We have launched the Foot Locker Art Prize - the most exciting collaboration in Australasia’s sneaker history.

With a first prize of AUD $50,001, it’s also the World’s Richest Colouring Competition.

Our aim is to shake up the art world. This is a serious art prize, but it’s also a colouring competition so it’s wide open to street artists, fine artists, students and anyone who has ever lived and breathed sneakers. Anyone could win it.
There are 8 sneaker templates to choose from – some of our all-time favourite kicks from Nike, adidas, Puma and Converse. Everyone has the same starting point so it’s all about self-expression, customisation and seeing where it can take you.

The prizes are big and the judges have serious cred, so don’t think about it, enter here.

Terms & Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the “Foot Locker Art Prize” Competition (“Competition”) is deemed acceptance of these Terms and Conditions.

2. The promoter of the Competition is Foot Locker Australia Inc (ABN 22 619 093 977) of Metroplex Complex, Level 1, 16 Terrace Place, Murarrie, Queensland 4172, telephone (07) 3252 3000 (hereafter referred to as “Foot Locker”).

3. Entry is only open to Australian and New Zealand residents.

4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by Foot Locker to enter into a further agreement as evidence of consent to the minor entering this competition.

5. Employees (and their immediate families) of Foot Locker, participating Foot Locker stores and agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Competition Dates
6. Entries open at 9.00am AEST on 6/4/2011 and online entries/registrations close at 6.00pm AEST on 20/6/2011 (“Competition Period”). Mail entries close at 6.00pm AEST on 24/6/2011.

7. Judging will commence at 8.30am AEST on 4/7/2011. People’s Choice voting will open at 9.00am AEST on 13/7/2011 and close at 6pm AEST on 27/7/2011 (“Voting Period”).

Nature of Competition
8. Multiple prizes will be won as part of this competition. Entries will be judged by a panel of judges appointed by Foot Locker. The twenty five (25) entries judged the best by the judging panel at the end of the Competition Period, who are contactable by Foot Locker within seven (7) days of Foot Locker attempting notification, will be deemed the ‘Finalists’. The best Finalist will be deemed the Major Prize winner. The Finalists who choose to have their Artwork voted on by the public (as advised to a representative of Foot Locker in writing) will be deemed the ‘People’s Choice Finalists’. The People’s Choice Finalists’ entries will be voted on by the public, and the entry with the most votes received during the Voting Period will be deemed the People’s Choice Winner. In addition, there will be one prize given to the best entries from each age group (inclusive of the Major Prize and People’s Choice winners), as outlined below.

How to Enter
9. To be eligible to enter individuals must, during the Competition Period:

a) visit the Foot Locker Art Prize website, http://footlockerartprize.com/enter, follow the prompts to the Competition entry page and download and/or print out one (1) of the eight (Cool available entry forms or pick up an entry form from a Foot Locker store (while available). There are eight (Cool different entry forms available for download (available in landscape and portrait format), each with a different sneaker outline (Nike Air Force 1 Mid, Nike Tuned Air 1, Puma Faas 300, Puma Suede, adidas Superstar, adidas TKD, Converse Chuck Taylor All Star, or Converse All Star Padded Collar II); and

b) use the sneaker template on the entry form to create their own piece of artwork (in accordance with the requirements below) (“Artwork”).

Each eligible entrant who submits an entry online and confirms that they would like their entry to be uploaded to the online gallery will be sent a 20% off Foot Locker discount voucher on confirmation that their artwork has been successfully uploaded to gallery. The voucher may be used to take 20% off the marked price of any item in any Foot Locker store within Australia or New Zealand. The voucher is not to be used in conjunction with any other offer (e.g. 2 for 1, buy one get one free, etc). The voucher cannot be applied to purchases of a Foot Locker Gift Card or lay-bys. The voucher is not to be used in conjunction with Club or Medibank discount. The voucher will be valid for two (2) weeks from the date of issue. The voucher may be used once only. The voucher can be used for the purchase of multiple items, as long as it is one transaction. Any ancillary costs associated with redeeming the voucher are not included. Redemption of the voucher is subject to any terms and conditions of Foot Locker, including those specified on the voucher. Individuals must surrender the voucher at point of purchase.

10. Individuals have the option of submitting their Artwork online or mailing/delivering their Artwork. Eligible individuals must submit their entry in accordance with the steps below, depending on their mode of submission:

(A) Online Submission

i. during the Competition Period, visit the Foot Locker Art Prize website, follow the prompts to the registration page, input the requested details including their display name, materials used, artwork name, artwork description, date of birth, full name, valid email address, residential address including postcode country and state (if applicable), phone number and shoe size;

ii. upload their digital Artwork or a scan/photo of their Artwork (if a painted entry form) as prompted; and

iii. submit the fully completed entry form, so it is received by 6.00pm AEST on 20/6/2011. Eligible individuals will obtain a unique entry ID number on submission.

