CONDITIONS OF ENTRY
1. Information on How to Enter and prizes form part of these Conditions of Entry.
2. Entry into this Promotion is deemed to be acceptance of these Conditions of Entry.
3. The Entrant is responsible for ensuring his or her familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Conditions of Entry generally.
4. The Promotion is only open to “Eligible Entrants”, being individuals who:
I. are residents of Australia aged 18 years and over; and
II. are not employees of Trader Classifieds, a division of ACP Magazines Ltd (“The Promoter”), or any of its related corporations or any of their agencies associated with the Promotion; and
III. are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.
5. The Promotion commences 30th July 2010 at 00:01 and final entries close 4th September 2010 at 23:59.
6. The Major Prize Draw will take place at Storacall Technology LTD T/a X-on, Level 20, Tower A, The Zenith, 821 Pacific Highway, Chatswood, NSW, 2067 on 10th September 2010 at 12:00. The winner will be notified by telephone, mail, and have their details (initial, surname and postcode) published in The Australian on 15th September 2010, and on the Promotional Website (
www.discoverdownunder.com.au) from 13th September 2010.
UNCLAIMED PRIZE DRAW
7. If a prize remains unclaimed, the Promoter may conduct such further draws at the same place as the original draw as are necessary on 14th January 2011 at 12:00 noon, in order to distribute any unclaimed prize by that date, subject to any written directions under relevant Lottery and Gaming Regulations. In the event of a winner in the unclaimed prize draw, they will be notified by mail and phone and their details (initial, surname and postcode) will be published in The Australian on 18th January 2011.
HOW TO ENTER
8. To enter Eligible Entrants must either:

Any costs associated with accessing the Promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. Any contact details incorrectly entered on the website may invalidate the relevant entry, in the Promoter’s sole discretion.

9. Multiple entries accepted however only one (1) entry is permitted per household via the web.10. Entrants using multiple aliases or email addresses will be disqualified at the discretion of the Promoter.
11. All prices stated are in Australian dollars and include GST. All references to times and dates are to times and dates in Melbourne, which may be Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT) depending on the date. All times are stated using the 24 hour clock.
PRIZE
12. Total value of prize is $12,216.
a) The first valid entry randomly selected will win our Major prize, consisting of:

Insurance, additional options, and all other ancillary costs (including but not limited to installation) are the responsibility of the winner.
There is no color choice available.
To the fullest extent permitted by law, the Promoter takes no responsibility for any, body or paint repairs from the date and time of collection of prize.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.
It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter at their discretion.
The winner will be responsible for any expenses incurred in getting to and from their nearest authorised GIC dealership to collect the prize. Dealership will be located in the winners’ nearest capital city.
The prize must be redeemed in full no more than 28 days after the draw date and for delivery please allow approximately 3 months from the date of ordering. In the event for any reason the winner does not redeem the prize, or an element of the prize, within the time stipulated by the Promoter then the prize, or that element of the prize, will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize.

13. Prize is not transferable or exchangeable, must be taken as offered and cannot be taken as cash.
14. Prize (or components of) may require assembly and installation which is the responsibility of the winner. Unless expressly stated within these Conditions of Entry all other expenses related to the prize become the responsibility of the winner.
15. The prize winner should look to the manufacturer of any products and services awarded as prize for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
16. The Promoter is neither responsible nor liable for any change in prize value of the prize occurring between 21st June 2010 and the date the prize is claimed.
17. Where the prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the respective regulatory gaming authorities, where required.
18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained during the use of the prize except for any liability which cannot be excluded by law.
19. The prize winner must, at the Promoter’s request, participate in all Promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in Promotional material.
20. The Promoter reserves the right to request a winner to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter. Prize winner may be required to sign a declaration confirming their eligibility to accept the prize.
21. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by winner.
22. Confirmation of printing errors and other quality control matters will not be used as a reason for refusing payment of the prize.
23. The Promoter and the agencies and companies associated with this Promotion take no responsibility for any delay in the delivery of the prize.
24. All entries are deemed to be received at the time of receipt in "The Promotion" database and NOT time of transmission by the entrant.
25. Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete entries will be disregarded. The Promoters decision in relation to any aspect of the Promotion is final and binding on every person who enters. No correspondence will be entered into.26. The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant for:
a) Tampering with the entry process. The use of any automated entry software or any other mechanical or electronic means that permit the participant to automatically enter repeatedly are not valid and will not be accepted.
b) Tampering with the operation of the Promotion or web site;
c) Acting in violation of these terms and conditions;
d) Acting in an unsportsmanlike or disruptive manner.
If an entrant selected as winner is found to be in breach of these conditions of entry, a new winner may be selected and, in the event that the entrant in breach has been awarded a prize, the entrant may be required to return the prize or reimburse the value of the prize to the Promoter.
27. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.
28. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
PERSONAL INFORMATION
29. All entries become the sole property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants.
30. Unless an entrant has marked the "opt-out" box (Web Entry) on the online entry form, entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future Promotion, marketing and publicity purposes regarding its products, including contacting the entrant via electronic messaging.
31. Entrants can request to access, update or correct their personal information the Promoter holds about them or may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address below. Should a participant's contact details change during the Promotion Period, it is the participant's responsibility to notify the Promoter
