Terms and Conditions
1. DETAILS
1.1. The following terms and conditions (Terms and Conditions) and prize information (Prize Information) apply for the Melbourne Renegades' Win a Toyota RAV4 for a year! promotion (Promotion).
1.2. The Promoter is Melbourne Renegades Pty Ltd (ABN 84 153 209 628) (Promoter) of 86 Jolimont Street East Melbourne VIC 3002 (Telephone 1300 RENEGADES or 1300 736 342).
1.3. The Promotion commences at 9am AEDST on Monday 2 December 2013 and closes at 5pm AEDST on Thursday 16 January 2014 (Registration Period).
1.4. The prize period (Prize Period) refers to the 365-day period of the fully-maintained novated lease during which the Promotion winner is entitled to the use and benefits of the vehicle and lease arrangements.
1.5. All entrants must be Victorian residents. The prize vehicle will be registered in Victoria and registration of the vehicle must not be transferred interstate. Employees of Melbourne Renegades and agencies associated with this competition, and their respective immediate families, are ineligible to enter.
1.6. All entrants must be over the age of 18. To claim the Prize you must be over the age of 18.
1.7. Entries not completed in accordance with these Terms and Conditions are void. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
1.8. Information on how to enter the Promotion and prize details form part of these Terms and Conditions.
1.9. Incomplete, indecipherable, or illegible entries will be deemed invalid.
1.10. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
1.11. By registering, the entrant warrants that they have read, understood and accepted these Terms and Conditions and Prize Information.
1.Prize
2.1. The prize is one fully-maintained (includes scheduled servicing, limited fuel for 20,000km of travel, fully comprehensive insurance and registration for 12 months) Toyota RAV4 (2013 plated current model MY14) on a 12-month novated lease provided by LeasePLUS with all costs of the lease arrangement being paid by LeasePLUS ($20,000 value includes vehicle price, all budgeted costs, scheduled services, fuel, fully compressive insurance for 12 months and 12 months registration less the guaranteed buy back figure agreed between LeasePLUS and Nunawading Toyota)) (Prize).

2.2. Further details of the prize as follows:
2.2.1. Fully-maintained novated lease budgets have been calculated on 20,000km being travelled in 12 months (kilometre buffer of 2000km over 20,000km, as per guaranteed buy-back terms between LeasePLUS and Nunawading Toyota). The Promotion winner is entitled to use the vehicle (under novated lease conditions without being required to make any lease payments to LeasePLUS) for a period of 12 months or up to 20,000kms (whichever occurs first).
2.2.2. A Caltex StarCard debit card to the value of $2400 (inc GST) will be provided to the Promotion winner, with the use of such card capped at $200 (inc GST) fuel per month. Any additional fuel purchased by the Promotion winner must be paid for by the Promotion winner. Fuel budget of $2400 for 12 month period is based on fuel consumption of 7.71 litres for 100km, 20,000 kilometres travelled for the year at average cost of $1.55 per litre (Source:

2.2.3. Novated lease includes fuel (capped at $200 inc GST per month), vehicle maintenance, fully comprehensive insurance and on-road costs for one year.
2.2.4. The Promotion winner must provide personal details & driving history for insurance purposes. Fully comprehensive insurance is included in the Prize, however, driver details are required to create the policy.
2.2.5. The Promotion winner must ensure the vehicle receives one service at the six-month or 10,000km mark, whichever occurs first. The first service must be completed within two months of the time the service is required as set out in this clause 2.2.5. Failure to comply with this servicing requirement (set by Toyota capped price service program) could see any additional charges passed on to the competition winner.
2.2.6. Vehicle must be serviced at Nunawading Toyota. The Promotion winner will not be charged for the service.
2.2.7. The vehicle must not be modified in any way during the 12 month/20,000km Prize Period. This includes modifications such as the addition of any accessories to the vehicle such as headlight/bonnet protectors, nudge bars, side steps etc.
2.2.8. The Prize is to be returned at the end of the Prize Period (ie either 12 months or 20,000km of use whichever occurs first) in the same condition as provided to the Promotion winner (subject to Fair Wear and Tear). Any damage to the vehicle during the Prize Period must be reported to LeasePLUS for assessment and, where deemed required by LeasePLUS, action.
2.2.9. Fair Wear and Tear guidelines will be applied to the vehicle at the end of the 12 month/20,000km Prize Period. Any damage considered to be outside of these guidelines may result in repairs being carried out and the cost of any such repairs may (at the election of LeasePLUS) be paid by the competition winner. Any vehicle damage will be assessed in accordance with the Australian Fleet Lessors Association guidelines. A copy of these guidelines can be provided upon request.
2.3. Prize usage conditions will apply. The Prize must not be used:
2.3.1. as a race car;
2.3.2. for speed tests or contests;
2.3.3. in any illegal activities;
2.3.4. to carry any loads above the specified manufacturers limits; or
2.3.5. as a 4wd vehicle in off road conditions.
