ELIGIBILITY

Entry is open to residents of Australia aged between 5 – 14 years (inclusive) who, in the event they are the Major Prize winner, are able to travel and remain in Sydney, Australia for two (2) nights at any time during the period 15 March 2012 to 28 February 2013 (inclusive) in order to participate in the Major Prize as set out in Conditions 12 and 13 (Entrants).3. Entrants must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of Entrants who enter the promotion without disclosing (or who attempt to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Conditions of Entry will bind the Entrants and any parent or legal guardian who gives their consent. Prizes will be awarded to the parent or legal guardian who consented to the winner entering the promotion on behalf of the winner, at the discretion of the Promoter.
The Major Prize winner’s parent or legal guardian who consented to the winner entering the promotion must be over 18 years of age and must accompany the winner for the duration of the Major Prize.4. The directors, management and employees (and their immediate families, including their children and wards) of the Promoter, its related entities, corporations or franchisees, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.

6. To enter the promotion, Entrants must, during the Promotional Period, enter by post or online as follows:

c) Mail the completed entry form in a stamped envelope in the manner required, including writing the Entrant’s full name and postal address on the back of the envelope, and then posting it to:

e) Fully and correctly complete and successfully submit the online entry form in the manner required, including filling in the Entrant’s full name, residential address, contact telephone number and date of birth.
7. Online entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Postal entries must each have a separate, original entry form from a Box to be eligible and photocopies or images of entry forms will not be accepted. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, illegible or incomprehensible entries will be deemed invalid. Entries missing any of the Entrant’s details (including for postal entries, the Entrant’s full name, age and postal address on the back of the envelope) will be deemed invalid. Any contact details provided incorrectly shall be deemed invalid and will result in an ineligible entry. The Promoter accepts no responsibility for late, lost or misdirected entries.
8. Multiple entries are permitted. However, each entry must be based on a separate Box (for postal entries), must be submitted separately and must independently comply with these Conditions of Entry.
9. Any costs associated with accessing the Promotional Website remain the responsibility of an Entrant and are dependent on the Internet service provider used.
10. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
DRAW
11. The prize draw to determine the winners will take place at 3:00pm eastern daylight savings time on 01/03/2012 at Suite 205, 22 Mountain Street, Ultimo NSW 2007. Winners will be notified by telephone and in writing and the Major Prize winner’s name and locality will be published in The Australian on 05/03/2012. All reasonable steps to notify the winners of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
MAJOR PRIZE
12. The first eligible entry randomly drawn from all entries received will win one (1) ‘Sydney Pop Star Experience’ for the winner and three (3) companions (one (1) companion must be the parent or legal guardian who consented to the winner entering the promotion and the parent or legal guardian must be over 18 years of age) in Sydney, Australia for two (2) nights at any time during the period 15 March 2012 to 28 February 2013 (inclusive), valued at up to $8,366.00 (Major Prize). The Major Prize comprises of the following components:
a) Four (4) return economy airfares to Sydney, Australia from the Australian capital city closest to the ordinary residential address of the winner (inclusive of airfare related taxes and charges). If the winner’s ordinary residential address is Sydney, Australia or the metropolitan/regional area of Sydney, Australia, this component of the Major Prize is forfeited;
b) Two (2) nights minimum four (4) star accommodation at a hotel nominated by the Promoter in Sydney, Australia (or similar). This Major Prize component includes (1) hotel room to be shared by the winner and their companion(s);
c) Return transfers to and from the destination airport and the destination hotel;

