The Medibank Private 'Win a Big Trip' Competition - Terms & Conditions of Entry
1.Information on how to enter the competition and prizes form part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of Entry.
2.Entries not completed or not submitted in accordance with these Terms and Conditions of Entry will not be accepted.
3.Entrants guilty of insurance fraud or failure to disclose all relevant insurance information at the time of applying for a Medibank Travel Insurance Policy or when making a claim are also ineligible.
4.The promotion commences at 12.00am AEDT on 13 November 2011 and closes at 11.59pm AEDT on 31 December 2011 (“Promotional Period”).The promotion is being conducted by Medibank Private Limited ABN 47 080 890 259 of Level 17, 700 Collins Street, Docklands, Victoria 3008, Ph: 132 331 (“Promoter”).
5.Entry into this promotion is open to Australian residents aged 18 years and over who:
◦purchase any Medibank Travel Insurance Policy during the promotional period in accordance with clause 9 below;
◦is the Policyholder of the Medibank Travel Insurance Policy; and
◦do not cancel their Medibank Travel Insurance Policy during the 14 day cooling off period (“Eligible Entrants”).
Medibank Staff Members who purchase the Medibank Travel Insurance Staff Policy during the Promotional Period are not eligible to enter this promotion.

7.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrants who tamper with the entry process or who submit an entry that is not in accordance with these Terms and Conditions of Entry.
8.The Promoter reserves the right to waive any of the conditions set out in these Terms and Conditions of Entry in its absolute discretion, subject to any written directions from the relevant lottery departments. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9.Entrants can purchase a Medibank Travel Insurance policy via one of the following ways:
a.Phone: call 132 331 and follow the prompts to purchase any Medibank Travel Insurance Policy by 4.00pm AEST on 31 December 2011. Maximum cost of call is 55c (including GST). Calls from mobile and pay phones may attract a higher rate. Service provider: Telstra; or
b.Internet: visit www.medibank.com.au/travelinsurance
and follow the prompts to purchase any Medibank Travel Insurance Policy, input the requested details and submit the fully completed purchase of any Medibank Travel Insurance Policy by 11.59pm AEDT on 31 December 2011; or
c.In Person: visit their nearest Medibank Private Store and purchase any Medibank Private Travel Insurance Policy by 2.30pm AEDT on 31 December 2011 (store opening hours vary, Eligible Entrants can check store opening hours at www.medibank.com.au
10.Multiple entries per person are permitted, but only one (1) entry is permitted per Medibank Travel Insurance Policy and in accordance with all entry requirements.
11.The Prize Draw will be conducted on behalf of Medibank Private by Anisimoff Legal, Advertising, Marketing and Media Lawyers, Level 4, 448 St Kilda Road, Melbourne VIC 3004 at 10:00am AEDT on 24 January 2012. The judges’ decision is final and no correspondence will be entered into concerning any aspect of this promotion.
12.The first valid entry drawn will be the Major Prize winner, who will win:

13.The next five (5) valid entries drawn will each win a runner-up prize, being one AU$1,000 travel voucher provided by Peregrine Adventures.
The Peregrine Adventures travel vouchers are valid for 12 months from 1 March 2012 to 28 February 2013 and are redeemable towards the cost of any Peregrine tour (subject to availability) including the cost of airfares where they are part of a Peregrine tour. The vouchers cannot be used for payment for GST, taxes and other government changes and cannot be redeemed for private group departure, extension trip or add-on. Any costs in excess of the value of the voucher (including GST) and all ancillary costs associated with redeeming the travel vouchers are not included. The vouchers (or any unused balance of the travel vouchers) are not transferable or exchangeable and cannot be taken as cash. Redemption of the travel voucher is subject to any terms and conditions of the issuer including those specified on the travel voucher. The Promoter will not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
14.The six (6) winners of the promotion (the Major Prize winner and 5 runner-up prize winners) will be notified by phone and mail within 7 days of the draw. The prize winners’ names and state of residence will be published in ‘The Australian’ on 16 February 2012.
15.All prizes are subject to booking, flight and accommodation availability at time of reservation. Additional spending money (except as outlined in 12 b), meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, expenses incurred on or in connection with the tour and all other ancillary costs are not included and are the sole responsibility of the prize winner. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
16.Total competition prize pool is valued at up to AU$30,000.
17.Subject to the unclaimed prize draw clause 20, if for any reason a winner does not redeem the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
18.The prize winners will be advised of the procedure to claim the prize within 14 days of the draw.
19.In the event that any component of the prize is unavailable for any reason, the Promoter reserves the right to substitute that prize component with another prize of equal value and/or specification, subject to any written directions from a regulatory authority, and the prize winner will be notified accordingly.
20.If any of the prizes are unclaimed by 26 April 2012, the Promoter may conduct such further draws at the same time and place as the original draw as are necessary to select a winner(s), subject to any written directions from a regulatory authority. The winning entrant(s) in this unclaimed prize draw shall be notified by mail and their name(s) published in The Australian on 16 May 2011.
21.As a condition of accepting a prize, the winner (and any companion/s) may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.22.Any additional costs associated with claiming or redeeming the prizes are the sole responsibility of the prize winners. The Promoter does not take any responsibility for the prizes being lost, damaged or destroyed in transit. The Promoter, agencies and companies associated with this promotion accept no responsibility for any taxation implications that may arise for the prize winners in relation to the prize. The prize winners should seek independent financial advice if concerned about tax implications.
23.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any theft, unauthorised access or third party interference; (b) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in prize value to that stated in these Terms and Conditions of Entry; (d) any tax liability incurred by a winner or entrant; and/or (f) use of a prize.
24.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
25.All entries become the property of the Promoter. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
27.If this promotion is interfered with in any way, is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, or in the case of a force majeure event (including but not limited to technical difficulties, unauthorised intervention, fraud, vandalism, a power failure, tempest, terrorism, industrial action or an act of God), the Promoter reserves the right, in its absolute discretion, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
