TERMS AND CONDITIONS:

Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Promoter: The Smith's Snackfood Company Pty Limited (ABN: 31 057 976 940) of Tower A, Level 4, 799 Pacific Highway, Chatswood, NSW 2067, telephone: 1800 025 789, in Australia and Bluebird Foods Limited (Company No. 163343) of 124 Wiri Station Road, Manukau, Auckland 2104, in New Zealand (together, "Promoter").

Entry: Entry is only open to Australian and New Zealand residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotional Period: Promotion commences on 12:00 AM AEST 29/05/19 and closes at 11:59PM AEST on 22/07/19

How to Enter:

To enter, individuals must complete the following steps during the Promotional Period:
Purchase any participating Doritos products (excluding salsas/dips) listed in Clause 6 below ("Participating Products") from a participating store in Australia or New Zealand and retain purchase receipt. All stores in Australia and New Zealand that stock and sell Participating Products will be ‘participating stores’ for the purposes of this promotion;
Visit the Doritos Spider Man 2 Promotion website at www.doritos.com.au/spiderman ("Website");
Follow the prompts to the promotion entry page, input the requested details (including full name, email address, mobile number, date of birth, Australian or New Zealand postal address, full purchase receipt number and the last 6 digits of the product barcode number of the Participating Product purchased), and submit the fully completed entry form.

Entry Limits: Maximum of two (2) entries per person per day is permitted but only one (1) entry permitted per Participating Product purchased. Each entry must be submitted separately and in accordance with entry requirements. Unrecognised barcodes will be deemed invalid.

Entrants must retain their original or a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.

Prize Draws and Claims

Daily Draws: There will be one (1) draw conducted for the entries received each day of the Promotional Period, with a total of fifty-five (55) draws ("Daily Draws"). Subject to the starting and closing time of the Promotional Period, entries into each Daily Draw will open at 00:00 AM (AEST) 29/05/19 and close at 11:59PM (AEST) 22/07/19 each day. Each Daily Draw will take place at Tactics Marketing, Unit 6, 106 Old Pittwater Road Sydney, NSW 2100 at 12:00PM AEST on the first business day after entries close for the Daily Draw, with the first Daily Draw taking place on 30/05/19 and the last Daily Draw taking place on 23/07/19. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW.

Non-winning Daily Draw entries will be entered into any subsequent Daily Draw(s) and all entries will be entered into the Major Draw.

The Major Draw will take place at Tactics Marketing, Unit 6, 106 Old Pittwater Road Sydney, NSW 2100 at 12:00PM (AEST) on 26/07/19 The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

All winners will be notified by phone or email within two (2) business days of the relevant draw and their names will be published on www.doritos.com.au/spiderman from 05/08/2019.
Prize Claim: Winners must accept their prize by 11:59PM AEST on 05/11/19, by replying to the winner notification email with their full name, date of birth, delivery address and contact number.

Prizes

Daily Prize: There are 55 Daily Prizes available to be won. The first valid entry drawn in each Daily Draw will win a $500 Visa Gift Card. Any ancillary costs associated with redeeming the gift card are not included. The Daily Prize will be awarded in the winner’s local currency (i.e. AUD$500 if a winner is from Australia and NZD$500 if a winner is from New Zealand).
Visa Gift Cards will be delivered to the winners within twenty-eight (28) days of verification of their entry, to the Australian or New Zealand mailing address provided with their entry. To the extent permitted by law, once any prize has left the Promoter’s (or supplier’s) premises, the Promoter will not be responsible for any delay in delivery, loss or damage to the prize. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card. Gift cards are valid for twelve (12) months from date of issue. Visa Gift Cards can be used for purchasing goods and services where Visa Prepaid Cards are accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions). The Card is not a credit card, nor is it linked to a deposit account. Visa Gift Card cannot be used for cash advances, cannot be redeemed for cash and cannot be returned for a refund. Major Prize: The first valid entry drawn in the Major Draw will win a trip for two (2) adults to New York City, USA valued at up to AUD$20,000 depending on date and point of departure. Major

Return economy airfares for two (2) people from the winner’s nearest Australian State (if the winner is from Australia) or New Zealand (if the winner is from New Zealand) capital city to New York, USA;
Return private car transfers between JFK International Airport and accommodation;

Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, luggage, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.Prize must be taken by 22/07/2020 and is subject to booking and flight availability. Prize cannot be taken during Australian or New Zealand school holidays, public holidays or other peak periods.
Major Prize Special Terms and Conditions
The winner and their companion must be over 18 years of age, travel together, and depart from and return to the same departure point.
Accommodation and flight arrangements, including suppliers, will be determined by the Promoter in its sole discretion. The Promoter may refuse any requested changes. If any requested change is accepted by the Promoter, change fees may be applicable.
Prize is subject to the standard terms and conditions of individual prize and service providers.
The winner may be required to present their credit card at time of accommodation check in.
Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss, damage or injury arising from the use or participation in the prize, except to the extent any loss, damage or injury is due to the negligence or wilful misconduct of the Promoter.
Winner, and any other person(s) sharing the prize with the winner, is responsible for obtaining any required travel documentation, including passports and visas.
Unclaimed Prize Draw: A draw for any unclaimed prizes may take place on 06/11/2019 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their names will be published at www.doritos.com.au/spiderman from 07/11/2019.
Subject to the unclaimed prize draw clause, if for any reason any winners do not take the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Total prize pool: up to AUD$47,500.

General

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter’s decision is final, and no correspondence will be entered into.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.
The information entrants provide will be used by the Promoter for the purpose of conducting this promotion. By entering this promotion, entrants consent to the storage of their personal information on the databases of the Promoter and its related bodies corporate and the Promoter and its related bodies corporate may use this information for future promotional and marketing purposes regarding their products and services including (where the entrant has opted in) contacting entrants via electronic messaging. All entries become the property of the Promoter. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants.
