1. The Promoter is lastminute.com.au Pty Limited, ABN 34091825142, level 10, 17 York Street, Sydney, NSW 2000. Authorised under state permits: NSW - LTPS-10-07911, ACT - TP 10/03647.1
2. Entry into the competition constitutes acceptance of these Terms and Conditions.
3. Entry to the competition is free (excluding internet charges) and is only open to entrants who are 18 years or over. Employees (and their immediate families) of Promoter and their related entities are ineligible to enter.
4. The promotion is open to residents of Australia only.
5. During the promotional period, an entry will be automatically awarded to those who update their lastminute.com.au newsletter subscription profile via http://newsletters.lastminute.com.au/inxmail1/profile.jsp6. The promotion commences at 9am AEST, Friday 20 August 2010 and closes at midnight AEST, Sunday 29 August 2010.
7. The first entry drawn that meets the criteria will be deemed the winner.
8. The prize winner will be drawn at random from all valid competition entries received. The draw will take place at Level 10, 17 York Street, Sydney NSW 2000 at 9am on Monday 30 August 2010. The prize winner will be contacted via email.
9. The winner will receive one night in a five star Secret Hotel® in the capital city of their choice across Australia.
10. Total value of the prize pool is up to AU$350.
11. The prize will be arranged by the Promoter, and the choice of Secret Hotel® is at the discretion of the Promoter.
12. Should the winner be un-contactable by midnight Tuesday 30 November 2010, a second winner will be drawn at random from all valid competition entries received and will be deemed the winner by the Promoter at 9am AEST on Wednesday 1 December 2010 at Level 10, 17 York Street, Sydney NSW 2010.
13. The Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash. Prizes must be taken as offered. No modifications or exchanges will be possible.
14. The prize is subject to availability at the time of booking and, if any component of the prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which the prize will be booked.
15. The winner will be notified on the day of the judge’s decision. The winner’ details will also be published at
www.lastminute.com.au on Monday 30 August 2010 for a period of three months.
16. The Promoter expressly reserves the right to resolve any discrepancies, disputes or otherwise unforeseen circumstances as it deems fit and the Promoter's decision will be final and binding upon every person who enters. No correspondence will be entered into. The Promoter expressly reserves the right to change or alter these Terms and Conditions at any time, subject to written directions from State Regulatory bodies.
17. The Promoter accepts no responsibility for incomplete, incorrectly submitted, delayed, misdirected or illegible submissions.
18. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law.
19. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services.
20. If this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
