T&Cs
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to residents of Australia aged 18 years or over.

3. Entries must be submitted through the Invisible Zinc website www.invisiblezinc.com.au

4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. Promotion commences on Friday 10 January 2014 at 5.00am AEDT and entries close at midnight AEDT on Friday 31 January 2014. (Promotional Period).

6. To be eligible to enter, individuals must enter their details on the promotion page on the Invisible Zinc website at www.invisiblezinc.com.au, and answer the question ‘How will you protect your skin from the sun this summer?’

7. The Promoter reserves the right to exclude any entries which it believes to be in breach of these Terms and Conditions.

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. One entry only per person is permitted.

10. The Promoter reserves the right, at any time, to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.

11. Incomplete or indecipherable entries will be deemed invalid.

12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based the originality and creative merit of their answer to the question ‘How will you protect your skin from the sun this summer?’ The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

14. Judging will take place on Monday 3 February 2014. Winners will be notified via email.

15. The Promoter’s decision is final and no correspondence will be entered into.

16. There will be 400 winners. Each winner will receive the following:

a. 1 x 60 minute initial consultation conducted at a Molemap Clinic, valued at $375.00. The prize is for one free full body MoleMap only. Any subsequent appointments will be at the expense of the winner. The winner shall be bound by Molemap Clinic’s terms and conditions for the consultations and the Promoter shall not be liable for the consultation or the results of the consultation.

17. Any ancillary costs associated with redeeming the prize are not included and are the responsibility of the winner/s.

18. Whilst every attempt will be made to ensure the most appropriate time for winner/s appointments, it may not be possible to make a booking at the time chosen by the winner.

19. The Promoter accepts no liability in the event an unforseen circumstance causes the Molemap clinic to be closed on the date of the winner/s appointment. In such a case the winner will be offered an alternative appointment time.

20. If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

22. Total prize pool value is $150,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

23. Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.

24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

26. Any cost associated with accessing the Invisible Zinc website is the entrant’s responsibility and is dependent on the Internet service provider used.

27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.

30. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and/or indemnity form.

31. The Promoter collects and uses information you supply as set out in the iNova Australian Privacy Policy (http://inovapharma.com/privacy/). We collect personal information for its business purposes including to conduct the promotion and may, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant Consistent with our Privacy Policy we may disclose some or all of the information we collect about you to third parties outside Australia or to transfer the personal information to a cloud. We may also disclose your personal information as required by Australian regulatory authorities.
