Terms & Conditions1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of MediaCom Australia Pty Limited ('the Promoter'), London and Partners Ltd, Eurostar International Limited, Paris IDF ('Promotion Partners') and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.Promotion commences at 12.01am AEST on 24/09/2011 and ends at 11:59pm AEDST on 30/11/2011 ('Promotional Period').
4.To enter, individuals must, during the Promotional Period, visit
www.londonandparis.com, follow the prompts to the competition entry page, input the requested details including their full name, email address, residential address and their answer to the promotional question 'What five words describe your feelings about London, Paris and Eurostar?', and submit the fully completed entry form.
5.The Promoter and the Promotion Partners reserve the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter and the Promotion Partners to enforce any of its rights at any stage does not constitute a waiver of those rights.
6.Only one (1) entry permitted per person. Once an Entrant has submitted their completed entry they will be treated as having submitted one (1) entry into the promotion. Any subsequent entry after the first valid entry is received will be deemed invalid.
7.Entries will be deemed accepted at the time of receipt by London and Partners Ltd and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. There is no cost to enter the promotion.
8.Any entry that contains content that the Promoter or the Promotion Partners, in their sole discretion, considers to be offensive or inappropriate in any way or that the Promoter or the Promotion Partners considers, in their discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter's and the Promotion Partners discretion and no correspondence will be entered into.
9.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
10.The judging will take place at 2.00pm AEST on 02/12/11 at 15 Grosvenor Street, Neutral Bay NSW 2089. The winner will be notified in writing by email within 2 days of the judging, and published at
www.londonandparis.com on 09/12/11.
11.This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on the creativity of the answer provided to the promotional question. The Promoter's and the Promotion Partner's decision regarding all aspects of this promotion is final and no correspondence will be entered into.
12.The most creative, valid entry, as determined by the judges, will win a trip for two (2) adults visiting London, UK and Paris, France valued at a maximum retail value of AU$9,302.86 depending on the winner's point of departure. Prize includes:
•2 x economy flights departing on 31/05/12 from Sydney or Melbourne (whichever is closest to the winner's capital city) to London on Etihad Airlines (flight associated taxes are included)
•2 x economy flights departing on 09/06/12 from Paris, returning to the same departure point of either Sydney or Melbourne (whichever is closest to the winner's capital city) on Etihad Airlines (flight associated taxes are included)
•Four (4) nights twin share or double accommodation at the Mandeville Hotel, London plus breakfast (01/06/12 check in - 05/06/12 check out)

Travel to and from the winner's home and the departure point (either Sydney or Melbourne) is not included in the prize, and is the sole responsibility of the winner and their travel companion. Spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transfers or additional travel, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken on the dates specified and is subject to booking and flight availability.
13.The winner (and their companion) must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers may be required to present credit card at time of accommodation check in. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary.
14.The Eurostar Conditions of Carriage apply to the Eurostar Journey, copies of which may be obtained by writing to Eurostar UK Sales, Times House, Bravingtons Walk, London, N1 9AW or via the website
www.eurostar.com.
15.The winner (and their companion) must comply with all relevant customs, security and immigration requirements, including appropriate passport and visa requirements. The Promoter and/or the Promotion Partners will not be responsible for any passenger's failure to comply with these requirements. The winner is strongly advised to take out adequate levels of travel insurance.
16.If for any reason a winner does not take the prize or an element of the prize by the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
17.If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
18.Total prize pool value is up to AU$9,302.86 (based on the exchange rate as at 30/08/11). The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
19.All entries submitted become the property of the Promoter and the Promotion Partners. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
20.Entrants consent to the Promoter and the Promotion Partners using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
21.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
22.Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
23.As a condition of accepting the prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
24.Except for any liability that cannot be excluded by law, the Promoter and the Promotion Partners (including their officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or the Promotion Partners) due to any reason beyond the reasonable control of the Promoter and the Promotion Partners; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize.
25.The Promoter and the Promotion Partners make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.
26.The Promoter, or its agents in its behalf, and the Promotion Partners collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. For more information about how their personal information is treated entrants should read the Promoter's Privacy Policy (mediacomcable.com/legal_privacy) and the London and Partners Ltd Privacy Policy (
www.visitlondon.com/info/privacy). The Promoter and the Promotion Partners may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter and the Promotion Partners. All entries become the property of the Promoter and the Promotion Partners.
