Catch.com.au Golden Ticket Birthday Competition - Terms and Conditions

1. Definitions

For this Promotion, the following terms have the following meanings:

AEDT/ AEST

AEDT means Australian Eastern Daylight Time. AEST means Australian Eastern Standard Time.

Immediate Family
Any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin

2. Eligibility

Australian residents aged 18 years or over are eligible to enter this Promotion. Employees of the Promoter (or any related entity of the Promoter) and their Immediate Families are not eligible to enter this Promotion. Persons under the age of 18 may enter only with the consent of their parent or legal guardian. If such consent is not given, the entry will be deemed invalid and any prize forfeit for a redraw.

3. Entry

By entering this Promotion, the entrant accepts these terms and conditions. A person may only enter this Promotion during the Promotion Period. To enter, entrants must place an eligible order on Catch.com.au. Orders containing products sold and delivered by Catch, excluding ‘special order’ products. Entry is automatic. If entrants wish to withdraw their entry, they may do so by contacting our help centre at https://help.catch.com.au/s/. Entrants must check their orders once received, for a Golden Ticket. If a Golden Ticket has been included in their order, they will be a winner of the prize in section 4.

4. Prizes

There will be thirty (30) prizes and thirty (30) winners. Each winner will receive 1 x $1,000 Catch Gift Card. The total prize pool will be valued at $30,000. Prizes are not transferable or exchangeable and cannot be substituted for cash. If a prize is unavailable, the Promoter may substitute that prize with a prize that is equal in value or type subject to any written directions from a regulatory authority.

Gift Card Terms and Conditions:
All Gift Cards expire 3 years from the date of issue, unless otherwise stated on the Gift Card. No refund or credit will be given for any unused balance.
Gift Cards cannot be redeemed or exchanged (whether wholly or partly) for cash, including any unused balance on the card, nor can they be used to purchase other Gift Cards or tender.
You may be prohibited from purchasing certain items (such as alcohol if you are under the age of 18 years).
Gift Cards can be redeemed online at www.catch.com.au or www.groceryrun.com.au.
A maximum of 5 Gift Cards may be used in a single transaction.
Gift Cards cannot be used to purchase Catch Connect services.
Gift Cards entitle the holder to goods/services equal to the value stated on the card or remaining after partial redemption. Where an order's value exceeds the balance of the Gift Card, you must pay the balance in cash.
If you do not hold an existing user account, you must open a user account with Catch (for no charge) in-order-to spend (redeem) the balance of this Gift Card.
Items purchased using Gift Cards that are subject to our returns or refunds policy will be refunded as store credit. We reserve the right to issue you with a new Gift Card equivalent to the value of your refunded Gift Card purchase.
The value shown on the Gift Card includes any applicable GST.
Should Catch suspect any fraud relating to a Gift Card, Catch may refuse to redeem the Card until Catch is satisfied that no fraud has occurred.
Catch is not liable for any lost/stolen/damaged Gift Cards or redemption codes (unless fault or damage in the Gift Card arises as a fault of us or our contractors). Please contact Catch immediately via the Help Centre if your Card has been lost/stolen. Lost/stolen Cards can only be replaced if satisfactory proof of purchase is provided and the Card has not been redeemed.
You will not be sent statements of transactions on a Gift Card. You can check your Gift Card balance and expiry date at any time by visiting www.catch.com.au/gift-card.
Catch reserves the right to change these conditions at any time and will provide at least 14 days’ notice. Catch will give notice by posting the changes on catch.com.au. If you contact Catch within the notice period and do not accept the changes, Catch can cancel the Gift Card and refund you any value remaining on the Card.

5. Draw

Five (5) winners per day will be drawn at random by barrel draw, at 9AM AEST on 7/10/2020, 8/10/2020, 9/10/2020, 10/10/2020, 11/10/2020 and 12/10/2020. The draw will take place at the Promoters office in Bentleigh East, VIC.

6. Winners

The winners of the prizes will receive a Golden Ticket delivered with their order, which will include instructions on how to redeem their prize. Winners will also be announced on the Promoter’s Facebook account (https://www.facebook.com/CatchAustralia/) at 3PM AEST on 14/10/2020. The winners of the prizes must sign any release form that may be required by the Promoter or supplier of a prize. After winners have contacted the Promoter to claim their prize, the Promoter will arrange delivery of the prize.


7. Unclaimed prizes

If a prize is unclaimed, the Promoter will draw a winner for the unclaimed prize 3 months after the Promotion end date at 2PM AEDT on 11/01/2021 using the same method specified in section 5 and arrange delivery of the prize using the same method specified in section 6.

8. Forfeited prizes

The Promoter may forfeit a prize if a winner refuses to sign any release form specified in section 6 or if a winner refuses to accept a prize.

9. Entrant’s personal information

By entering this Promotion, the entrant consents to:

a. the Promoter, or any of its affiliated entities, using the entrant’s details and submission video for future marketing and promotional purposes, except if notified otherwise by the entrant;

b. if entrants are winners, the Promoter using their name, likeness, image and voice in any media platform; and

c. disclosing the entrant’s personal information to third parties, including agents, contractors and suppliers of the Promoter. For the Promoter’s privacy policy, please see https://www.catch.com.au/privacy.

10. Prohibitions and Promoter’s rights

a. This Promotion is subject to the Promoter’s ‘Fair Entries and Participation’ policy. Entrants are prohibited from and will have entries disqualified where the Promoter determines that an entrant has abused, misused or otherwise dishonestly or deceptively entered the promotion or manipulated the results of the Promotion. Entrants will be disqualified where, in the Promoter’s opinion, they are tampering or have tampered with the entry process, using or have used automated entry software or other mechanical or electronic means that allows a person to automatically enter repeatedly, using or have used multiple entries (unless specifically allowed by the Promoter), entering or have entered on behalf of another person(s), or otherwise tampering with the entry process.

b. The Promoter may verify the validity of entries and entrants (including an entrant's identity, age and place of residence). The Promoter may disqualify an entrant or winner where the Promoter determines that such entry is not in accordance with these terms and conditions, including the circumstances set out in clause 10.a. above. The Promoter may either disqualify an entrant or modify, suspend, terminate or cancel this Promotion if this Promotion is interfered with or this Promotion is not capable of being conducted as reasonably expected due to a reason beyond the control of the Promoter, including technical difficulties, unauthorised intervention or fraud, subject to any written directions from a regulatory authority.



11. Promoter’s liability

The Promoter is not liable for any loss, expense, damage or liability that may be suffered or incurred by a person in entering this Promotion or accepting and using the prizes. If the Promoter is liable, the Promoter’s liability is limited to either resupply of the goods or services. This section 11 does not alter a person’s rights under the Australian Consumer Law.
