Southbound Competition
Terms and Conditions of entry
1. Information on how to enter and the prize details form part of these terms and conditions of entry. By participating, entrants agree to be bound by these terms and conditions.
2. The Promoters are The Herald & Weekly Times Pty Ltd (HWT), of 40 City Road, Southbank, 3006, Victoria. ABN 49 004 113 937 and the Australian Broadcasting Corporation (ABC), 700 Harris Street, Ultimo, 2007, NSW, ABN 52 429 278 345.
3. Entry is open to legal residents of Australia aged eighteen (18) years old or over at time of entry. The Promoters reserve the right to request the prize-winner and guests to provide proof of age, identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoters. The winners also need to present the original winner’s letter when redeeming flight tickets – the letter will be forwarded to the winner. This is to ensure that the recipients of the flight(s) are the actual winners of the promotion. Employees and immediate family of the Promoters and their agencies associated with this promotion are ineligible to enter.
4. Competition opens on Wednesday 29th September at 12.00am 2010 AEST and closes on Wednesday 27th October 2010 11.59pm AEST.

To enter, tell us in 25 words or less, ‘why you deserve to be pampered at Southbound?’ Entries must not contain any offensive or defamatory material.


5. Only entries that comply with these terms and conditions will be eligible to enter. Entrants can enter as many times as they wish. Send your entries to triplejmagcomps@hwt.com.au with ‘Southbound’ in the subject line or send by mail to ‘Southbound’ competition, PO Box 14725, Melbourne VIC 8001. Don’t forget to include your full name, address, age and contact details including telephone number.
6. The entries will be judged at the triple j magazine office, 40 City Road, Southbank, Victoria, on Friday 29th October 12.00 Noon AEST. The winner will be notified by phone and email and their name printed in the Public Notice section of The Australian newspaper on Saturday 6th November 2010.
7. Upon receipt of entries, they become the property of the Promoters and will not be returned to the entrants. The entrants irrevocably consent to the Promoters publishing the winning entrants’ name and entry in the triple j magazine, The Australian newspaper and/or internet, for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and the entrants grant the Promoters a non-exclusive licence for that purpose.
8. There will be only one (1) winner.
9. The prize consists of 2 x return economy airfares from the winner’s nearest capital city to Perth, WA and return travel from Perth airport to Busselton for the winner and his/her companion, via car or bus. Prize must be taken to coincide with the Southbound Festival commencing on January 1, 2011.The winner will receive two ‘Pampered Camper Deluxe’ tickets, valued at $500 each, which includes; Access to VIP area, including four drink tickets and one hot meal per day Your own four-person tent (complete with beds set up for two – you must bring your own bedding!)
A Pampered Camper welcome pack Access to toilets and hot shower amenities Access to the shady, seated Pampered Camper chill area, where you can buy your own breakfast each morning (breakfast at your own expense) Access to side of stage position to watch a set by one of your favourite artists.
10. The prize does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the prize-winner and their travel companion.
11. Prize travel is subject to availability at the time of booking. The winner and their travel companion will not accrue Qantas Frequent Flyer points on the prize travel.
12. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. There can be no changes made to travel arrangements once tickets are issued. If the prize is not utilised on the dates stated in paragraph 9 it will be forfeited.
13. The Promoter’s decision is final and binding. No correspondence will be entered into. Judging will be by suitably qualified judges (from within triple j magazine) able to assess the quality and creativity of the entries and each entry will be judged on its merits. Chance plays no part in determining the winner.
14. Unruly and unreasonable behaviour is prohibited. Any behaviour that is considered unacceptable by the airline, venue or Promoters will result in the person(s) being removed from the venue.
15. The prize winner must comply with any terms and conditions specified by any relevant third party in relation to the airfares, accommodation and the tickets to the Southbound Festival.
16. Compliance with any health or other government requirements is the responsibility of the prize winner and their traveling companion. It is the responsibility of the prize winner to enquire about local issues and conditions at destinations prior to travel. The Promoters make no representation as to the safety, conditions or other issues that may exist at any destination.
17. The winning entrants and his or her companion acknowledge that they participate in the events that form part of the prize at their own risk and accept that participation in the events that form part of the prize has a degree of danger and may involve a real risk of serious injury or even death from various causes. The winning entrant and his or her companion should seek medical advice to ensure they are fit to compete. The winning entrant and his or her companion attest that they are physically fit to compete safely in the events that form part of the prize and have not been advised otherwise by a qualified medical practitioner. If the winning entrant or his or her companion becomes aware of any medical condition or impairment that will be detrimental to their health if they participate in the events that form part of the prize they must withdraw from those events.
18. The Promoters take no responsibility for any lost, stolen or misdirected prizes which are not as a result of fault of the Promoters. The Promoters accept no responsibility if the event or any part thereof is abandoned, called off or re-scheduled for any reason whatsoever beyond the Promoters’ control and if this occurs, the winners and
their companions forfeit all rights to attend and participate in the relevant event and no cash or substitute prizes will be provided in lieu. Where any prize is unavailable for any reason, the Promoters reserve the right to substitute that prize for a prize of equal value at the publishing date.
19. The prize is strictly as above. The prize is not transferable or exchangeable and cannot be taken as cash. The prize winner must be available to redeem the prize on the dates stipulated by the Promoters. If the prize winner is not able to redeem the prize on that date, the Promoters may determine another prize winner in their discretion. The Promoters accept no responsibility for any variation in the prize value. The Promoters may in their discretion refuse to award any prize to any entrant who fails to comply with these terms and conditions. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoters which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoters may in their sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities where required
20. The Promoters do not exclude any rights and remedies in respect of goods or services under the Trade Practices Act 1974 (Cth) or equivalent State or Territory legislation which cannot be excluded, restricted or modified. However, the Promoters exclude all rights, remedies, conditions and warranties in respect of goods or services from your use of this site, your entry into this competition or your enjoyment of the prize whether based in statute, common law or otherwise to the extent permitted by law. To the extent permitted by law, the winning entrant must exclude, release and forever discharge the Promoters, and all other persons involved in the conduct, promotion and organisation of this promotion, and their respective employees, officers, agents and contractors from all liability for claims, loss, damage, cost or expenses (whether arising under statute, from negligence, personal injury, death, property damage, infringement of third party rights or otherwise) arising from or in connection with the participation in the prize or otherwise howsoever arising. It is a condition of accepting the prize that the winners and their companions sign a legal release and any other document provided by the Promoters in a form determined by the Promoters in its absolute discretion. If the winners or their companions do not sign the legal release or any other document in the form provided by the Promoters within the time requested by the Promoters, the winners and their companion will forfeit any claim to receive the prizes.
21. The Herald & Weekly Times Pty Limited collects your personal information to assist us in providing the goods or services you have requested, to process your competition entries, and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including by SMS or email) at any time in the future to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities that assist us in providing our services, running competitions or with other companies who provide prizes for competitions or reader offers. This company is part of a global media and entertainment company. We would like to share your information with these overseas-related companies so that they can contact you with offers. 22. The Promoters accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