Digital/photo Artwork files uploaded must be in JPG or PNG format and must not exceed 2MB in file size. Scanned Artwork must be in JPG and PNG format and must not exceed 2MB in file size.

(B) Mail Submission

i. during the Competition Period, visit the Foot Locker Art Prize website, follow the prompts to the registration page, input the requested details including their display name, materials used, artwork name, artwork description, date of birth, full name, valid email address, residential address including postcode country and state (if applicable), phone number and shoe size; and submit. Eligible individuals will obtain a unique entry ID number via email on submission of their entry. Eligible individuals must attach a print out of their email containing the unique entry ID to their artwork; and

ii. print off a manual entry form or pick up an entry form from a Foot Locker store, include their personal details as instructed on the manual entry form and the unique entry ID number (received on submission of registration), and attach the manual entry form to the original Artwork created (if the original Artwork is not a painted sneaker outline of the entry form) and send together to “Foot Locker Art Prize” Competition, SapientNitro, 29 Hutchinson Street, Surry Hills, NSW 2010, so it is received by 6.00pm AEST on 24/6/2011.

11. Foot Locker accepts no responsibility for any entries not received for any reason. No responsibility will be taken for lost, late or misdirected entries. Foot Locker does not warrant that the Foot Locker Art Prize website will be available at all times during the Competition Period.

12. Individuals who submit their entry via mail have the option of uploading a photo of their Artwork (if Artwork is a sneaker outline applied/transposed to a medium that can be hung on a wall) or a photo/scan of their Artwork (if Artwork is a painted entry form), at the time of registering.

13. Artwork picture files uploaded must be in JPG or PNG format and must not exceed 2MB in file size. Scanned Artwork must be in JPG or PNG format and must not exceed 2MB in file size.

14. Entrants must re-register online for each subsequent entry submitted. Each manual entry form submitted must include a new unique entry ID number.

15. All postage and collection costs associated with posting/retrieving the Artwork to/from SapientNitro is the responsibility of the entrant.

Artwork Requirements
16. The sneaker outline (found on entry forms) can be incorporated in any of the following methods to create the Artwork:

i. Individuals can paint the paper entry form they collect from a Foot Locker store/print from the Foot Locker Art Prize website; or

ii. Individuals can apply/transpose the sneaker outline to any medium that can be hung on a wall and then painted (for example, this might be done via tracing a projection or a screen print). ‘Mediums’ include, but are not limited to, canvas, paper, and fabric; or

iii. Individuals can create a digital Artwork by colouring the pdf file of the entry form from the Foot Locker Art Prize website, using any available software program.

17. Each Artwork may only contain one sneaker outline. Any Artwork which contains more than one sneaker outline will be invalid and will not be considered in judging.

18. Free-drawn copies of a sneaker outline that are not accurate (i.e. the lines of the copied sneaker outline that form part of an entrant’s Artwork are not where they appear on the sneaker outline on the original entry form) will not be considered eligible pieces of Artwork for the purpose of judging and will be disqualified.

19. No more than 50% of the sneaker outline in the Artwork should be hidden or obscured by paint/colour.

20. Individuals can paint the sneaker outline on the entry form (or other medium that can be hung on a wall) in any way they like. ‘Paint’ includes oils, charcoal, collage, or any other substance that can be applied to a surface to change the surface visually.

21. Foot Locker will not accept entries with moving pictures, projections or audio, or sculptures or installations, including entries where actual shoes are coloured or customised. Entries must be essentially two dimensional.

22. Entries with moving pictures, projections or audio, or 3-dimensional creations, including entries where actual shoes are coloured or customised will be invalid and will not be considered for judging.

23. Entrants may paint/colour outside the actual sneaker outline if they wish to. For the sake of clarity, if an entrant chooses to paint the sneaker outline on the entry form or colour the PDF version of the entry form to create their Artwork, they can paint/colour to the edge of the entry form. If an entrant applies/transposes the sneaker outline to a medium, he/she can also paint outside the sneaker outline to create their Artwork.

24. Artwork created by transposing/applying the sneaker outline to a medium, must not exceed two (2) metres on its longest edge. The size of the sneaker in relation to the size of the Artwork must stay the same ratio as the sneaker outline template on the entry form (i.e. the sneaker must not be made more or less prominent in the Artwork as it does on the original entry form).

25. Wet or unfinished Artwork will not be accepted.

26. When entrants submit any materials in conjunction with the Competition, including the original/copy of the Artwork (“Content”), entrants agree that they are fully responsible for the Content they submit. Foot Locker shall not be liable in any way for such Content to the full extent permitted by law. Foot Locker may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (i) they will not submit any Content that is unlawful or fraudulent, or that Foot Locker may deem is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (ii) they will obtain prior consent from any person or property that appears in their Content; (iii) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (iv) their Content shall not contain viruses or cause injury or harm to any person or entity; and (v) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify Foot Locker for any breach of the above terms.

