20.If the winner is from South Australia and cannot be contacted within 2 months from thedate of the draw, a new winner will be redrawn at 12:00PM on the 16th of September2019 at The Trophy Room, 545 South Dowling St, Surry Hills, NSW 2010. The newwinner will be notified via email and the new winner’s details published on thecompetition website (​www.jnto.org.au/discovery-dial​) within 24-48 hours of confirmingthe winner is an Eligible Entrant.21.The Promoter expressly disclaims any responsibility and entrants agree to indemnify andhold harmless the promotion entities from and against any and all claims, actions,demands and/or liability for injury, damage or loss whatsoever relating to or arising inconnection with participation in this promotion (regardless of the cause of such injury,damage or loss) and/or the delivery and/or subsequent use or misuse of any of theprizes awarded.22.The Promoter reserves the right, at any time, to verify the validity of entries and entrants(including an entrant’s identity, age and place of residence) and reserves the right, in itssole discretion, to disqualify any individual who the Promoter has reason to believe hasbreached any of these Terms and Conditions, tampered with the entry process orengaged in any unlawful or other improper misconduct calculated to jeopardise fair andproper conduct of the competition. Errors and omissions may be accepted at thePromoter's discretion. Failure by the Promoter to enforce any of its rights at any stagedoes not constitute a waiver of those rights. The Promoter's legal rights to recoverdamages or other compensation from such an offender are reserved.23.The Promoter’s decision concerning any aspect of this promotion is final and nocorrespondence will be entered into.24.The Promoter and its related bodies may use entrant’s email addresses for futurepromotional and marketing purposes. Entrants may unsubscribe at any time.25.By entering the promotion, each entrant agrees in addition to the above uses, that thePromoter may disclose entrants’ personal information, to State and Territory lotterydepartments, the winners’ names will be published as required under the relevant lotterylegislation and the Promoter may publish or cause to be published the winner's namesand suburb in any media.26.The Promoter collects information about entrants, including names and contact detailswhich entrants provide when registering or using our services, as well as informationfrom data houses, social media services, affiliates and other entities. Tickets from Melbourne to Tokyo valued at upto AUD $2,135 per ticket as of 21 May 2019 (including taxes).b.Winner is entitled to two (2) free places on guaranteed departuresof G Adventures Japan Express: Osaka to Tokyo (AJJR) departing by 31 July2020 provided that a minimum of four paying passengers are confirmed on suchdeparture. Valued at AUD $7738 as of 16 May 2019 (including taxes).28.All additional costs not expressly stated, but which may be incurred in acceptance anduse of the Prize, are the responsibility of the Winner. Such additional costs include,meals, beverages, room service, telephone calls, laundry services, spending money,transport to and from airport departure point, other transfers, travel, insurance, travelinsurance, passports and visas (if applicable).Flight prize terms and conditions29.All travel must be booked in by the 15th December, 2019. The Prize winner and theirtravel companion must be available to travel between the period of 1 August, 2019 and31 July, 2020 in accordance with fare validity.30.Flights are subject to availability at the time of booking and embargo periods, andblackout periods may apply.31.Japan National Tourism Organization reserves the right to substitute for any reasonwhatsoever a prize (or portion thereof) of comparable or greater value, at their solediscretion. Prize is awarded “as is” without warranty nor guarantee, subject to any writtendirections from a regulatory authority.
32.The winners desired travel dates must be communicated to Japan National TourismOrganization representative within 7 days of winning the Prize.33.Flights arrangements will be made by a designated Japan National TourismOrganization representative.34.The Prize winner and their companion must depart from and return to either Sydney orMelbourne and travel together on the same dates/times. If the Prize winner (and theirtravel companion) are located outside of Sydney or Melbourne, connecting airfares andother travel costs will be at the winner’s expense.35.No Prize substitution or cash equivalent of Prize will be awarded for any reason,including for cancellation of trip due to natural calamities or any other force majeureevent.36.Once the trip is confirmed, the departure date cannot be changed or winner will forfeitthe Prize.37.The winner of the Prize (and their travel companion) will not accrue any frequent flyerpoints from taking the Prize.38.Travel insurance, passports, visas, travel vaccinations and medication, transport to andfrom departure point and all other ancillary costs, as well as obtaining any of these, arethe responsibility of the prize winner.39.Picture identification (valid driver’s license, passports, visas or other pictureidentification) is the winner’s and his or her companion’s responsibilities. Australianpassport holders do not require visas to enter Japan.40.Flights are non-transferable, non-exchangeable, non-replaceable, non-upgradeable, andnon-changeable. Further fare rules may apply.41.Entire travel must be completed by 31 July 2020.42.The prize winner agrees to absolve Japan Airlines from any liability that may result fromor is claimed to have resulted from participating in the competition or from theacceptance or use of the prize.43.Any cost associated with accessing the promotion website is the entrant’s responsibilityand is dependent on the Internet service provider used.Tour Prize terms and conditions
44.Winner must book by 15 Dec 2019.45.Valued at AUD $7738 as of 16 May 2019 (including taxes).46.Winner must be 18 years of age or older in order to claim the prize.47.Prize applies to the listed itinerary only and excludes optional or additional services suchas transfers, pre- or post-tour accommodation, “My Own Room” or “My Own Tent,”insurance, amendments, and all incidentals, meals, gratuities, taxes, fees, levies, andtransportation not expressly included in the itinerary.48.All travel related expenses including but not limited to transportation to and from home,taxes, gratuities, incidentals, upgrades, insurance, service charges, airport surcharges,departure taxes, hotel, resort or property fees, food & beverage and excursions notspecifically included in the applicable trip itinerary and personal expenses including butnot limited to telephone/Internet charges and gift shop purchases are the soleresponsibility of the Winner and Guest.49.Once the prize trip has been booked, no substitutions or changes will be permitted toany elements of the prize, including the identity of the Guest.50.Redemption of prize:i) is subject to availability,ii) is valid on new bookings only,iii) may not be combined with any other offer or discount,iv) has no cash value,v) is not transferable or assignable,vi) is not eligible for “Lifetime Deposit” nor “Guaranteed Departure”,vii) cannot be exchanged by the prize Winner or Guest, andix) is non-commissionable if booked by or through an agency.51.Prize Winner must contact the JNTO Representative directly by phone and/or email toorganise Tour Prize details.52.Prize Winner and Guest must agree to G Adventures’ booking terms and conditions,found here: gadventures.com/terms-conditions/booking-terms/.53.Prize Winner and Guest are solely responsible for ensuring they have medical insurancein an amount no less than US $200,000 covering medical, evacuation, and repatriationwhile travelling which is a mandatory requirement for participation on all G Adventurestrips as set out in G Adventures’ booking terms & conditions.
