1. Instructions and information on how to enter form part of these Conditions of Entry. Participation in the Customer Experience Survey constitutes acceptance of these Conditions of Entry.
2. Entry is only open to residents of Australia who, during the Promotion Period, are Private or Bronze Fleet purchasers of a new Toyota vehicle (Dealer demonstrator vehicles excluded), or Toyota Service Advantage customers. Employees of the Promoter and agencies associated with this promotion, and their immediate families are ineligible to enter.
3. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant who tampers with, or benefits from tampering with the entry process or who submits an entry which is not in accordance with these Conditions of Entry.
4. The promotion commences on 1 January 2011 and concludes at 5 pm EDST on 31 December 2011 ('Promotion Period').
5. HOW TO ENTER: To enter, during the Promotion Period the entrants must fully complete the Customer Experience Survey either online at
www.toyotaexperience.com.au/sales or
www.toyotaexperience.com.au/service , OR over the phone on 1800 852 454 for Sales or 1800 727 494 for Service (there is no cost to the entrant to call either of these numbers). Entrants must complete the survey within 30 days from the date of invitation. Invites are by either email or postcard.
6. All surveys must be received by the Promoter during the Promotion Period. No responsibility is accepted by the promoter for late, lost, misdirected or illegible entries. Completion of the on-line or phone survey entitles a person to one (1) entry in the competition. All entries become the property of the Promoter.
7. There will be 12 monthly prize draws and 1 yearly prize draw. The Monthly Prize Draws will take place at 2 pm (EST) on 8 March 2011 (for January entries), 12 April 2011 (for February entries), 10 May 2011 (for March entries), 7 June 2011 (for April entries), 12 July 2011 (for May entries), 9 August 2011 (for June entries), 6 September 2011 (for July entries), 11 October 2011 (for August entries), 8 November 2011 (for September entries), 6 December 2011 (for October entries), 10 January 2012 (for November entries) and 7 February 2012 (for December entries). The Yearly Prize Draw will take place at 2 pm (EST) on 7 February 2012 (for entries received in the Promotional Period). All Prize Draws will take place at Level 7, 8 West St, North Sydney NSW 2060. The Winners will be notified by mail and their names will be published in The Australian newspaper on 11 March 2011 (for January entries), 15 April 2011 (for February entries), 13 May 2011 (for March entries), 10 June 2011 (for April entries), 15 July 2011 (for May entries), 12 August 2011 (for June entries), 9 September 2011 (for July entries), 14 October 2011 (for August entries), 11 November 2011 (for September entries), 9 December 2011 (for October entries), 13 January 2012 (for November entries) and 10 February 2012 (for December entries and Promotional Period entries). The Judges' decision is final and no correspondence will be entered into.
8. PRIZES: The first four (4) valid entries drawn in the Monthly Prize Draw will win a Fuel Voucher valued at $500. The first four (4) valid entries drawn in the Yearly Prize Draw will win a Toyota Voucher valued at $1,000.
9. All entries received during the Promotion Period will be entered into the draw. Total value of the prizes is $28,000.
10. The Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter's decision is final and no correspondence will be entered into. If the prize is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority.
11. If the winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on their behalf.
12. In the event of a prize not being accepted or claimed, subject to applicable state laws, the relevant winner's entry will be deemed invalid and the Promoter reserves the right to conduct an unclaimed Prize re-draw on 8 May 2012 at the same location as the original draws, as are necessary to distribute the prize, subject to any written directions given by any relevant authority. The Winner in any unclaimed prize draw will be notified by post and will have their name published in The Australian on 11 May 2012.
13. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.
14. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition. If the competition is not capable of being conducted due to circumstances beyond the Promoter's control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the competition subject to approval from any relevant authority.
15. The Promoter and its agencies and companies associated with this promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to this competition or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).
16. The Promoter may use any personal information entrants provide in connection with this competition for the purpose of running the competition, and also in advertisements, publications, media statements and other promotional material associated with the competition. It may also be used to consider or respond to your feedback, to send you further surveys or information or to update your details on their customer database(s). The Promoter may disclose the information for those purposes to its related bodies corporate and contractors, and to Toyota dealers. If entrants do not provide the information requested, they will not be able to enter the competition. Unless the entrant has indicated otherwise on the entry form, the Promoter may also use personal information entrants provide to send information about Toyota products and services (including via electronic means), and may disclose the information to Toyota dealers, to its related bodies corporate, agencies, distributors and contractors (including call centres, advertising agencies, direct mail houses and IT service providers, some of which may be located outside Australia) the Promoter engages for that purpose. The Promoter is bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988. A copy of the Promoter's privacy policy can be viewed at
www.toyota.com.au. To request access to, or to update, personal information the Promoter holds about them, entrants can contact the office of the Promoter (an administrative fee may be imposed to access personal information).