Artwork Ownership
27. The winning entry submitted by the Major Prize winner (including the original Artwork) becomes the property of Foot Locker. Artwork will not be returned to the Major Prize winner. As a condition of entering this competition, each entrant hereby assigns all of their rights, title and interest (including copyright) in and to their entry to Foot Locker, in the event they are judged the Major Prize winner.

28. Upon submitting any Content (including the original/copy of their Artwork), each entrant, unless Foot Locker advises otherwise, hereby grants Foot Locker, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

29. Each entrant warrants to Foot Locker that each Artwork submitted is an original artistic work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify Foot Locker against all costs and claims by third parties arising from a breach of this warranty. Entrants hereby consent to any use of their Artwork which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

Judging, Voting & Prizes
30. Judging:

a) All entries will be judged by a credentialed panel appointed by Foot Locker (“Judging Panel”). Judging will commence at 8.30am AEST on 4/7/2011.

b) Each entry will be individually judged based on the creativity and originality of the Artwork submitted.

c) The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

31. Category Winners:

a) All entries will be divided into each of the following age categories.

a. 13 years of age or under;

b. 14 to 18 years of age; and

c. Over 18 years of age.

b) The valid entry judged the best by the Judging Panel from each age category (inclusive of the Major Prize and Peoples' Choice winners), will each win a AU$1,000 Foot Locker Gift Card (or if the winner is from New Zealand, a Foot Locker Gift Card credited with the equivalent New Zealand dollar value, based on the exchange rate as at the date the prize is issued). In the event that the AU$1,000 value in New Zealand dollars is not a whole dollar value, the credit awarded on the Foot Locker Gift Card will be rounded up to the nearest whole dollar.

c) Category winners will be notified by telephone and email.

d) Any ancillary costs associated with redeeming the Foot Locker Gift Card are not included. Any unused balance of the Gift Card will not be awarded as cash. Redemption of the Gift Card is subject to any terms and conditions of Foot Locker including those specified on the Gift Card.

32. Finalists:

(a) The best twenty-five (25) valid entries, from all entries received online and via mail, as determined by the Judging Panel, will be the Finalists.

(b) Foot Locker will contact all Finalists via email and phone to let them know they are a Finalist. In the event that a Finalist is not contactable or does not respond to Foot Locker within seven (7) days of Foot Locker making all reasonable attempts to contact the Finalist (via the details provided on entry), the Finalists entry will be deemed to be invalid. The next best entry, as determined by the Judging Panel, will be deemed a Finalist.

(c) Finalists will be notified by telephone and email and asked to send their original Artwork to SapientNitro at the address: "Foot Locker Art Prize" Competition, SapientNitro, 29 Hutchinson Street, Surry Hills, NSW 2010 by 20/07/11 (if not done so already).

(d) All Finalists will be invited to attend the finalist exhibition on 28/7/2011 (“Finalist Exhibition”). The Finalist Exhibition will be held in Sydney, NSW. The exact venue of the Finalist Exhibition once confirmed will be provided to all Finalists. All costs associated with travel to and from the Finalist Exhibition are the responsibility of the Finalists.

(e) It is the responsibility of the Finalists and entrants who send in their Artwork via mail, to arrange collection of their Artwork (at their own expense) prior to 31/8/2011. In the event that an entrant chooses to post/courier their Artwork back to themselves, the entrant themselves will be responsible for all associated postage/courier costs. If Artwork is not collected by this date it will be disposed of by Foot Locker.

(f) Foot Locker will not be responsible for any loss or damage to an Artwork (outside of its reasonable control) whilst in its custody or any loss of any Artwork en route to Foot Locker. Each entrant is responsible for maintaining his / her own insurance coverage for the Artwork.

33. Major Prize Winner:

a) The entrant who submits the best Artwork from all Finalists, as determined by the Judging Panel, will win AU$50,001 (or if the winner is from New Zealand, the prize will be awarded in New Zealand dollars, based on the exchange rate as at the date the prize is issued) and a pair of sneakers customized with their winning Artwork design or a variation of their design, in Foot Locker’s absolute discretion. The brand and model of the sneaker on the entry form used to create the Major Prize winner’s Artwork (e.g. adidas Superstar entry form) will be the sneaker on which the Artwork design will be painted (e.g. if an adidas Superstar sneaker outline is used to create the Artwork, the Artwork design will be painted on a pair of adidas Superstar shoes). The shoe size of the sneakers to be awarded will be determined by Foot Locker in consultation with the Major Prize winner. In the event that a particular shoe size cannot be accommodated, Foot Locker will award the sneakers in the next best available size. The Major Prize cash prize will be awarded in the form of a cheque.

b) The Major Prize winner will be notified in person at the Finalist Exhibition or via phone and email.

c) The Major Prize Winner will agree to sign any additional agreement in regard to transferring their ownership rights, including intellectual property rights, and to the extent possible, moral rights, in the Artwork to Foot Locker and for the use of their Artwork design on sneakers produced by Foot Locker, as may be reasonably required by Foot Locker.

