TERMS AND CONDITIONS

By entering The NT News �Darwin Symphony Orchestra Giveaway� competition, you are agreeing to the following Terms and Conditions:

1. STANDARD TERMS
1.1 Information on how to enter forms part of the Terms and Conditions. Entry into the competition is deemed acceptance of these Terms and Conditions.

2. WHO CAN ENTER
2.1 Subject to clause 2.2, entry is only open to Northern Territory residents. Entrants under the age of 18 years need parent/guardian permission to enter. If the winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner�s behalf.

2.2 Directors, management, employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3. HOW TO ENTER
3.1 The competition commences Monday 5 August 2013 and concludes Wednesday 14 August 2013, at first mail (�the Competition Period�).

3.2 To enter the competition, eligible entrants must find the coupon in The NT News and Sunday Territorian between Monday August 5 and Sunday August 11 and enter all the details requested within the coupon. Entries must be sent to PO Box 1400, Darwin, NT 0801.

3.4 Limit one (1) entry permitted per person during the Competition Period.

3.5 The time of entry will, in each case, be the time that the entry is received by the servers of the Promoter or its appointed agent or contractors for the receipt of entries and not the time of transmission by the entrant.

3.6 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
3.7 Incomprehensible, indecipherable or incomplete entries will be deemed invalid.

3.8 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

3.9 Competition entrants assign to the Promoter all right, title and interest in and to all copyright and all moral rights in any material created pursuant to their entry or participation in any aspect of the competition and acknowledge that the Promoter is free to use competition entries and to exercise its rights in relation thereto and entrants will not be entitled to any fee for such use.

4. DRAW
4.1 The draw will take place at 10.00am AEST on 15 August 2013 at the offices of the Promoter at Printers Place, Darwin NT 0800.

4.2 The winner will be notified in writing within two (2) days of the draw and his or her name will be published in The NT News newspaper on 16 August 2013.

4.3 The Promoter�s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.

4.4 It is a condition of accepting the prize that the winner and his or her companion may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
4.5 Entries not completed in accordance with these Terms and Conditions will not be considered valid.

4.6 The Promoter reserves the right to request that the winner provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

4.7 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs, who submits an entry that is not in accordance with these Terms and Conditions, or who has, in the opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoter. The Promoter reserves the right to disqualify the winner if the Promoter becomes aware that the winner and/or the winner�s entry is of a type described in this clause.

5. PRIZES

There will be one (1) prize winner who will receive the prize outlined in 5.1 below:

5.1 Prize includes:

- Two A-Reserve tickets to both nights of the Darwin Symphony Orchestra performance at Uluru October 18-19. Alice Springs residents can enter but a condition would be to forgo the flights and make their own way to Uluru)

� Return Airfares from Darwin to Uluru on a chartered flight with members of the Darwin Symphony Orchestra. With the exception of Alice Springs residents who will be required to forgo flights and make their own way to Uluru.
� Two nights� accommodation in a campground cabin

MAXIMUM PRIZE POOL VALUE: AU$3,000 (including GST).

5.2 If the winner, for whatever reason, is unable to participate in a prize which is restricted to a specific date, or does not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. The prize is not transferable. Cash will not be awarded in lieu of the prize or element thereof.

5.3 If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter�s control, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

5.4 Spending money, meals, taxes (excluding airline and airport taxes), insurance, transfers from the winner�s home to and from Darwin airport, items of a personal nature, in-room charges and all other ancillary costs are not included unless specified in the major prize details.

5.5 During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.

5.4 The winner and his or her travel companion must depart from and return to the same departure point and travel together.

5.5 Frequent flyer points will not form part of the prizes.

5.6 Itinerary and service providers (including airline and hotel) to be determined by the Promoter in its absolute discretion.

5.7 Prizes are subject to the standard terms and conditions of individual prize and service providers.

5.8 The winner may be required to present his or her credit card at time of accommodation check in.

5.9 Subject to the terms and conditions of the participating prize provider(s), if for any reason the prize winner does not, once the prize has been booked, take a prize (or an element of a prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

5.10 If for any reason the winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

6. NO LIABILITY
6.1 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.

6.2 In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

6.3 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (�Non-Excludable Guarantees�). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

6.4 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter�s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of a prize / participation in a prize.

6.5 Once prizes have left the Promoter�s possession or control, the Promoter and its associated agencies take no responsibility for prizes damaged, delayed or lost in transit.

6.6 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter�s legal rights to recover damages or other compensation from such an offender are reserved.

6.7 Any cost associated with accessing the competition website is the entrant�s responsibility and is dependent on the Internet service provider used.

7. PRIVACY CONSENT
7.1 The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from other sources. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may share your information with our related companies and any of us may be in contact for those purposes (including by email and SMS). We may also use your information as described when we collect information from you. If you do not provide us with requested information we may not be able to provide you with the goods and services you require. We disclose your information to our related companies, service and content providers, including those located outside Australia. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). The Promoter�s privacy policy can be viewed at www.ntnews.com.au/privacy. To request access to, or to update, personal information the Promoter holds about them, entrants can contact the office of the Promoter on (08) 89449900 or at privacyofficer@ntnews.com.au.


7.2 Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
