2. Tell us about your collection
Explain the themes and inspiration behind your collection in 300 words or less. 1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these Terms and Conditions.
2. The competition is a Game of Skill and chance plays no part in determining the winner. A panel of representatives appointed by the Promoter, and based on literary and creative merit will judge each valid entry. The judges’ decision is final and no correspondence will be entered into.
3. Entry is open to Australian residents. Directors of the Promoter, printers, suppliers, providers and agencies associated with this promotion are not eligible to enter. Participants under 18 years of age must seek parent or legal guardian approval before taking part in the promotion. If the Winner is under 18 years of age, the Prize may be awarded to the Winners legal parent or guardian.
4. PROMOTIONAL PERIOD: The promotion commences 9:00am (AEST) 10 August 2010 and concludes 8 September 2010 at 11:59pm (AEST).
5. HOW TO ENTER: To participate in the promotion you must, during the Promotional Period:
* Log on to myer.com.au and follow the prompts to the competition page
* Select five (5) items from the list provided that make up your unique resort collection (“collection”)
* Describe in 300 words or less, the themes and inspiration behind your collection
* Provide your name, address and email address
Note: The email address used to submit your entry will also be used to contact you if you are the Winner. It is the responsibility of the entrant to check their email regularly.
Entries will be deemed to be accepted at the time the entry is received in the competition database and not at the time transmission of the online entry. Internet charges apply and are the responsibility of the entrant. No responsibility accepted for late, lost, incomplete or misdirected mail.
Multiple entries will be accepted proving each entry is unique. 6. The entry must be the original independent creation of the entrant and free from any claims, including copyright or trade mark claims, by other parties. The Winner agrees that they will not sell or otherwise provide their story and/or photographs to any media or other organisation. The Winner also consents to the Promoter publishing in any medium the winning answer to the daily question.
7. PRIZE: There will be one (1) Winner for the Competition. Final judging will take place 12 September 2010 at the Promoters address stated below. The Winner will be contacted by email and details will be announced 12 September 2010 on
www.myer.com.au on 12 September 2010.
The Winner will receive:
* Two (2) return economy airfares flying Virgin Blue from any destination on the Virgin Blue domestic network to Hamilton Island (a travel voucher from Virgin Blue will be issued to the Winner). Voucher must be redeemed within 12 months from 14 July 2010, no extensions accepted.
* Two (2) nights accommodation twin share in a Windward Pavilion room at the Qualia Resort Great Barrier Reef. An accommodation voucher from Qualia Resort will be issued to the Winner. The Qualia Resort stay includes:
o Breakfast for two (2) at The Long pavilion or Pebble Beach (Qualia)
o A couples spa treatment to the value of $220 per person
o 24 hour chauffer service whilst staying at Qualia Resort
o Exclusive use of a 2 seater golf buggy whilst staying at the Qualia Resort
o Return transfers for two (2) to the Hamilton Island airport or marina
o Use of all non-motorised water sports
The total prize pool is valued at up to $6,040 ($AUS, inc. GST). Prize value is subject to travel dates and departure points. The value of the Prize is accurate as at the commencement of the competition. The Promoter accepts no responsibility for any variation in the value of the prizes after this date.
8. The Promoters decision in relation to any aspects of the Competition, including content displayed on the Myer website, is final and binding on all entrants and no correspondence will be entered into.
9. The Promoter will contact the Winner via email to confirm address for the Prize to be delivered to. If the Winner’s email cannot be verified, the Prize will be forfeited. The Promoter and its agencies and companies associated with this Competition take no responsibility for prizes damaged or lost in transit.
10. The Winner will receive a travel voucher via registered mail to the Winners nominated address in Australia. It is the responsibility of the Winner to organise dates to redeem the vouchers. Lost, stolen, defaced vouchers will not be replaced or refunded. Travel must be taken and completed within 12 months from 14 July 2010. No further extensions will be accepted. Failure to travel prior to the expiry date 13 July 2011 will result in the Prize being forfeited and no compensation or refunds will be given. Travel during peak season is excluded (including but not limited to school or state specific public holidays, major sporting events or travel blackout periods).
11. To redeem the Virgin Blue voucher, the Winner must contact the Virgin Blue Staff Travel Department on 131 270 ext 1, and quote reference MYER one. Travel is subject to Virgin Blue Airways general conditions of carriage including but not limited:
* flights are non-redeemable for cash
* taxes, fees and surcharges are the responsibility of the Winner and will need to be paid at time of booking with a credit card
* travel in on confirmed space (ie we won’t bump you off the flight) but is still subject to seat availability at the time of booking
* tickets are non transferable (ie no name changes allowed)
* blackout periods apply during school holidays (ie you cannot take the flights during school holidays nation-wide) and flights subject to availability
* flights are valid for 12 months from 14 July 2010. No extensions.
