By entering the ‘Mitsubishi Motors Win a Mirage Competition’, you are agreeing to the following terms and conditions:



1. STANDARD TERMS

1.1 Information on how to enter forms part of these conditions of entry. Submission of an entry is deemed acceptance of these conditions of entry.


2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all residents of Australia, aged 18 years or over, with a valid Driver’s Licence.

2.2 Employees and their immediate families of the Promoter, participating Mitsubishi dealerships and agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.


3. CONDITIONS OF ENTRY

3.1 The competition commences on Thursday the 30 November, 2012 (11:00 AEST) and concludes on 13 January 2013 (23:59 AEST) ("the Competition Period").

3.2 Only one entry permitted per person. Any subsequent entries made will be deemed invalid.

3.3 To enter the competition, entrants must “like” the Mitsubishi Motors Australia Facebook page http://www.facebook.com/MitsubishiMotorsAustralia, complete all required form details, including their full name, email address, physical address and mobile telephone number and create a caption for a Mirage image billboard, from a choice of five images.

3.3.1 Each of the five images relates to one of the Mitsubishi Mirage’s key features “Style”, “Efficiency”, “Manoeuvrability”, “Versatility” and “Value”. Entrants will pick one of the five images provided and create a caption to enter. The caption that is created must relate to the key feature that has been chosen and must incorporate the corresponding key feature (“Style”, “Efficiency”, “Manoeuvrability”, “Versatility” or “Value”). Example: if the image of the key feature “style” is chosen by the entrant, the caption they create must incorporate the word “style”.

3.3.2 Entrants have the choice of incorporating the noun or adjective of the key feature they have chosen to write a caption for (“style” or “stylish”, “efficiency” or “efficient”, “Manoeuvrability” or “manoeuvrable”, “Versatility” or “versatile”, “Value” or “valuable”)

3.3.3 All valid entries will be publicly visible in a gallery on the Mitsubishi Motors Australia Facebook page.

3.4 Any incorrect details submitted may render the corresponding entry invalid.

3.5 The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, address and email address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry, who tampers with the entry process or who submits an entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate, defamatory, unlawful, or otherwise not in keeping with the spirit of the competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an entrant are reserved.

3.6 Incomprehensible, incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which infringe third party intellectual property rights, are not eligible to win.

3.7 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

3.8 The entry mechanic is only open to entrants with access to the internet, with a current and functioning email address and Facebook account. It is recommended that entrants check with their individual service provider in this regard.

3.9 This is a game of skill and chance plays no part in the determination of the winners. Each valid entry will be individually judged on the basis of creativity and uniqueness at the judges’ sole discretion.

3.10 The time of entry will be the time that it is received by Clemenger BBDO – 120 Pacific Highway, St Leonards, NSW 2065.

3.11 Subject to clause 3.12, one entry per person will be allowed and one major prize will be awarded for the competition.

3.12 A second entry will be allowed for those who “share” or “post” their original entry from the Facebook account that they used to enter the Promotion.

3.13 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.

3.14 Judging of the winners will commence on 14 January 2013 at Mitsubishi Motors Head Office. The prize winner will be notified by mobile phone call and by email within 7 working days of judgement commencing and their name will be published on the Mitsubishi Motors Facebook page on 23 January 2013.

3.15 The Promoter’s decision is final and no correspondence will be entered into.

3.16 If for any reason whatsoever a prize winner does not take delivery of the prize by 24 April 2013 then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu of the prize or that element of the prize.

3.17 The Promoter reserves the right to judge “reserve” entries (in addition to the winner) and record them in order of priority based on merit. If a prize has not been claimed by 24 April 2013, the prize may be distributed at the Promoter's absolute discretion to the next best entry as determined by the Promoter.

3.18 The Promoter reserves the right to request that the winner provides proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

3.19 Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the judging.


4. PRIZES

4.1 There will be a total of one major prize winner who will receive a Mirage 14MY LS automatic transmission vehicle from Mitsubishi Motors Australia Limited. Maximum retail value of the prize is $18,000 (including GST) including on road costs and dealer delivery charges. Vehicle Colour will be dependent on availability and prize may take up to four months to deliver.

The following terms and conditions apply to the prize:

a. In the event that the prize becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide an alternative prize of the same theme and value as the original prize, subject to any applicable laws or written directions made under applicable State or Territory legislation.

b. Prize value is correct at 13/11/2012. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Prize is not transferable or exchangeable and cannot be taken as cash. Prize must be taken as offered and cannot be varied.

4.2 It is a condition of accepting the prize that the delivering dealer (“Nominated Dealership”) is at the discretion of The Promoter and will be based on geographical proximity to the winner from one of the following capital cities:

Brisbane, or
Sydney, or
Melbourne, or
Adelaide, or
Perth, or
Canberra, or
Hobart, or
Darwin
4.3 Prizes cannot be transferred, exchanged or redeemed for cash. In the event that a winner does not take the prize as offered, then the prize will be forfeited and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied.

