On entering the National Pharmacies Consumer Promotion you are agreeing to the following terms and conditions:
1. STANDARD TERMS
* Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
2. WHO CAN ENTER?
* Subject to clauses 2.2, 2.3 and 2.4, entry is open to all Australian residents who are existing financial members of National Pharmacies (FSMA).
* Members who join during the promotional period and have an interim card are not eligible to enter the competition.
* Entrants under 18 years old must have parental/guardian approval to enter and the parent/guardian must read and consent to these terms and conditions. Parents/Guardians may also be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
* Employees and their immediate families of Friendly Society Medical Association Limited and National Pharmacies are not eligible to enter.
3. HOW TO ENTER
* The competition commences on Monday 4thJuly 2011 and closes at midnight on Sunday 30thOctober 2011.
* Entrants must purchase one of approximately 100 products identified in store by a specially market ticket and produce their National Pharmacy Members card for scanning at the time of purchase.
* Each product purchased from the specially marked range will generate an entry and members can enter as many times as they like.
4. THE PRIZES AND DETAILS OF PRIZE DRAWS
4.1 There are three (3) prizes to be won with a total value of $40,041.
* The first valid entry drawn from the national pool will win a new 2011 Mitsubishi CJ Lancer SX 2.0 litre automatic sedan in white. This major prize includes on road costs (which may vary State by State, GST, 12 months registration, compulsory third party insurance, dealer delivery and statutory charges and is valued at $28,541. Full comprehensive insurance, optional extras, petrol and all other ancillary costs are the responsibility of the winner.
* The winner of this major prize must collect the prize from their nearest nominated Mitsubishi dealership and should allow 28 days from date of notification for fulfilment of their prize, subject to dealer availability.
* It is a condition of accepting the prize that the winner holds a current and valid full Australian drivers license at the time of taking the prize. The Promoter reserves the right to confirm the validity of the drivers license prior to awarding the prize. If the winner does not hold a full valid drivers license, the prize will be awarded to the winner’s nominated family member or selected person.
* If the winner of the major prize draw is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on behalf of the winner.
* The second valid entry drawn from the national pool will win a travel voucher for 2 people from King William travel to an international destination of their choice including business class flights, accommodation and spending money to the total value of $10,000 (including GST). This is a single event holiday and cannot be separated into different holiday vacations or redeemed for cash. The winner may be required to present their credit card upon checking in at the accommodation.
* Availability of the flight and land component of this prize cannot be guaranteed during peak periods such as Christmas, School Holiday or special event periods and is subject to availability.
* All travel must be completed by December 31 2012. All passengers must travel together on the same flights and stay in their allotted accommodation for each destination. No changes can be made to this prize within 7 days of departure.
* Travel insurance is strongly recommended before travel. Obtaining and paying for this insurance is the responsibility of the prize winner.
* The prize winner will be required to sign a liability waiver form to accept the prize. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.
* If the winner of this prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on behalf of the winner.
4.12 The third valid entry drawn from the national pool will win a new Apple iPad and connectivity to the value of $1500.
* If the winner of this prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on behalf of the winner.
* All 3 prizes listed above are subject to the standard terms and conditions of individual prize and service providers.
* None of the prizes are transferable (except where the winner is under 18 years of age) and none of the prizes can be redeemed for cash.
* Winners of the prizes should seek independent financial advice about any tax implications that may arise from the prize winnings.
* The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
* In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition , including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companion) will not be entitled to any fee for such use.
* The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
* Subject to the Terms and Conditions of the participating prize providers, if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
* If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
* The prizes draw will take place under the supervision of a licensed and independent scrutineer at 12 noon on Wednesday 2ndNovember 2011 at the offices of the Friendly Society Medical Association trading as National Pharmacies at 52 Gawler Place, Adelaide, South Australia 5000.
* The winners will be notified by mail and the winners names will be published in The Australian on Monday 7thNovember 2011.
* If any prize is unclaimed a redraw will take place (subject to any directions from a regulatory authority) at 12 noon on Monday 5thDecember 2011 at the offices of the Friendly Society Medical Association trading as National Pharmacies at 52 Gawler Place, Adelaide, South Australia 5000.
* In the case of a re-draw the prize winner(s) will be notified by mail and the winner(s) name(s) will be published in The Australian on Friday 16thDecember 2011.
* As a condition of the accepting the prize, the winners must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
* The Promoter’s decision is final and no correspondence will be entered into.
5. NO LIABILITY
* In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation.
* If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right , in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
* Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
* Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
