TERMS AND CONDITIONS FOR NAPIER CITY COUNCIL GIVING AN AUSSIE A BREAK COMPETITION

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of NSW, ACT, and QLD aged 18 years and over. However, employees and their immediate families of Fairfax Digital Australia & New Zealand Pty Ltd and Napier City Council and agencies and companies associated with this competition are not eligible to enter.
3. The competition commences at 12:01 am (AEDT) on Monday, 28th March 2011 and concludes on at 11.59 pm (AEST) on Sunday, 24th April 2011.
4. To enter, a participant must be a registered member of Fairfax Digital. Participants may register to become a member of Fairfax Digital via the promotional website. It is free to become a member. Members are required to provide personal information including (but not limited to) name and email address.
5. To enter, participants must:
a) Log on to either www.smh.com.au/competitions/aussiebreak or www.brisbanetimes.com.au/competitions/aussiebreak; and
b) Complete your details on the entry form including: full name, email address, year of birth, gender and postcode; and
c) Opt in to receive Fairfax Digital Third Party Offers; then
d) Opt in to receive offers from Napier City Council; and
e) Answer the following question in 30 words or less, “Why would you like to Take an Aussie Break in Napier The Art Deco Capital of the World?”
6. Entry into the competition is limited to one (1) entry per person. Incomplete and incomprehensible entries will be deemed invalid.
7. Entrants must be 18 years or older to be eligible to enter.
8. A judging panel will review all entries submitted on Tuesday, 26th April 2011. The entry that is judged the best and most creative entry will be deemed the major prize winner. The judge’s decision is final and no correspondence will be entered into.
9. If the prize remains unclaimed until Monday, 16th May 2011 the prize will be reallocated to the entrant that best suits the criteria for judging, excluding the original unclaimed winner.
10. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
11. Major prize: There will be one (1) winner. The winning entry will receive:
• 2 return Economy Class airfares to Napier, New Zealand for two people departing from the nearest of the following cities to the prize winner’s place of residence: Sydney, Melbourne or Brisbane (“Flight Departure Cities”)
• 7 nights accommodation in Scenic Hotel Te Pania in a double room
• Breakfast daily during their stay
• Napier Art Deco Capital of the World attractions pass
• NZ$1000 spending money (for the winner only)
• Prize pool valued at $6000 (incl. GST)
12. The prize cannot be transferred and cannot be redeemed for cash.

13. The winner and their travelling companion are responsible for all expenses other than those specified above, including additional spending money, meals, drinks, transfers, laundry charges, activities, incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.

14. It is the winner’s and their travelling companion’s responsibility to take out, at their own cost, all relevant insurance (including but not limited to travel insurance) which may be required or prudent to be taken.

15. The winner and travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne or Brisbane).

16. The winner and their companion must be 18 years and over to participate in the prize.

17. The prize is subject to hotel and flight availability and must be taken by Wednesday, 31st August 2011. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made. Black-out periods include Easter and certain hotel restrictions may apply.

18. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

19. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable. The winner must present the official prize certificate upon check-in to the hotel.

20. It is the winner’s and their travelling companion’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.

21. The Promoter and Napier City Council make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

22. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in any component of the prize should they be chosen as the winner. The winner releases the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of any aspect of the prize, except for any liability which cannot be excluded by law.

23. If any component of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize or any part of it for a prize of equal or greater value, subject to State Regulation.

24. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner and their travelling companion may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

25. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

26. The Promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

27. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

28. All entries become the property of The Promoter and Napier City Council. All entries will be entered into a database and the Promoter and/or Napier City Council may use the entrant’s names and email addresses for future promotional, marketing and publicity purposes (including third party advertising offers from the Promoter) in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By entering the competition and signing up to receive third party advertising offers from the Promoter, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
