“VAALIA & PAULS BACK TO SCHOOL” PROMOTION TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over.
3. Employees (and their immediate families) of the Promoter, participating IGA, Supa IGA, IGA Express and Foodland supermarkets and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences on 13/01/2014 and ends at 11:59pm AEDST on 23/02/2014 (“Promotional Period”).
5. To be eligible to enter, individuals must spend $5.00 or more in a single transaction on Eligible Product(s) (defined below) at a participating IGA, Supa IGA, IGA Express or Foodland supermarket in Australia during the Promotional Period (“Qualifying Transaction”). For the purposes of this promotion, participating IGA, Supa IGA, IGA Express and Foodland supermarkets will be any IGA, Supa IGA, IGA Express or Foodland supermarket displaying material advertising this promotion during the Promotional Period.
“Eligible Products” are: Vaalia Kids Yoghurt Pouch Vanilla 140g, Vaalia Kids Yoghurt Pouch Banana 140g, Vaalia Kids Yoghurt Pouch Strawberry 140g, Vaalia Kids Lactose Free Yoghurt Pouch Vanilla 140g, Vaalia My First Yoghurt Pouch Vanilla 70g, Vaalia My First Yoghurt Pouch Pear 70g, Vaalia My First Yoghurt Pouch Apple 70g, Vaalia My First Yoghurt for Babies & Toddlers Vanilla Strawberry 6x90g, Vaalia My First Yoghurt for Babies & Toddlers Vanilla Banana 6x90g, Pauls Yoghurt Pouch Vanilla 70g, Pauls Yoghurt Pouch Strawberry 70g, Pauls Yoghurt Pouch Banana 70g, Pauls Custard Pouch Vanilla 70g, Pauls Custard Pouch Chocolate 70g, Pauls Scooby Doo Yoghurt 12x90g pack, Pauls Tweety Yoghurt 12x90g, Pauls Tweety Yoghurt 6x90g, Pauls Custard Snack Pack 6x150g, Pauls Custard & Fruit Snack Pack Strawberry 6x150g and Pauls Choc Shock 12x100g .
6. To enter, individuals must then visit www.amazingtoystorenewyork.com.au, follow the prompts to the promotion entry page, input the requested details (including but not limited to their full name, a valid email address, the last 4 digits of each Eligible Product barcode number and the full purchase receipt number for the Qualifying Transaction), and submit the fully completed entry form so it is received by 11:59pm AEDST on 23/02/2014. Instant Prize winners will be notified immediately on screen.
7. There will be one (1) Instant Prize awarded each day of the Promotional Period, for a total of forty-two (42) Instant Prizes. All entries received (from winners and non-winners of an Instant Prize) during the Promotional Period will be entered into the Major Prize Draw. Entrants that spent between $5.00 and $9.99 in the Qualifying Transaction will receive one (1) entry into the Major Prize Draw, and entrants that spent $10.00 or more in the Qualifying Transaction will receive two (2) entries into the Major Prize Draw.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted for each Qualifying Transaction where between $5.00 and $9.99 was spent on Eligible Product(s); (b) only two (2) entries permitted for each Qualifying Transaction where $10.00 or more was spent on Eligible Product(s); (c) each entry must be submitted in accordance with entry requirements; and (d) a maximum of two (2) entries per person per day is permitted.
10. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, that $5.00 or more was spent on Eligible Product(s), and that the purchase was made during the Promotional Period but prior to entry.

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. The draw will take place at MessageMedia Interactive, Level 22, 385 Bourke Street, Melbourne, VIC 3000 at 3:00pm AEDST on 03/03/2014 (“Major Prize Draw”). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
14. Instant Prize winners will be notified immediately on screen and their names will be published online at www.amazingtoystorenewyork.com.au on 14/03/2014. The Major Prize winner will be notified in writing within two (2) business days of the draw and their name will be published online at www.amazingtoystorenewyork.com.au on 14/03/2014.
15. The Promoter’s decision is final and no correspondence will be entered into.
16. Instant Prizes: forty-two (42) x AU$500 EFTPOS Gift Card.
17. The first valid entry drawn in the Major Prize Draw will win a trip for four (4) people to New York City, USA, valued at up to AU$30,800 depending on date and point of departure (“Major Prize”). Major Prize includes:
 return economy airfares from the winner’s nearest Australian capital city to New York City, USA
for four (4) people;
 return transfers from the New York City airport to the accommodation for four (4) people;
 seven (7) nights twin-share accommodation in a deluxe suite at a 5-star hotel in New York City for
four (4) people (exact hotel to be determined by the Promoter in its absolute discretion);
 continental breakfast with a FAO Schwarz Toy Soldier at the FAO Schwarz Flagship Store one
hour before the store opens to the public (exact menu to be determined by the Promoter in its absolute discretion), a 45 minute private tour of the store hosted by an FAO Toy Soldier, private time on the Big Piano (exact time allowed on the Big Piano will be determined by the Promoter in its absolute discretion) and a FAO Schweetz “Candy Raid” for four (4) adults;
 four (4) general admission tickets to the Central Park Zoo;
 four (4) tickets to a Broadway show (exact show to be determined by the Promoter in its absolute
discretion);
 a helicopter tour of New York City for four (4) people; and
 AU$1,000 spending money for the winner, to be deposited into a bank account in the winners
name.
Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 02/03/2015 and is subject to booking and flight availability. Blackout periods apply, which include Australian and USA school holidays, public holidays and other peak periods.
18. The Major Prize winner and his/her companions are responsible for ensuring that they have passports which are valid for at least six (6) months from the selected date of departure, and any requisite visas, vaccinations and travel documentation. The Major Prize winner and his/her companions must depart from and return to the same departure point and travel together. Itinerary of the Major Prize to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the Major Prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. Major Prize winner may be required to present their credit card at time of accommodation check in. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.

19. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
20. EFTPOS Gift Card must be activated by 23/05/2014 by visiting www.giftcardplanet.com.au or calling 1300 079 267. If a winner fails to activate the EFTPOS Gift Card by 23/05/2014, then the EFTPOS Gift Card will be forfeited and the winner shall not be entitled to any compensation. Once activated, the funds on the EFTPOS Gift Card will be available from 12:00pm the following business day. EFTPOS Gift Card is only valid for 12 months from date of activation. Any ancillary costs associated with redeeming the EFTPOS Gift Card are not included. Any unused balance of the EFTPOS Gift Card will not be awarded as cash. Redemption of the EFTPOS Gift Card is subject to any terms and conditions of the issuer including those specified on the EFTPOS Gift Card. 21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. Total prize pool value is up to AU$51,800.
23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
24. A draw for any unclaimed prizes may take place on 03/06/2014 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their name(s) will be published online at www.amazingtoystorenewyork.com.au on 17/06/2014.
25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any

technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize or participation in the Major Prize.
31. As a condition of accepting a prize, each winner (and the Major Prize winner’s companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. The winner’s companions that are under the age of 18 must have their parent/guardian sign the legal documentation required under this clause on their behalf.
32. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
