‘Trip to Spain’ Promotion Terms & Conditions Desking Systems Updated 10/10/11

i. Indesign Group (Level 1/50 Marshall St Surry Hills 2010) is the ‘Promoter’ of the Indesign magazine competition, and is responsible for selecting the winner within the period stated. Desking Systems (30 Boronia Street, Redfern NSW 2016) is the ‘Prize Supplier’ and is liable for delivering the prize in accordance with terms and conditions listed below.

ii. To be eligible to enter the ‘Trip to Spain’ promotion, individuals must take out an annual subscription to Indesign magazine before 22/02/2012 and complete the entry form including the competition question. Entries to be received by 22/02/2012. The prize will be awarded to the person completing the question for the judged competition in the most creative and interesting way as determined by the designated judge(s) assigned by the Promoter, Indesign Group, in conjunction with the Prize Supplier, Desking Systems.

iii. Winners will be contacted by the Promoter by mail and telephone within two weeks of the promotional closing date.

iv. The trip to Spain includes one return economy ‘non peak season’ flight for one person from the winner’s nearest Australian capital city to Madrid; Spain, internal return flight between Madrid and Alicante, Spain; two (2) nights accommodation in a 4 star rated hotel (or similar) in Madrid; three (3) nights accommodation in a 4 star rated hotel (or similar) in Alicante; limited local transport; selected meals and drinks; and a day visit to the ACTIU Technology Park in Alicante. Trip is valued at up to $4,000.

v. The trip must be taken on a date determined by the Prize Supplier in 2012 and is subject to booking and flight availability. Winners will be notified as to the exact travel dates by the Prize Supplier as soon as practicable.

vi. Flights are subject to availability at the time of booking, are non-transferable and cannot be exchanged for flights to other destinations.

vii. Spending money, additional meals, taxes, travel insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

viii. Winners are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Winners must depart from and return to the same departure point. Itinerary to be determined by the Prize Supplier in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present credit card at time of accommodation check in.

ix. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Entry is only open to new and renewing subscribers of Indesign magazine aged 18 and over, who are based in Australia. Employees (and their immediate families) of the Promoter and the Prize Supplier, DSA Dealers (and their immediate families) and agencies associated with these promotions are ineligible to enter.

x. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

xi. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed invalid.

xii. Multiple entries not permitted, subject to subscription requirements.

xiii. Subscription to Indesign magazine acts as proof of purchase and is an entry requirement of the promotion. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Prize Supplier, result in invalidation of an entrant’s entry and forfeiture of any right to a prize.

xiv. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

xv. The Prize Supplier's decision on dates, transport, itinerary, accommodation and restaurants (if applicable) is final and no correspondence will be entered into.

xvi. In the event of war, terrorism, state of emergency or disaster, the Prize Supplier reserves the right to cancel, terminate, modify or suspend the promotion.

xvii. Prize, is not exchangeable and cannot be taken as cash.

xviii. If for any reason a winner does not take a prize by the time stipulated by the Prize Supplier, then the prize (or that element of the prize) will be forfeited.

xix. If any prize (or part of any prize) is unavailable, the Prize Supplier, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

xx. Any unclaimed ‘Trip to Spain’ prize(s) will be awarded to the next entrant(s) with the best-judged answer, at the Prize Supplier’s discretion.

xxi. Unless expressly stated in these Terms and Conditions all other expenses become the responsibility of the winners.

xxii. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into these promotions, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason, including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party.

xxiii. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry, which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

xxiv. In participating in this promotion, winners consent to the Prize Supplier using their name, company name and image in any media, including but not limited to Indesign magazine and Indesignlive.com for an unlimited period without remuneration for the purpose of communicating these promotions and promoting any products manufactured, distributed and/or supplied by the Prize Supplier.

xxv. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Prize Supplier, the Prize Supplier reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; or (b) modify, suspend, terminate or cancel this promotion, as appropriate. xxvi. Winners should seek independent financial advice about any tax implications that may arise from winning a prize.

xxvii. Except for any liability that cannot be excluded by law, the Prize Supplier (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Prize Supplier's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Prize Supplier) due to any reason beyond the reasonable control of the Prize Supplier; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.

xxviii. The Prize Supplier is not providing travel insurance; it is the Winner’s responsibility to arrange prior to the travel.

xxix. As a condition of accepting a prize, the winner (and his/her companion if applicable) must sign any legal documentation as and in the form required by the Prize Supplier and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

xxx. The Promoter collects personal information in order to conduct these promotions and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