4.4 It is a condition of accepting the prize that travel to and from the Nominated Dealership is the sole responsibility of the winner.

4.5 Comprehensive insurance, additional options and all ancillary costs (including travel to and from the dealership) are the responsibility of the winner.

4.6 Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.

4.7 If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

4.8 The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

4.9 Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

4.10 In participating in the prize, the winners agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media world wide and the winners (and their companions) will not be entitled to any fee for such use.

4.11 The winners agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.12 When an entrant submits any materials via the promotion including comments and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability.

4.13 Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (c) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

4.14 Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

4.15 By accepting the prize, the winner agrees to allow their name and/or suburb and/or state to be published on Facebook as part of the ‘winner announcement’ at a date to be determined by the Promoter.

4.16 In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

4.17 Prize value is correct as of 13/11/12 (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.


5 NO LIABILITY

5.1 The Promoter and Mitsubishi Motors Australia Limited (“MMAL”) shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Neither is the Promoter or Mitsubishi Motors Australia Limited (“MMAL”) responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries.

5.2 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.

5.3 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) and Mitsubishi Motors Australia Limited (“MMAL”) excludes all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following: a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); b) any theft, unauthorised access or third party interference; c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; d) any variation in prize value to that stated in these conditions of entry; e) any tax liability incurred by a winner or entrant; f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or g) participation in the prize.

5.4 Once prizes have left the Promoter premises, the Promoter, their associated agencies and Mitsubishi Motors Australia Limited (“MMAL”) take no responsibility for prizes damaged, delayed or lost in transit.

5.5 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.


6 PRIVACY CONSENT

6.1 Mitsubishi Motors Australia Limited (Mitsubishi) as the Promoter of this competition collects your personal information to assist us in providing the goods or services you have requested, to process your competition entries and to improve our products and services. By submitting your details you give consent to receive marketing material from Mitsubishi and its dealer network. For more information, please read our privacy policy below.


7 PROMOTER’S DETAILS

MITSUBISHI MOTORS AUSTRALIA LIMITED PRIVACY POLICY

1. PRIVACY ACT

Mitsubishi Motors Australia Limited ("MMAL") is an "organisation" for the purposes of the Privacy Act 1988 ("Act"), and is subject to the National Privacy Principles ("NPPs") contained in the Act. This Privacy Policy is intended to provide a general overview of our policies in respect of the handling of your personal information. Your "personal information" is any information or opinion about you that is capable of identifying you. Other policies may override this Privacy Policy in certain circumstances. For example, when we collect personal information from you, we may advise a specific purpose for collecting that personal information, in which case we will handle your personal information in accordance with the stated purpose. This Policy is intended to cover most personal information handled by us (and our authorised agents who collect personal information, on our behalf), but is not exhaustive. If you have any queries about our management of your personal information, you are encouraged to contact our Privacy Officer for further information (see below).

2. EXEMPTIONS

No general exemptions under the Act apply to us, to your personal information, or to any of our acts or practices.

3. HOW WE COLLECT, HOLD, USE AND DISCLOSE PERSONAL INFORMATION

3.1 COLLECTION

We may collect your personal information directly from you, or from third parties (such as Mitsubishi dealers, or market research companies acting on our behalf) that have collected it from you. For example, if you purchase a Mitsubishi vehicle from a Mitsubishi dealer, MMAL will collect personal information about you from that dealer.We limit the personal information we collect to that which is necessary for our functions or activities. When collecting personal information, we take steps to make you aware of the purposes for which the information is being collected by us, the organisations to which we would usually disclose your information, and any consequences for you if you fail to provide any information that is requested at that time.

3.2 STORAGE

We have policies and procedures intended to ensure that your personal information is not misplaced or misused, and that unauthorised access to, or modification or disclosure of, your personal information does not occur.Security measures we employ include authorised user-only access to computer records (including password protection); internal procedures to protect physical documents; and regular monitoring and improvement of our practices and systems to ensure the effectiveness of our security policies.We will endeavour to destroy your personal information as soon as it is no longer required by us (as permitted by law).

3.3 USE AND DISCLOSURE

We will generally only use or disclose your personal information for the purpose for which we collected it, and for related purposes we consider will be within your reasonable expectations.
We may disclose it to our Authorised Mitsubishi Dealers, contractors and associated organisations in order to best respond to your information request, question or feedback, and may also use it to send you information about Mitsubishi products and services.
Mitsubishi will not disclose this information to any other parties.
Otherwise, we will seek your consent prior to using or disclosing your personal information for another purpose, unless we are required or permitted by law to do so without seeking your permission. Further information about the use and disclosure of personal information by us (and our authorised agents, on our behalf) is set out below.

