1)In these terms the "Promoter"/"we" means Paramount Pictures Australia Pty of Level 3, 208 Clarence Street Sydney NSW 2000, ABN 85 0085 73171.
2)By entering the "Super 8" competition (the "Competition"), entrants agree to be bound by these terms and conditions. Entrants may be required to provide written acknowledgement of these terms and conditions before receiving a prize. These terms and conditions will be governed by the laws of New South Wales, Australia and the state courts of New South Wales, Australia shall have exclusive jurisdiction in relation to any disputes arising therefrom.
3)Entry is open to all residents of Australia who are, at the time of entry, members of the Paramount "Red Carpet Movie Club", excluding employees of the Promoter and its advertising agencies, sub agents, respective employees and their immediate families.
4)Entrants under the age of 18 must ensure that they have obtained the permission of a parent or guardian before entering. Proof of such permission must be provided to the Promoter on request.
5)The Competition will open on Monday 30th May at 12:01am and will close on Monday 20th June 2011 at 11:59pm. Entries received before or after this time will not be counted. All times referred to are Australian Eastern Daylight Standard Time or Australian Eastern Standard Time, whichever is applicable in New South Wales at the time. All valid entries will be entered into a pool from which one winner and eight runners up (together, the "Winners") shall be drawn at random, at Salmat Interactive Level 2, 116 Miller Street, North Sydney, NSW 2060 on Thursday 23rd June at 10:00am. The Winners will be notified in writing and by phone within 5 working days of such draw taking place and, in compliance with Australian law, the first initial, surname and state of residence of the Winners will be published in the public notices section of The Australian on Thursday 30th June 2011.
6)Without limiting the foregoing, the Promoter reserves the right to reject any entry that it deems, in its sole discretion, inappropriate, fraudulent or to infringe or violate someone else's rights or otherwise violate the law. 13)There is only one entry permitted per person.
14)Entry is free.
15)The prize is not transferable or redeemable and must be taken as offered.
16)Entries without the required information will be deemed incomplete and will not count towards an entry into the Competition.
17)It is the entrant's responsibility to advise the Promoter of any change of address or contact details.
18)Once the prize has left the Promoter's premises the Promoter is not liable for any damage to or late delivery of the prize.
19)If any of the prizes remain unclaimed by 23rd September 2011, a second random draw to determine the Winner(s) will take place on 26th September 2011 at 10:00am at Salmat Interactive, Level 2, 116 Miller Street, North Sydney, NSW 2060, and the next Winner(s) shall be notified by phone within five days of such draw taking place. Their first initial, surname and state of residence will also be published in the public notices section of The Australian on 3rd October 2011. If the next Winner(s) fail(s) to claim the prize(s) within 30 days of notification by the Promoter the same process will continue until all of the prizes have been claimed. The Winners' details will be published in The Australian 3 working days after the Promoter's notification.
20)Entry times will in all cases be when the entry is received by the database of the service provider(s) and not when the entry was submitted.
21)Entries via any computer generated automated system will be deemed ineligible and will not be entered into the draw.
22)To the extent permitted by law, any Winner of the Competition releases the Promoter from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the Winner as a result of any loss or damage to any physical property of the Winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter or the prize.
23)The Promoter is not responsible for any lost or ineligible entries, or incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
24)In the event of war, terrorism, state of emergency, disaster or, without limitation, any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the Competition, subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
25)If, for any reason, the Competition is not capable of running as planned including, but not limited to, technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the Competition.
26)All entries become the property of the Promoter. Entrants grant to the Promoter an irrevocable, world-wide, fully-paid, perpetual license to use their entries in any and all media, now known or hereafter devised, in any manner related to the Competition and/or the motion picture "Super 8" without prior notice, approval or compensation.
27)Any Winner of the Competition agrees to participate in any news media activities surrounding the Competition as requested by the Promoter and consents to their name and state being published in The Australian in accordance with these terms.
28)The Promoter collects entrants' information in order that entrants may participate in the Competition and will disclose such information to third parties in order to operate the Competition. We may also use such information to assist us in improving our goods and services and to contact entrants in the future regarding our other goods and services.