34. People’s Choice Finalists

At the time of notification as a Finalist, all Finalists will be asked whether they would like to be considered for the People’s Choice Prize. The Finalists who advise Foot Locker that they would like to be considered for the People’s Choice Prize and provide written confirmation to this effect, will be deemed a People’s Choice Finalist.

35. Voting

a) All People’s Choice Finalists’ entries will be uploaded onto the Foot Locker Art Prize website by Foot Locker for public voting.

b) To vote, individuals must, during the Voting Period, visit the Foot Locker Art Prize website and press the ‘vote’ button next to the Finalist’s entry they think is best.

36. People’s Choice Winner

a) The entry which receives the most number of votes during the Voting Period will win AU$1,500 cash (or if the winner is from New Zealand, the prize will be awarded in New Zealand dollars, based on the exchange rate as at the date the prize is issued) (“People’s Choice Winner”). The People's Choice cash prize will be awarded in the form of a cheque.

b) In the event of a tie for the most number of votes, Foot Locker will award the People’s Choice prize to the tied-entry the Judging Panel judges as the best. Tied-entries will be judged on their creativity and originality.

c) The People’s Choice Winner will be notified in person at the Finalist Exhibition or via phone and email.

d) Foot Locker reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted fraudulently.

General
37. This is a game of skill and chance plays no part in determining the Finalists, People’s Choice Finalists and winners.

38. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize.

39. Incomplete, indecipherable or illegible entries will be deemed invalid.

40. Foot Locker reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at Foot Locker’s discretion. Failure by Foot Locker to enforce any of its rights at any stage does not constitute a waiver of those rights.

41. Multiple entries are permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with the entry requirements.

42. Only one (1) vote per People’s Choice Finalist’s entry permitted per IP address. For the sake of clarity, a voter can submit a maximum of one (1) vote for each People’s Choice Finalist’s entry on a single computer. In the event that the original voter or another voter uses the same computer, he/she will not be able to submit any further votes on that computer.

43. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

44. The parent or guardian of each entrant under 18 years of age:

a) will ensure that the entrant in respect of whom they agree to these Terms and Conditions, will comply with these Terms and Conditions; and

b) warrants that the entrant in respect of whom they agree to these Terms and Conditions, is capable of agreeing to these Terms and Conditions and giving the consents contained herein.

45. The parent or guardian of each entrant under 18 years of age agrees to indemnify Foot Locker against:

a) any claims made by the entrant, his or her guardian, any member of his or her family or any other party, against Foot Locker in connection with the Competition or the entrant's participation in the Competition; and

b) any losses (including any liability) caused by any act or omission of the entrant which is inconsistent with these Terms and Conditions.

46. The parent or guardian of each entrant under 18 years of age who participates in the Competition, acknowledges that they are provided with the opportunity for their child to participate in the Competition, as consideration for their agreement to these Terms and Conditions.

47. Foot Locker may require any parental or guardian consent or agreement referred to in these Terms and Conditions to be produced in writing, and such consent if requested must include the words "in consideration of Foot Locker Australia Inc agreeing to admit the entrant into this Competition, [name of Parent or Guardian] agrees to be bound by the terms of entry into the Competition.

48. If there is a dispute as to the identity of an entrant, Foot Locker reserves the right, in its sole discretion, to determine the identity of the entrant.

49. Foot Locker’s decision is final and no correspondence will be entered into.

50. If for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by Foot Locker then the prize (or that element of the prize) will be forfeited.

51. If any prize (or part of any prize) is unavailable, Foot Locker, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

52. Total prize pool value is AU$54,501.

53. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

54. Entrants consent to Foot Locker using the entrant's Artwork, name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by Foot Locker.

55. If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Foot Locker, including but not limited to technical difficulties, unauthorised intervention or fraud, Foot Locker reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.

56. Any cost associated with accessing the Foot Locker Art Prize website is the entrant’s responsibility and is dependent on the Internet service provider used.

57. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Foot Locker (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of Competition.

58. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Foot Locker (including its respective officers, employees and agents), Nike, Puma, Adidas and Converse are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Foot Locker’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Foot Locker) due to any reason beyond the reasonable control of Foot Locker; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of a prize.

59. Foot Locker collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors and service providers. If the personal information requested is not provided, the entrant cannot participate in the Competition.
