Terms & Conditions

    Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    The promoter (“Promoter”) is Carnival plc trading as P&O Cruises Australia (ABN 23 107 998 443) of Level 5, 465 Victoria Avenue, Chatswood NSW 2067, telephone: (02) 8326 4000 (Australia).
    Entry is only open to residents of Queensland aged 18 years or over.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    Promotion commences on 20 May 2019 and final entries close at 11:59pm AEST on 16 June 2019 (“Promotional Period”).
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    A limit of one (1) entry per person is permitted.
    Incomplete or indecipherable entries will be deemed invalid.

     How to Enter
    To enter, entrants must, within the Promotional Period, visit the competition landing page on www.pocruises.com.au/brisbaneheartland, fill out the entry form with all required fields and accept the term & conditions. Or complete an identical form on Facebook, available through our facebook.com/pocruises page. All eligible entries will be entered into the draw (the Entry).

    Prize Draw
    There will be one prize draw. The draw will take place at Carnival Australia, Level 5, 465 Victoria Avenue, Chatswood NSW 2067 at 2pm AEST on 18 June 2019All eligible entries received during the Promotional Period will be entered into the draw. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
    The winner/s will be notified in writing within two (2) business days of the draw and his/her name will be published online at www.pocruises.com.au/brisbaneheartland, and on the P&O Cruises Facebook & Instagram feeds on 24 June 2019.
    The Promoter’s decision is final and no correspondence will be entered into
    A draw for any prize if unclaimed may take place on 17 July 2019 at the same time and place as the original draws, subject to any directions from a regulatory authority. The winner will be notified in writing within two (2) business days of the re-draw and their name will be published online at www.pocruises.com.au/brisbaneheartland, and on the P&O Cruises Facebook & Instagram feeds on 22 July 2019.

    Prizes
    The first valid entry drawn will win the major prize of 1 x New Guinea Island Cruise for 10 nights for 2 people, departing Brisbane before June 30, 2020 (Major Prize). The Major Prize includes:
        10 nights’ accommodation in a balcony cabin for 2 people;
        onboard main meals (with the exception of those restaurants which have an additional cover charge) for 2 people;
        selected onboard activities, evening entertainment, and access to nightclubs (with the exception of those activities and facilities which have an additional cover charge) for 2 people; and
        a travel voucher valued at up to $500 to put towards air travel to/from the departure port of Brisbane, only applicable where the winner resides outside of Brisbane.
    The second valid entry drawn will win a runner-up prize of 1 x Signed 2019 QLD Maroons Jersey, valued at $1,000.
    The 3rd, 4th, 5th, 6th and 7th valid entries drawn will each win a runner-up prize of 1 x Ultimate Maroons Membership, valued at $80.
    Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or part of a prize), then the prize (or that part of the prize) will be forfeited.
    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
    Total prize pool value is AU$5,898.
    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless specified otherwise.

    Major Prize terms
    Cruise prize is valued at $3,998, based off New Guinea Island W025 cruise, departing Brisbane 5 May 2020.
    Any additional travel expenses in relation to the Major Prize are the responsibility of the winner. Shore excursions or other onboard activities, spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included as part of the Major Prize package.
    The Major Prize must be taken before June 30, 2020. School holiday cruise periods are excluded
    The winner or their travelling companion must be over the age of 18. Alcohol consumption and gambling onboard are restricted to passengers aged 18 years of age or older.
    The winner and his/her travelling companion are responsible for ensuring that they have the necessary and valid travel documentation including, passports, any requisite visas and vaccinations.The winner and travel companion will be responsible for any expenses incurred in obtaining necessary travel documentation, including any fines, or penalties incurred as a result of not having the requisite travel documentation. Itinerary to be determined by the Promoter in its absolute discretion. A credit card imprint or cash deposit will be required from the winner at check-in in order to board the cruise ship, for all incidental charges.
    The cruise booking cannot be changed once the booking has been made. If the winner and travelling companion are, for whatever reason, unable to travel on the date they nominate, or do not take an element of the prize, including the travel voucher within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner.

    The Promoter reserves the right to refuse to allow a winner and/or his/her travelling companion to take part in any or all aspects of the Major Prize if it determines in its absolute discretion that a winner and/or his/her travelling companion are not in the mental or physical condition necessary to be able to safely participate in the prize, or if they pose a risk to the safety and wellbeing of any other passenger.

    General
    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
    The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors and service providers in the United States and, as required, to regulatory authorities in Australia, New Zealand and the ports of call on the cruise itinerary. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.pocruises.com.au/business/privacy-policy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may access, update or correct their PI, and how Australian entrants may complain about a breach of the Australian Privacy Principles or any other applicable law. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose entrants’ PI to entities overseas (for a list of the countries, see the Promoter’s Privacy Policy).
    When entering this Promotion, you agree to release Facebook from all liability and claims arising out of or in connection with the Promotion or these terms and conditions.
