TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Repco & Appco Trade Account Customers who are operating in Australia and New Zealand and are aged 18 years or older.
3. Employees (and their immediate families) of the Promoter, participating Repco or Appco stores and agencies associated with this promotion are ineligible to enter.
4. Kmart Tyre & Auto & Shell are not permitted to enter.
5. The promotion starts at 8:00am on 01/12/2013 and closes 5:00pm (AEDST/NZST, whichever is applicable) on 31/01/2014 (Promotional Period).
To be eligible to enter participants must register before January 31st 2014 via the dedicated website:
www.gatespromo.com.au and completing the entry form including business name, name, phone, email address and Repco / Appco trade account number. Simply Purchase Gates Products through a current Repco or Appco account during the promotional period a minimum of $300 (ex GST) to qualify to participate in the promotion to receive 1 x entry. All subsequent purchases of any Gates products within the promotional period receive 1 x additional entry into the promotion sweepstakes for every $50 spent exclusive of GST.
6. This promotion consists of 1 major prize draw, to be drawn at Flow Marketing, 107/9 Claremont Street, South Yarra VIC Australia 3141.
7. The major prize will be drawn at 12:30pm AEDST on Tuesday 4th February 2014. Major Prize - There will be nine (9) Eminem Concert Experiences to be won each valued up to: $2,200 AUD available to be won. The first nine (9) valid entries drawn from all valid entries received from Repco businesses operating within Australia & New Zealand will win the major prize.
8. The major prize is an Eminem Concert Experience Event for 2 people to attend the Eminem Concert scheduled to be held on Wednesday 19th February 2014. The prize includes where applicable: - Return flights (economy) from the winners nearest capital city to Melbourne (Australia) for 2 people. Arrival in Melbourne on the morning of Wednesday 19th February 2014 and departure on the afternoon of Thursday 20th February 2014.
- Accommodation in a twin share standard room in a 4 star property in Melbourne, Australia for 1 night (Wednesday 19th February 2014) including breakfast for 2 people.
- 2 tickets for attendance at Eminem Concert at Etihad Stadium on Wednesday 19th February 2014 (evening) as a guest of Gates & Repco, including: Premium Level 2 Reserved Seat, Two and a half hour pre-show function, Gourmet cocktail menu with premium beer, wine, RTDs and soft drinks, Exclusive themed room, Official merchandise item, One hour post-show drinks, Prize is non-transferable and must be taken on the dates specified above.
9. If the winner is not from Victoria, the major prize also includes two (2) x return economy airfares to Melbourne Australia from the winners nearest Australian or New Zealand capital city (carrier selected by the Promoter). If the winner is from Victoria, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash.
10. The winners location will be determined by the location of the registered business. Each double pass will be awarded to the location of the registered business and will not be separated.
11. Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
12. Prize must be taken to coincide with the Eminem Concert at Etihad Stadium, which is scheduled to take place Wednesday 19th February 2014. Prize is subject to booking and flight availability.
13. The winner and his/her companion is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation where required. The winner must depart from and return to the same departure point.
14. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary.
15. Frequent flyer points will not form part of the prize.
16. Prize is subject to the standard terms and conditions of individual prize and service providers.
17. The winner and companion may be required to present their credit card at time of accommodation check in.
18. In the event of war, terrorism, state of emergency, event cancellation from organizers or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
19. The winners and companions acknowledge that the Event may be cancelled or re-scheduled for any reason, other than as set out in the Conditions of Sale of tickets to the Event and the Promoter accepts any responsibility for such cancellations. The winner also acknowledges that participation in any event may be subject to additional terms and conditions imposed by third parties. The winner and companions must become acquainted with any additional terms & conditions of participation prior to participation in any event.
20. Winners will be notified by telephone and in writing. Winners names will be published in the Australian Newspaper Thursday 6th February, 2014.
21. Prizes will be awarded to the authorised representative of the respective winning business, as provided through the registration process.
22. If for any reason the winning business does not claim the Prize by 12:00pm AEDST on Monday 11th February 2014, then the Prize will be forfeited and the winner will be the first reserve (if any) drawn at the time of the original draw set out in clause 8. or if any reserve entries were drawn, will be re-drawn in accordance with clause 26.
23. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
24. Total prize pool in Australia and New Zealand is valued up to AUD$19,800.
25. Prizes or part of the prize are not transferable or exchangeable and cannot be taken as cash.
26. A draw for any unclaimed minor and major prizes may take place at 12 noon AEDST on 11/02/2014 at Flow Marketing, 107/9 Claremont Street, South Yarra VIC 3141, subject to any directions from a regulatory authority. Winners of any second chance draw will be notified by telephone and in writing.
27. Authorised representatives of Eligible Businesses consent to the Promoter using the business name, likeness and/or image in the event they are the winning business (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Businesses and/or its authorised representative; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and in New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winning business or Eligible Business (or its authorised representative); or (e)use of a prize.
31. As a condition of accepting the prize, the authorised representative of the winning business must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
32. The Promoter collects personal information of authorised representatives of Eligible Businesses in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Business and/or its authorised representative. Authorised representatives of Eligible Businesses should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
33. The laws of Australia apply to this promotion to the exclusion of any other law. Eligible Businesses submit to the exclusive jurisdiction of the courts of Australia.
