How to enter
To be eligible to enter, consumers must purchase any specially marked Energizer or Eveready battery product from any Woolworths or Safeway store between 20/11/2013 and 14/01/2014. To enter, consumers must then visit
www.batterypromo.com.au, follow the prompts to the competition entry page, input their personal details and the unique code (found on specially marked Energizer or Eveready battery products) and submit the fully completed online entry form by 5pm AEDST on 14/01/2014.
Entrants must retain a photocopy of their store receipt(s) and original product barcode(s) for all entries as proof of purchase. The Promoter may request a photocopy of the store receipt(s) and original product barcode(s) from the entrant to verify the validity of an entry and reserves the right to declare any entry for which a photocopy of their store receipt(s) and original product barcode(s) cannot be provided invalid.
Terms and conditions
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with the entry requirements; (c) each unique code can only be used once; and (d) unrecognised barcode(s), unique codes and store receipt(s) will be invalid.
Entrants must retain ALL their original barcode(s) and a photocopy of their receipt(s) for ALL entries as proof of purchase. If for example a person enters 10 times, and one of those entries is drawn as a winner, they will be required to provide receipts for all 10 entries. Failure to produce the required original barcode(s) and a photocopy of their receipt(s) for ALL entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize or offer. Entries are deemed accepted at the time of receipt and not at the time of transmission.
Promotion commences at 9am AEDST on 20/11/2013 and closes at 5pm AEDST on 14/01/2014 ("promotional period").
There will be one (1) draw conducted for each weekday (i.e. Monday – Friday) of the promotional period, for a total of 40 draws ("Weekday Draws"). Entries into each weekday draw will close at 11.59pm on the day before that draw.
Each Weekday Draw will take place at 30thirty, Level 2, 50 Yeo Street, Neutral Bay, NSW 2089 at 10:00am AEDST on the first business day after entries close for that Weekday Draw, with the first Weekday Draw taking place on 21/11/2013 and the last Weekday Draw taking place on 15/01/2014. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in Sydney. Non-winning entries in each Weekday Draw will be entered into any subsequent Weekday Draw(s). Winners will be notified in writing within two (2) business days of the relevant Weekday Draw. Any Draws falling between 21/12/13 and 02/01/14 will be informed within two (2) business days after Monday 02/01/14.
There will be twenty (20) prize winners drawn in each Weekday Draw (800 prize winners in total for the entire promotion). The first twenty (20) valid entries drawn in each Weekday Draw will each win a $200 Woolworths WISH Gift Card.
Total prize pool is valued at $160,000 AUD. Prizes, including any unused portion, are not transferable or exchangeable and cannot be taken as cash unless otherwise stipulated.
Please allow up to 28 days for the delivery of prizes. Woolworths Limited is the issuer of the WISH Gift Card but is not the Promoter and is therefore not responsible for the prizes, products, or services under the promotion or the fulfilment of these Terms and Conditions. Woolworths Limited is responsible for the fulfilment of the terms and conditions of the WISH Gift Card. WISH Gift Cards are redeemable at participating stores only. Any ancillary costs associated with redeeming a Woolworths WISH Gift Card are not included. Any unused balance of a Woolworths WISH Gift Card will not be awarded as cash. Redemption of a Woolworths WISH Gift Card is subject to any terms and conditions of the issuer including those specified on the Woolworths WISH Gift Card.
If the winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian, on behalf of the prize winner.
The Promoter may conduct such further draws at the same place as the original draw as are necessary on 16/04/2014 at 3:00pm AEST in order to distribute any prizes unclaimed by that date subject however to any written directions given by a regulatory authority. Winners of the unclaimed prize draw will be notified in writing within two (2) business days of the draw.
Prizes are not transferable or exchangeable and cannot be taken as cash.
Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem the prize by the time stipulated by the Promoter, then the prize will be forfeited.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant Regulatory Authority.
The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person's computer related to or resulting from participating in or downloading any materials in the promotion. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.

The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
