Smart Pay and Win Promotion - Terms and ConditionsBy submitting an entry to this promotion, you are deemed to have accepted these terms and conditions. This promotion is being run by Telstra Corporation Limited (ABN 33 051 775 556) of 400 George St, Sydney NSW 2000 ("we", “us” or “our”).
Dates you need to know
The promotion starts at 11:00am AEDST on 13 November 2013. Entries close and must be received by 12:00pm AEDST on 13 February 2014 ("promotion period").
The computerised draw will take place at Level 2, 400 George St, Sydney NSW 2000 on 27 February 2014 at 11am AEDST. Our decision is final and no correspondence will be entered into.
Winners will be notified by telephone and in writing within 2 days of the draw. Winners’ names (for prizes over $250) will be published in The Australian on 6 March 2014.
Who can enter?
Entry is open to all Australian residents, over the age of 18 who are Telstra Post-Paid account holders, who are not signed up for direct debit, other than our officers, employees or contractors and other companies associated with the promotion, and their immediate families.
How do you enter?
To enter, you must, during the promotion period:
register your details on the competition entry form available at the website
www.telstra.com/smartpayandwin;sign up for direct debit; and
remain on direct debit for the remaining duration of the promotion period.
Only one entry per person will be accepted.
Invalid Entries
We may verify the validity of entries (including an entrant’s identity, age and address). Entries that are incomplete, indecipherable or illegible will be deemed invalid. We may disqualify entries that do not comply with these terms and conditions.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter.
The Prizes
The first valid and correct entry drawn will win 1 x new Silver 3.6L 6 speed automatic 2013 VF Holden Commodore SV6 including on road costs (stamp duty, registration and CTP insurance) (based on WA on road prices) valued at $36,768.12 (GST inclusive)(“first prize”).
The second entry drawn will win 1 x Flight Centre travel voucher valued at $10,000 (GST inclusive)(“second prize”).
The third entry drawn will win 1 x Pre-Paid gift card from Smart Loyalty Marketing valued at $5,000 (GST inclusive)(“third prize”).
First prize will be delivered to the prize winner’s nearest Holden dealer to be collected by the prize winner.
Second and third prizes will be delivered to the prize winners nominated delivery address by registered mail.
Standard terms and conditions apply for the use of the gift card and travel voucher and is subject to change. The terms and conditions which apply for the use of the gift card or travel voucher at the time it is issued to the Prize winner will prevail over these terms and conditions to the extent of any inconsistency.
We accept no responsibility for any variation in the value of the prizes.
The total prize pool value is $51,768.12 (incl. GST).
All other expenses become the responsibility of the winner.
Unclaimed prize draw
Subject to the unclaimed prize draw clause, if for any reason whatsoever a winner does not redeem a prize or an element of the prize by the time stipulated by us, then the prize or that element of the prize will be forfeited by the winner and cash will not be awarded in lieu.
If required, an unclaimed prize draw may take place on 15 May 2014 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on 22 May 2014.
Photographs and comments from the winner
If you are the winner, we may contact you about the promotion, and take photos of you, and use your comments and photos for promotional and marketing purposes. If we do so, you grant us a royalty free, perpetual and irrevocable licence to use your comments and the photos for such purposes.
Use and disclosure of your information
We may use and disclose the information you provide in submitting an entry on the terms and for the purposes, including marketing, set out in our Privacy Statement, and as required to conduct this promotion, which may include disclosing that information to prize suppliers. Supply of an alternative prize
If we are unable to provide a winner with a prize (or part of a prize), we will supply an alternative prize (or that part of the prize) of greater or equal monetary value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
If there is a dispute about the identity of an entrant, the entrant will be deemed to be the person in whose name the corresponding phone account is held.
Suspension, cancellation, modification or termination of the promotion
If for any reason beyond our reasonable control, we are not able to conduct the promotion as anticipated, we may disqualify any entrant, or subject to any written directions from a regulatory authority, take any action that may available to us including cancel, suspend, modify or terminate the promotion.
Liability excluded
The Promoter excludes all warranties in relation to supply of the Prize, except those that cannot be excluded by law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any rights a consumer may have which are unable to be excluded under Australian law, is limited to the payment of the costs of having the Prize supplied again.
To the extent permitted by law, we will not be liable for any loss or damage or personal injury suffered or sustained in connection with the promotion including the prize or the taking of the prize. We accept no responsibility for any tax liabilities that may arise from winning the prize.