d) The opportunity for the winner only to record one (1) single in a recording studio under professional supervision for up to three (3) hours; and
e) One (1) compact disc recording of the finished composition (supplied after mixing complete).
13. The Major Prize must be booked and travelled in full by 28 February 2013 or the Major Prize will be forfeited. Redemption of the Major Prize is subject to availability and may be dependent on travel class availability, specific room category availability, the availability of any other applicable Major Prize suppliers or representatives of the Promoter, and any travel ‘blackout’ periods applying (including but not limited to school holidays and public holidays). The recording studio session included in the Major Prize can only be taken Monday to Friday. No extension or variation of the dates permitted once confirmed by the winner to the Promoter, unless notified otherwise by the Promoter in its sole discretion. Travel, accommodation and transfers included in the Major Prize must be taken together and when offered or are forfeited. Any element of the Major Prize not taken will be deemed to be forfeited. The winner and their companion(s) must travel together and depart from and return to the same departure point and participate in the Major Prize together at all times. The winner and their companion(s) may not accrue frequent flyer points. Participation in the Major Prize and any tickets, passes or vouchers issued as part of the Major Prize may be subject to prevailing Major Prize supplier terms and conditions of use. The Major Prize cannot be used in conjunction with travel discounts or special offers. All components of the Major Prize are to be arranged by an agent nominated by the Promoter in its sole discretion.
14. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Major Prize, are the responsibility of the winner and their companion(s) and are NOT included in the Major Prize. Such additional costs include, but are not limited to, meals and beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, destination taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the Major Prize, insurance, travel insurance, passports and visas (if applicable). Winner’s parent or legal guardian may be required to present a credit card at time of accommodation check-in.
15. Taking the Major Prize is subject to any prevailing terms and conditions of any accommodation/transport/experience/services/transfers/travel insurance or tour providers (including but not limited to the recording studio providers), and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winner or their companion(s) are unable to use any element of the Major Prize as stated for whatever reason, including refusal of entry or departure into or out of any location in Sydney, Australia or participation in any other activities (including the recording studio session) for health, age, behaviour or safety reasons. The winner and their companion(s) must follow all reasonable directions given by any representative of the Promoter and any Major Prize supplier during the course of their participation in the Major Prize, including all directions in relation to health, behaviour and safety. Any part of the Major Prize that is not taken for any reason is forfeited. If the winner or their companion (if any) fail to participate in the Major Prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter and/or any Major Prize supplier, the balance of the Major Prize will be forfeited with no compensation payable.
MINOR PRIZES
16. The next one hundred (100) eligible entries randomly drawn from all remaining entries will each win one (1) ‘Alvin & The Chipmunks’ DVD pack containing one (1) ‘Alvin & The Chipmunks: The Movie’ DVD and one (1) ‘Alvin & The Chipmunks 2: The Squeakquel’ DVD, valued at $24.95 per pack (Minor Prize). All costs not expressly stated, but which may be incurred in acceptance and use of the Minor Prizes (including DVD player compatibility), are the responsibility of the winners.
GENERAL
17. Total maximum prize pool value is up to $10,861.00. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.

Independent financial advice should be sought. All prize values are the recommended retail price including GST (depending on point of departure for the Major Prize). Minor Prizes will be sent to the winners’ nominated addresses within a reasonable time of the winners being notified and their eligibility verified.
18. An Entrant whose entry is drawn must confirm their eligibility to be awarded the Major Prize, and ability to accept and participate in the Major Prize, within five (5) days of being successfully notified by the Promoter that they have been drawn, otherwise their entry will be deemed invalid. If their entry is deemed invalid, the Promoter will draw another Entrant at the same time and place as the original draw and repeat this process until the Major Prize has been awarded. If after this process the Major Prize has still not been awarded, or if an Entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with Condition 19.
19. The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 06/06/2012 in order to distribute any prizes (if any) unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner or winners in the unclaimed prize draw, the winner or winners will be notified by telephone and in writing and the Major Prize winner’s name and locality (if applicable) will be published in The Australian on 13/06/2012. All reasonable steps to notify the winners of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
20. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request an Entrant to produce (within the requested time) appropriate photo identification or any other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm the Entrant’s identity, age, residential address and email address, eligibility to enter the promotion and claim a prize, and any information submitted by the Entrant in entering the promotion (including confirming consent of an Entrant’s parent or legal guardian and also the name, age and address of the parent or legal guardian that gave their consent) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agents) or an Entrant or entry (including Box, if applicable) has not been verified or validated to the Promoter’s satisfaction within the time requested, then all the entries of that Entrant will be ineligible and deemed invalid.
21. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Entrant for: a) tampering with the entry process; or b) for submitting an entry which is not in accordance with these Conditions of Entry; or c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
22. A prize will only be awarded following any winner validation and verification that the Promoter (or its nominated agents) requires in its sole discretion.
23. The Promoter reserves the right to request the Major Prize winner’s companion(s) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the companion(s)’ (if any) identity and age before issuing the Major Prize.
24. It is a condition of accepting a prize that the winner and their companion(s) (if applicable) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
25. The Promoter, its franchisees and its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party

interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.
26. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
27. If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize or prizes to the same value of an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
28. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the promoter for those losses, damages and costs.
29. As a condition of entering this promotion, an Entrant consents to the Promoter using the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in the event they are a winner in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents, and expressly gives the Promoter permission to publish the Entrant winner’s name and locality in any media (including but not limited to on
www.happymeal.com.au and, for the Major Prize winner, in The Australian), as required under the relevant State or Territory lottery legislation.
30. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the Entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible.
