Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. This is a game of skill and chance plays no part in determining the winners.
3. Entry is open to all residents of Australia and New Zealand. However, employees and their immediate families of the Promoter are not eligible to enter.
4. The competition commences on Monday 4 February 2013 at 08:00 (AEDT) and concludes on Thursday 14 February 2013 at 23:59 (AEDT).
5. The competition will be advertised on Discovery Channel and the Discovery Channel Australia Facebook Page.
6. To enter, participants must:
a. go to the official Discovery Channel Australia Facebook page at https://www.facebook.com/DiscoveryChannelAU (the “WEBSITE”); and
b. go to the ‘Discovery Channel Gold Rush’ application tab within the Facebook page; and
c. become a fan of the Discovery Channel Facebook page; and
d. within the entry form answer the given question, in 25 words or less; and
e. complete the entry form with all the details required, including (but not limited to) full name and  email address. Mandatory details will be indicated on the entry form.
7. Entrants under the age of 16 must obtain the prior permission of a parent or guardian over the age of 16 to enter.
8. Entrants in the competition may enter only once during the Promotion and only one prize per household is permitted. 
9. Illegible, incomprehensible and incomplete entries will be deemed invalid.
10. Any entry that is made on behalf of an Entrant by a third party will be invalid.
11. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is strictly prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using a Repeat Entry Device, the Promoter may disqualify that entrant without notice. To ensure fairness, the Promoter may undertake automatic and/or manual audits of entries and may deem entries ineligible if it is reasonably believed that they are frivolous, incomprehensible, incomplete, or otherwise not genuine.
12. Entries must be received by 23:59 (AEDT) on Thursday 14 February 2013. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason 
13. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
14. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
15. There will be one (1) Major Prize and 10 (ten) Runner-Up Prizes to be won in this Competition.

16. One (1) Major Prize Winner will receive:
• A Gold Apple iPad 64GB WiFi and 4G (Black) valued at a maximum of $2,168.24.

Each of ten (10) Runner-Up Prize Winners will receive:
• A ‘old Rush’ DVD prize pack containing ‘Gold Rush’ Season 1 DVD and Gold Rush’ Season 2 DVD valued at a maximum of $50.00 per prize pack.

17. Total prize pool for this Competition is valued up $2,668.24 (including GST)
18. Prizes cannot be transferred, exchanged or redeemed for cash. 
19. It is a condition of accepting the Prize that the Prize winner must comply with all the conditions associated with use of the Prize and the Prize supplier’s requirements. It is each Prize winner’s responsibility to first check with the Prize supplier in respect of any such conditions of use.
20. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
21. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
22. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
23. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
24. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
25. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
26. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
27. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
28. Prize will be awarded to the person named in the entry.
29. As a condition of entering this Competition, entrants consent to having their entry, name, state and any other details uploaded onto the Discovery Channel Australia Facebook Page and Discovery Networks on Air.
30. Each entry must be an original work and must not infringe the copyright or any other rights of any third party.  Each entrant warrants that:
a. each entry is their own original work and is not copied in any manner from any other works; 
b. he/she has the full power and capacity to grant the rights and consents set out in these Terms and Conditions; and
c. he/she will fully indemnify the Promoter against any loss or damages suffered by the Promoter in the event any of the warranties set out in this clause are false.
31. Entrants will retain ownership of copyright in theirentry; however, as a condition of entry, each entrant:
a. agrees that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and videos) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and videos; and
b. consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
32. One (1) Major Prize Winner will be judged on creativity from all valid entries received during the Promotional Period. The judging will take place at Discovery Networks Asia Pacific, Suite 2, 19 Harris St, Pyrmont, NSW 2000 on Friday 15 February 2013 at 12:00 (AEDT). The Winner will be the Entrant who, in the sole opinion of the judges, have submitted entries which best meet the judging criteria. The winners be notified on Friday 15 February 2013 at 15:00 (AEDT).
33. All reasonable attempts will be made to contact the Prize Winner. If a prize remains unclaimed by a winner or unallocated or forfeited for any reason, by 11:00 (AEST) on Friday 29 March 2013, the prizes will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize.  The winner of the unclaimed prize judging will be notified in writing within 2 day of this judging.
34. Prizes will be awarded to person named in the entry.
35. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
36. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
37. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
38. Entrants release Facebook and its associated companies from all liability arising in respect of the Competition and acknowledge that:
a) the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook;
b) any information provided by the entrant in connection with the Competition is provided to the Promoter and not to Facebook; and
c) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook.
39. Any costs of using and accessing Facebook via a mobile phone, tablet or other devices will be dependent on the entrant’s individual mobile and internet service provider. The Promoter is not responsible for any costs associated with any mobile, telephony, internet, or Facebook access and usage. The Promoter is not responsible for any other costs associated or incurred as a result of the entrant’s entry into the Competition.
40. Entry and continued participation in the Competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.
41. This Competition adheres to the terms and conditions set out in the Facebook promotion guidelines which can be found at: http://www.facebook.com/promotions_guidelines.php.
42. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
43. Entrants enter the Competition at their sole risk. The Promoter and Facebook shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
44. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
45. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
46. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
47. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy. By entering the Competition, the Major Prize Winner agrees to the use of their name, image, and works submitted to the Promoter without compensation,
48. The Promoter is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). If you are not willing for this to occur you cannot participate in the Promotion.