2.4. At the end of Prize Period, the Promotion winner will be given the following options:
2.4.1. purchase the vehicle outright at agreed vehicle value as determined by LeasePLUS and vehicle partner; or
2.4.2. continue to run the vehicle lease at the agreed monthly rental for a period of up to four years (at the cost of the Promotion winner); or
2.4.3. give the vehicle back to LeasePLUS.
2.5. The Prize is not transferable, cannot be exchanged and is not redeemable for cash. Prize values are in Australian dollars exclusive of GST and are based on the recommended retail value of the prize at the time of printing. The Promoter accepts no responsibility for any variation in the value of any prize. If a prize is unavailable, for whatever reason, the Promoter, in its discretion, reserves the right to substitute the prize for a prize of equal value and/or specification. To the extent permitted by law: (a) the Promoter makes no representations or warranties as to the suitability of the Prize; and (b) no compensation will be payable if, for any reason, a winner is unable to use the Prize as stated.
2.6. If a prize is unavailable, for any reason, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
1.How to enter
3.1. To receive entry into the Promotion you must take part in a game of skill by guessing how many balls are in the back of the Toyota RAV4.
3.2. Entrants must register their details (including name, email address and mobile telephone number) and guesses may be lodged via:
3.2.1. the Melbourne Renegades Win a Toyota RAV4 for a year! Facebook application (
http://woobox.com/qob5yz); or
3.2.2. the Promotion’s mini-site (
www.melbournerenegades.com.au/leaseplus); or
3.2.3. at any Melbourne Renegades home match during BBL|03 (either by completing an entry form and providing to a Melbourne Renegades representative, on your smartphone via the Facebook app and competition mini-site or as directed).
3.3. Entrants must ensure that the registration process is completed during the Registration Period.
3.4. There is a limit of one entry per person in the Promotion. If there is a dispute as to the identity of an entrant, the Promoter reserves the right in its sole discretion, to determine the identity of the entrant.
4. How to win the prize
4.1. The Promoter's decision on the Promotion winner is final and no correspondence will be entered into.
4.2. The Promotion winner will be the entrant who lodges the first correct guess with the Promoter. If no winner is determined using this criterion, then the first entry received by the Promoter that is closest to the correct number of balls will be named winner.
4.3. Promotion winner will be determined at Cricket Victoria, 86 Jolimont Street, Jolimont, VIC 3002 on Friday 17 January at 11am. The prize winner does not need to be present at time of draw to be declared the winner of the Prize.
4.4. The winner will be announced at the Melbourne Renegades’ final BBL|03 home match on Saturday 18 January 2014 and notified by email and/or phone. The Promoter will advise the winner about how and when they are to accept their prize. If for any reason a winner does not take the prize at the time stipulated by the Promoter, the prize will be forfeited.
5. Personal Information
5.1. The Promoter collects personal information in accordance with the Promoter's privacy policy (available from
http://www.melbournerenegades.com.au/privacy-policy) in order to conduct the Promotion. Entry into the Promotion is conditional on the provision of this information by an entrant.
5.2. Information about an entrant may be disclosed to third parties, including but not limited to, agents, contractors, service providers, sponsors, prize suppliers and respective corporate partners [however the information will not be disclosed to anyone outside Australia].
5.3. Information about an entrant may be used by the Promoter and by such third parties for the purposes of carrying out promotional, marketing, planning, product development, publicity, research and profiling purposes, including sending electronic messages, direct mail and telephoning the entrant, unless the entrant withdraws their consent to the use of their information in this manner.
5.4. An entrant may opt-out of direct marketing at any time by utilising the unsubscribe feature on electronic marketing communications or contacting the Promoter.
5.5. Entrants should refer to the Promoter's privacy policy for details about how to access and request correction of their personal information held by the Promoter or make a complaint about the handling of their personal information, and for information about how a complaint will be dealt with by the Promoter.
6. Acknowledgement of risk and exclusion of liability
6.1. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) and prize supplier excludes all liability (including negligence) for any personal injury suffered or sustained in connection with this Promotion or prizes or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion including but not limited to where arising out of the following:
6.1.1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
6.1.2. any theft, unauthorised access or third party interference;
6.1.3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
6.1.4. any variation in prize value to that stated in these Terms and Conditions;
6.1.5. any tax liability incurred by a winner or entrant; or
6.1.6. any use of the prize.
6.2. As a condition of accepting the Prize, the winner may be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form and documentation relation to the lease arrangement.
7. Other
7.1. Entrants consent to the Promoter and prize supplier using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and prize supplier.
7.2. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
7.2.1. to disqualify any entrant; or
7.2.2. to modify, suspend, terminate or cancel the Promotion, as appropriate.
7.3. Any cost associated with accessing the Promotion mini-site or Facebook application is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
7.4. All entries become the property of the Promoter.
7.5. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php.
7.6. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook.
