TERMS AND CONDITIONS
1.Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to registered businesses operating in Australia located within 100kms of a Kwik Kopy Centre (“Eligible Business”). See
http://www.kwikkopy.com.au/browse-centres for a full list of Kwik Kopy Centre locations. The Promoter reserves the right to determine whether a business is an eligible business, in its sole discretion. Any queries on whether a business is an eligible business for the purposes of this promotion, should be directed to the Promoter at Kwik Kopy Australia, PO Box 657 Northbridge NSW 1560. Subject to the above, ineligible businesses include, but are not limited to, print franchisees, printers, graphic designers, design agencies, design studios, web designers, web developers, branding agencies and merchandise suppliers.
3.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.Promotion commences on 04/10/2013 and final entries close at 4:00pm AEDST on 14/02/2014 (“Promotional Period”).

www.kwikkopy.com.au/ideas, follow the prompts to the promotion entry page, input the requested details including an answer to the question
“Why do you think your business needs help with their website?” in 500 words or less, and submit the fully completed entry.
6.The Promoter reserves the right, at any time, to verify the validity of entries authorised representatives and Eligible Businesses (including place of employment, identity, age and place of residence) and to disqualify any Eligible Business whose authorised representative submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights
7.Incomplete or illegible entries will be deemed invalid.

.Only one (1) entry permitted per Eligible Business 9.The judging will take place at Kwik Kopy Australia, Level 1, 115 Sailors Bay Road, Northbridge, New South Wales, 2063 from 12:00pm (noon) AEDST on 26/03/2014. The winning Eligible Businesses will be notified by telephone. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question, as well as how compelling the response is and how Kwik Kopy will be able to positively influence their business. The Promoter’s decision is final and no correspondence will be entered into.

The best five (5) valid entries, as determined by the judges, will each win Kwik Kopy credit up to the value of $10,000 (including GST). The Kwik Kopy credit is to be used towards one (1) website design (either design of a new website or the re-design of an existing website) for the winning Eligible Business, including but not limited to, consultation, building/re-designing of the website (as the case requires) and providing content for the website, as well as hosting the website for the first twelve (12) months from the date the website goes live (if required). The value of the prize will be based on the time spent by the Promoter and its team working on the individual project and the services required, as per the Promoter’s standard rate card. The $10,000 Kwik Kopy credit cannot be used for any other product or service aside from design, development, consultation, image purchase and hosting of a website. Any other products and or services requested by the Eligible Business will be charged separately at a cost to the winner. All services provided must be able to be performed internally by the Promoter and not go beyond the Promoter’s standard capabilities, as determined by the Promoter in its absolute discretion. The Promoter may refuse to undertake a project if it is beyond its capability or is illegal or exposes the Promoter to legal challenge. The Kwik Kopy credit must be redeemed within twelve (12) months from signing the Scope of Work document (as detailed below). Any unused value of the credit will be forfeited, including any value remaining after twelve (12) months.
11.As a condition of accepting the $10,000 Kwik Kopy credit, an authorised representative on behalf of a winning Eligible Business must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form, and a Scope of Work document Services Agreement.
12.Any ancillary costs associated with redeeming a Kwik Kopy credit are not included. Any unused balance of a Kwik Kopy credit will not be awarded as cash. Redemption of a Kwik Kopy credit is subject to any terms and conditions of the issuer.
13.If for any reason an Eligible Business does not redeem their credit by the time stipulated by the Promoter, then the credit will be forfeited
14.Credits are not transferable or exchangeable and cannot be taken as cash.
15.As a condition of entering this promotion, each authorised representative, on behalf of an Eligible Business, licenses the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each authorised representative, on behalf of an Eligible Business warrants to the Promoter that each entry submitted is an original literary work of the Eligible Business that does not infringe the rights of any third party. Authorised representatives, on behalf of an Eligible Business agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Authorised representative, on behalf of Eligible Business consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
16.Authorised representatives, on behalf of Eligible Businesses, consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
17.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
18.Any cost associated with accessing the promotional website is the Eligible Business’s responsibility and is dependent on the Internet service provider used.
19.Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the Eligible Business. Eligible Businesses should seek independent financial advice in this regard.
20.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
21.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business; or (f) use of a credit.
22.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Business. Authorised representatives on behalf of Eligible Businesses should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
23.The Promoter is Kwik Kopy Australia Pty Limited (ABN 27 002 218 822) of Level 1, 115 Sailors Bay Road, Northbridge NSW, 1560.