4. ACCESS TO PERSONAL INFORMATION

You may contact our Privacy Officer to request access to your personal information held by us. Contact details for our Privacy Officer are set out below. You will be required to verify your identity before we will allow you to access your personal information, for the protection of your privacy and the privacy of other individuals whose personal information we hold. We may refuse to allow you to access your personal information if we are legally required or entitled to do so. We may require you to pay a fee in order to access your personal information held by us. We will advise the amount of the fee payable (if any) once we have assessed your application for access. Any application for access to personal information will not incur a fee. If you lodge an application for access, we may discuss with you possible options for providing you with access to your information such as, for example, supplying you with a hard copy of your personal information. If you establish that any personal information we hold about you is not accurate, complete and up-to-date, we will amend our records accordingly. Please notify us if our records need to be updated. If we provide you with the means of informing us of changes to your personal information (such as by return forms sent to you by post, or tear-out pages in your Owner's Manual), we encourage you to use these means to assist us to maintain accurate records of your information.

5. KINDS OF PERSONAL INFORMATION WE HOLD

The personal information about you we may hold includes your name and address, contact telephone number(s) and/or email address(es). We may also hold information about any products or services you acquire from us or our dealers, any warranty claims made in connection with those products or services, and any other personal information that you provide to us.

6. ACTIVITIES FOR WHICH PERSONAL INFORMATION IS HELD

MMAL holds personal information so that we may:

administer any warranty provided to you in relation to any products or services you acquire from us or our dealers;
provide you with certain services, such as the Diamond Care Roadside Assistance program;
contact you to ask about your experiences with, or impressions of, our products or services (such as during the Customer Satisfaction Survey we conduct shortly after you purchase a Mitsubishi vehicle);
contact you in the event of a voluntary or compulsory product recall, or if we wish to offer upgrades or modifications to products or services that you have acquired from us;
contact you from time to time to advise you of new products, promotional offers, or services offered by us or our dealers that we consider may interest you; conduct market research or monitor product demand (although where possible we will use "de-identified" information that does not refer to particular individuals when conducting these activities); or you about other matters relating to products or services that you have acquired from us or our dealers.
7. DISCLOSURE OF PERSONAL INFORMATION TO OTHER ORGANISATIONS

We may discuss your personal information to:
• Mitsubishi dealers for certain purposes, for example, handling a warranty claim;
• certain motoring organisations so that they may provide services to you under the Diamond Care Roadside Assistance program;
• our authorised agents that provide administrative or promotional services to us (for example, mail processing businesses, printers, or market research companies). We enter into contractual agreements with these organisations to ensure that information we disclose is used only for the limited purposes for which we have provided it; and public authorities, as required by law.

8. ONLINE PRIVACY

This part of our Privacy Policy sets out the manner in which we handle your personal information in respect of online services provided to you by us. "Online services" includes any services provided by us via the Internet (including email and web pages).

8.1 AUTOMATIC SERVER LOGS

Our web site server automatically collects various items of information when you use our web site. Such information may include the type of Internet browser software you are using to access our web site.When you visit our web site it may store "cookies" on your computer. The purpose of "cookies" is to avoid the need for you to re-enter certain information when you next visit our web site. The settings in your Internet browser software can be adjusted to prevent cookies being stored on your computer, if required. However, some of the features of our web site may then be lost.Although, in some circumstances, it may be possible to identify you from the information we collect, we do not attempt to do so, and only use this information for statistical analysis, system administration, and similar related purposes.

8.2 EMAIL AND MESSAGE FORMS

We may collect personal information from you (such as your name, address, telephone number and email address, and any other information you volunteer) if you send us an email or if you submit information to us using a message or brochure request form. We will use this information to contact you to respond to your message, to send you information that you request, and for other related purposes we consider are within your reasonable expectations. We will not use or disclose any such information for any other purpose without your consent.

8.3 STORAGE AND TRANSMISSION OF PERSONAL INFORMATION ONLINE

If you provide any personal information to us via our online services (including email) or if we provide such information to you by such means, the privacy, security and integrity of this information cannot be guaranteed during its transmission unless we have indicated to you beforehand that a particular transaction or transmission of information will be protected (for example, by encryption).

8.4 OTHER ONLINE SERVICES

If any of our online services (including any email messages we send to you) contain links to other online services that are not maintained by us ("other services"), or if other services link to our online services, we are not responsible for the privacy practices of the organisations that operate other services, and by providing such links we do not endorse or approve the other services. This Privacy Policy applies only in respect of our online services.

9. CHANGES

We reserve the right to amend this Privacy Policy at any time. You may obtain a copy of the current version of the Privacy Policy by contacting us. If the requirements of the NPPs change in the future, we will change our Privacy Policy, as necessary to meet those requirements.

If you believe that a breach of your privacy has occurred, we encourage you to contact our Privacy Officer to discuss your concerns.
