 21 January 2011.
All entries become the property of the Promoter. Each entrant consents to the Promoter using their personal information in order to conduct the Promotion. No further use of information collected solely from entries into the Promotion will be made beyond this Promotion by the Promoter. To facilitate an entrant's participation, the Promoter may disclose an entrant's personal information to other companies associated with this Promotion and where the Promoter deems it necessary to do so. If an entrant does not provide their personal information they will not be eligible in this Promotion. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, or computer network, lines, servers, or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these terms and conditions. The Promoter's decision is final, and no correspondence will be entered into, including in the event of a dispute.
No responsibility will be accepted for late, lost or misdirected entries.
The Promoter is not liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize, except for any liability which cannot be excluded by law. Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the Prizes and these Terms and Conditions, subject to approval of the gaming authorities in each State and Territory where relevant.
