The first six (6) valid entries drawn will each win an Apple iPad valued at AU$928.
The next twenty-four (24) valid entries drawn will each win an Apple iPod Shuffle (4GB) valued at AU$109.
The next 1,500 valid entries drawn will each win a Dr Martens Gift Pack valued at AU$50. The exact contents of the Gift Pack will be determined by the Promoter in its absolute discretion.
Total number of prizes available is 1,530. Total prize pool is valued at AU$83,184.

Terms and Conditions

1.    Information on how to enter and prizes form part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.
     
How to Enter
2.    To enter individuals must, during the Promotional Period:
     
(a)    purchase a full-priced pair of Dr Martens shoes from any participating Dr Martens store in Australia or New Zealand, during the promotional period. Customers will receive a promotional postcard at the time of purchase; and
     
(b)    visit www.dm50goldengiveaway.com.au (for Australian residents) or www.dm50goldengiveaway.co.nz (for New Zealand residents) and enter the requested details including their name, address and login code found on the promotional postcard and submit.

     
Duration of Competition
3.    The promotion commences at 9am AEST on Wednesday 1st September 2010 and entries close at 5pm AEDST on Sunday 31st October 2010 ('Promotional Period'). There will be a total of 8,000 promotional postcards printed for this promotion.
     
Prizes
4.    The draw will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004 on Friday 5th November 2010 at 2pm AEDST.

9.    Winners will be notified by mail and the winners’ names for the iPad prizes will be published in The Australian on Tuesday 9th November 2010.
10.    The value of each prize is correct at the time of printing. The Promoter is not responsible for any subsequent variation in value.
     
Conditions of Entry
11.    Entry is only open to Australian and New Zealand residents.
12.    Employees and their immediate families of the Promoter, participating stores and the agencies associated with the promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
13.    Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
14.    The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with the Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
15.    Incomplete or indecipherable entries will be deemed invalid
16.    Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
17.    Entrants must retain their original Dr Martens purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify Dr Martens as the store of purchase and that the purchase was made during the promotional period but prior to entry.
18.    Entrants must retain original promotional postcards for all entries as proof of purchase for up to 14 days after the draw date. Failure to produce the original promotional postcards for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
19.    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
20.    The Promoter’s decision is final and no correspondence will be entered into.
21.    No responsibility is accepted for late, lost or misdirected entries.
22.    Partial lay-by payments and purchases using Dr Martens gift voucher/s are not eligible for entry.
23.    Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize, then the prize or that element of the prize will be forfeited.
24.    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
25.    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
26.    A draw for any unclaimed prizes, from all non-winning entries may take place at 2pm AEDST on Tuesday 8th February 2011 at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing and the winners’ names for the iPad prizes (if any) will be published in The Australian on Tuesday 15th February 2011.
27.    Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28.    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
29.    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
30.    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
31.    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
32.    The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