* all bookings need to be made at least 7 days prior to travel
* bookings can be mad Monday to Friday 9:00am - 5:00pm on 131 270.
* Changes to flight details once booked will incur a $40 change fee per guest per change
* No stopovers permitted

12. To redeem the Qualia voucher, the Winner must contact the Luxury Specialist at Qualia resort by calling 02 9433 3349 or email
luxuryspecialist@hamiltonisland.com.au. Qualia Resort strongly recommends that you do not book your flights until your accommodation is confirmed. The Promoter accepts no responsibility for bookings made at Qualia resort without flight confirmations and vice versa. The Promoter will not compensate the Winner for failure to adhere to these Terms and Conditions.
13. The Winner and their companion must travel together on the same flights and stay at the same properties and share a room. In the event any Winner is under the age of 18 years, the travel companion must be their parent or legal guardian.
14. Unless expressly stated in these Terms and Conditions all other expenses become the responsibility of the Winner. The Winner (and their companion) is responsible for expenses incurred, all airport taxes, including spending money, meals, all transfers including travel to and from departure point to airport (unless otherwise stated), passports, visas, travel insurance, taxes including departure taxes, energy surcharges, gratuities, and all other ancillary costs are the responsibility of the Winner. Incidentals charged to the Winner’s (and travel companion) room, such as meals, mini bar, laundry room services, telephone calls etc, are at the expense of the Winner and their travel companion. The Winner (and travel companion) must hold a valid passport with at least 6 months validity from the date of travel in order to accept the Prize. Flights and accommodation are subject to availability and is the responsibility of the Winner to organise. The Winner (and their travel companion) is responsible for ensuring that they have travel insurance prior to travel to cover them for the travel period. Any fees associated with any amendments (including name changes), cancellations and additions to the initial booking (where authorised) are at the Winners expense. A credit card imprint or cash deposit may be required from the Winner at check-in to the hotel, for all incidental charges, this is the responsibility of the Winner (and their companion).
15. Transfers to the airport from the departing destination (destination on the Virgin Blue domestic network) are the responsibility of the Winner and the travel companion.
16. Flight schedules are subject to change without notice. The Promoter and associated companies of this competition makes no representation as to the safety, conditions or other issues that may exist at any destination. The Winner (and travel companion) is strongly encouraged to seek advice of the safety of their travel. Domestic and International travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.
17. It is a condition of accepting a Prize that the Winner (and their companion) must comply with all the terms and conditions of use of a Prize and prize supplier's requirements.
18. The Promoter reserves the right to request the Winner to provided proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
19. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, or who submits an entry/claim which is not in accordance with these Conditions of Entry.
20. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the Prize winnings. Independent financial advice should be sought prior to entering the competition.
21. Each prize must be taken as offered and cannot be varied, unless authorised by the Promoter. The prize value includes GST and is in Australian dollars and is correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If a prize or part of a prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
22. Prizes are not transferable to another person or exchangeable. Prizes cannot be redeemed as cash, other goods and services or sold to a third party including online auctions and private sales. Unused portions of any prize will be forfeited and no compensation will be paid in lieu of that element of the prize.
23. The Promoter accepts no responsibility for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
24. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
25. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
26. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion. Use of such information will be in accordance with these Terms and Conditions and for the purpose of the competition. To facilitate your participation and in order for you to claim your Prize, the Promoter may disclose your personal information to other companies associated with this promotion (including but not limited to Virgin Blue Airways and Qualia Resort). By entering this promotion unless otherwise advised, each entrant also agrees that the Promoter may use this information in any media for future promotional, marketing and publicity purposes (including advising you of special sales, specific promotional events and other special offers) without any further reference, payment, or other compensation to the entrant including, sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
27. Winners agrees to participate and co-operate with the Promoter as required in all editorial and promotional activities relating to the competition, including but not limited to being interviewed and photographed for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter for an unlimited period of time without remuneration. Winners also agrees to grant to the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and Winners will not be entitled to any fee for such use.
28. Winners may be required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter, at the Promoter’s discretion.
29. If for any reason this promotion is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, malfunction of any telephone network or line, providers or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State regulations, including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the activity and recommence it from the start on the same conditions subject to State and Territory Regulation.
