‘SUNRISE CASH COW’ COMPETITION

TERMS AND CONDITIONS

By entering the ‘Sunrise Cash Cow’ Competition (“the Competition”), you are agreeing to the following terms and conditions:

STANDARD TERMS
Information on how to enter forms part of the terms and conditions of entry.

WHO CAN ENTER?
Subject to clause 2.2, entry is open to all residents of Australia where the Channel Seven signal is received.
Employees and their immediate families of Seven Network (Operations) Ltd, MNET Group Ltd and their associated agencies and companies associated with the Competition are not eligible to enter.

HOW TO ENTER
The Competition commences on Monday 27 September 2010 at 06.00 (AEST) and concludes on Friday 1 October 2010 at 16.30 (AEST) (“the Competition Period”). However, the eligible entry period for each daily prize will commence and conclude on the following dates and times:

In order to enter, viewers must watch Sunrise (“the Program”) on the Seven Network during the Competition Period. Each morning throughout the Competition Period there will be a Competition segment aired during the Program (or any replacement program broadcast in the Sunrise timeslot) which will disclose a daily code word.
In order to enter, viewers must either:
telephone 1902 55 77 07 and register the daily code word, the entrant’s name, address, state, postcode, contact daytime telephone number (including STD area code); or
send a text message/SMS to 19 777 077 including the daily code word and the entrant’s full name and address.
1902 prefix telephone number and SMS entry lines will remain open from Monday 27 September 2010 at 06.00 (AEST) to Friday 1 October 2010 at 16.30 (AEST).
For viewers in all states, the maximum entry costs (for both 1902 and SMS entry) is $0.55 (including GST). Note that SMS entries are charged at premium rate. Higher rates apply to calls to the 1902 prefix phone numbers from mobile phones.
All entrants in the Competition may enter as many times as they like. However, entrants can win only one prize throughout the Competition Period (except entrants from South Australia who are entitled to win more than one prize).
The time of entry will in each case be the time the SMS message and/or 1902 telephone call are received by the MNET Group Ltd database.
SMS entries via the internet or computer generation are invalid and will not be accepted.
Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

4. PRIZES

4.1 There will be one (1) major prize winner and ten (10) minor prize winners each week day (five (5) major prize winners and fifty (50) minor prize winners in total throughout the Competition Period).

Major prize and minor prize winners will each receive the prize package set out below:

Cheques will be made payable to each prize winner to the value of the prize won.

4.2 In accepting the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and they will not be entitled to any fee for such use.

4.3 If the winner is under the age of 18 as at the date of the draw, the prize will be transferred to the winner’s parent or legal guardian.

4.4 Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.5 The winners agree they will not sell or otherwise provide their story and or photographs to any media or other organisation.

4.6 Full details of prizes can be obtained by telephoning the Seven Network in each state on Sydney 02 8777 7777; Melbourne 03 9697 7777; Adelaide 08 8342 7777; Brisbane 07 3369 7777; Perth 08 9344 0777.

5. HOW TO WIN

5.1 Ten (10) minor prize winners (50 in total) and one (1) major prize winner (five (5) in total) will be drawn each week day from the national pool of daily entrants received. Each entrant who has entered the Competition within the Competition Period and registered all details in accordance with clause 3 by using the 1902 prefix telephone number or a mobile phone with a reply path whose SMS message has passed through the Telco carriers between the daily Competition dates and times as stated in clause 3.1 (“Qualifying Entrant”) will be entered into the relevant daily draw following the close of entries for that draw. Daily draws will be conducted on Monday 27 September 2010, Tuesday 28 September 2010, Wednesday 29 September 2010, Thursday 30 September 2010, Friday 1 October 2010 at 16:40 (AEST). All draws will take place at MNET Group Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000.

Daily winners’ entry details may be announced in the Program the next day. Winners will be notified by phone call within 2 days of the draw and a letter advising winners of their prize will also be mailed out. All winners will be published in the Public Notices section of The Australian newspaper on Monday 11 October 2010. Notification or announcement of the winner does not amount to confirmation of the winner’s eligibility and the Promoter may refuse to award the prize if the entrant has not complied with these terms and conditions even after the announcement or notification has been done.
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
Subject to State government legislation an unclaimed prize draw from all non-winning entries will take place at MNET Group Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000 on Monday 10 January 2011 at 10.00am (AEDT) and winners will be published in the Public Notices section of The Australian newspaper on Monday 17 January 2010 and a letter advising winners of their prize will also be mailed out.

NO LIABILITY


6.1 The Seven Network (Operations) Ltd & affiliates, MNET Group Ltd and their associated agencies and companies associated with this Competition, will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.2 The Seven Network (Operations) Ltd & affiliates, MNET Group Ltd and their associated employees, agencies and companies associated with this Competition will not be liable for any misadventure, accident, injury, loss or claim, damages, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with this Competition and/or its prizes that may occur:

(a) during the draw;

(b) in the participation in any prize;

(c) as a consequence of late, lost or misdirected mail;

(d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

(e) in relation to failure of an SMS entry message to be received by the promoter on account of technical problems or traffic congestion;

arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in the Competition; or
due to circumstances outside the Promoter’s reasonable control.
Subject to State regulation, in the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.
Seven Network (Operations) Ltd & affiliates, MNET Group Ltd and their associated agencies and companies associated with this Competition assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
Subject to State regulation, if for any reason this Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition.
