Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet or SMS only.
Entry into the promotion is only open to Australian residents aged 16 years or older (Entrants). The directors, management and employees (and their immediate families, including their children and wards, and other persons residing in their household) of the Promoter, its related entities, corporations or franchisees, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.
Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion and provide Personal Information about themselves. All entries of Entrants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental/ legal guardian consent (as and where required) will be deemed invalid. These Conditions of Entry will bind the Entrants and any parent or legal guardian who gives their consent (for Entrants aged under 18 years). If any prize winner is aged under 18 years, the prize will be awarded to the parent or legal guardian who consented to the prize winner entering the promotion, at the discretion of the Promoter.
Promotion starts at 12:00am (AEDT) on 1/2/2014 and ends 11:59pm (AEDT) on 28/2/2014 (Promotional Period). The promotion is divided into twenty-eight (28) promotional days (Promotional Days), for the purpose of awarding prizes in this promotion.
To enter, Entrants must, during the Promotional Period:
obtain a receipt or a promotional contingency card (Game Card) containing a unique letter combination (Unique Code).
submit the Unique Code by either:
sending an SMS in the required format to 1999 1444. The required SMS format is “UNIQUE CODE” + SPACE + “ENTRANT’S FIRST NAME” + SPACE + “ENTRANT’S LAST NAME” + SPACE + “ENTRANT’S POSTCODE”; or
logging on to www.mcdonalds.com.au/amorepromo (Promotional Website) and completing and submitting in full the online entry form in the manner required, including the Entrant’s full name, address, date of birth, current and valid email address, mobile telephone number, postcode and the Unique Code.
Unique Codes are issued with any purchase, at the prevailing usual retail price, of the following products:
1 Unique Code - Extra Value Meal, being a meal consisting of a burger/ Real Choices Salad/ Real Choices McWrap, fries/garden salad and a beverage;
1 Unique Code - Breakfast Extra Value Meal which is a meal consisting of a McMuffin/breakfast wrap/breakfast roll, hashbrown and a beverage;
1 Unique Code - Amore Lunch/Dinner Meal, being a meal from the promotional Amore dinner/lunch menu offering;
1 Unique Code - Amore Breakfast Meal, being a meal from the promotional Amore breakfast menu offering;
2 Unique Codes – Chicken Dinner Box;
2 Unique Codes - Family Favourites Dinner Box; or
2 Unique Codes – Family Value Dinner Box,
from a participating McDonald’s restaurant in Australia during the given participating McDonald’s restaurant’s usual opening hours (Eligible Purchase). Not all participating McDonald’s restaurants will be open at all times during the Promotional Period.
Purchase receipts or Game Cards containing Unique Codes must be obtained from staff at the participating McDonald’s restaurant where the relevant Eligible Purchase is made. If staff advise that they are unable to issue a purchase receipt for any reason, a Game Card may be handed out by staff in place of a purchase receipt. If staff fail to provide a purchase receipt or Game Card/s containing Unique Code/s the customer should request them to do so. However, Game Cards and Unique Codes are subject to availability at each participating McDonald’s restaurant and are based on reasonably anticipated demand. Game Cards and Unique Codes may not be available at all times during the Promotional Period. The Promoter accepts no responsibility for any Game Cards or Unique Codes being unavailable at a McDonald’s restaurant during the Promotional Period.
Every Entrant must retain their purchase receipt or Game Card once they have entered the promotion. If an Entrant does not make the purchase of the Eligible Purchase, the Entrant must retain the purchase receipt or Game Card from the purchaser of the Eligible Purchase.
Limit of six (6) entries per person for each Promotional Day permitted via SMS and/or the Promotional Website. Each entry must be submitted separately and must independently comply with these Conditions of Entry. An Entrant can use a purchase receipt or Game Card to enter the Promotion at any time during the Promotional Period. For example, if a purchase receipt had ten (10) Unique Codes, on the same Promotional Day an Entrant could enter three (3) Unique Codes via the Promotional Website and three (3) Unique Codes via SMS. The Entrant would need to wait for a subsequent Promotional Day to enter the remaining four (4) Unique Codes.
SMS entries: SMS Entries must be made via SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants must be identified as having a clear relationship with the end mobile device and have the bill payer’s permission to enter the promotion or their entry will be deemed invalid. Maximum SMS cost $0.55 (including GST). Standard carriers' SMS costs may apply. Standard carrier SMS costs remain the responsibility of each Entrant and are dependent on the carrier used and an Entrant’s mobile phone plan. Any SMS entries submitted after the Promotional Period has closed will not be included in the promotion and will incur the $0.55 (including GST) charge. The charges for all SMS entry services will appear on the Entrant’s next mobile phone bill. All general queries relating to mobile bills should be directed to the Entrant’s mobile or telephone carrier. Mobile premium service provided by MessageMedia Interactive. For help using the mobile premium service, call the mobile premium service helpline on 1300 060 106. If an Entrant wants to subscribe to receiving electronic marketing messages they can SMS 0421 262 400 with the word “Yes”. Standard carrier’s SMS costs will apply.
A free reply SMS will be sent to a SMS Entrant after their entry has been received confirming their entry has been successfully received, advising whether or not they are an instant winner and if they are an instant winner, what prize they have won and how to redeem their prize. If an SMS entry is not successful because it is not in the required SMS format or the Unique Code submitted by the Entrant is not recognised by the Promoter as a valid Unique Code for the promotion, an “invalid entry” message will be sent to the originating phone number. The “invalid entry” message will prompt an Entrant to check their Unique Code and resubmit their SMS entry in the required format or with valid entry details. If an Entrant elects to resubmit their SMS entry, the Entrant will incur an additional premium entry SMS $0.55 (including GST) charge. SMS Entrants who re-submit a Unique Code already submitted from their mobile phone number will receive a reply SMS rejecting their entry and notifying the Entrant that the Unique Code may have already been entered for that mobile number. SMS Entrants who attempt to submit more than six (6) entries per day will receive a reply SMS rejecting their entry and notifying the Entrant that they have reached their entry limit.
Online entries: Once an Entrant submits their entry and the Promoter receives and confirms the entry has been successfully received, a message will appear on screen immediately advising the Entrant whether or not they are an instant winner, what prize they have won and how to redeem their prize. If an online entry is not successful because the Unique Code submitted by an Entrant is not recognised by the Promoter as an eligible Unique Code for the promotion, or entry fields are incomplete or invalid, an “invalid” message will appear on screen. The “invalid” message will prompt the Entrant to check their Unique Code and other details and resubmit their online entry in the manner required. Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Internet service provider used. Online Entrants who attempt to submit more than six (6) entries per day will receive an on-screen notification advising the Entrant that they have reached their entry limit.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received. Contact details entered incorrectly by an Entrant on the Promotional Website or in a SMS entry will deem an entry invalid.
Each Entrant must retain and may be required to present proof of each Unique Code and its connection to an Eligible Purchase in order to claim a prize. An Entrant may be required to provide to the Promoter proof of Unique Codes and their connection to Eligible Purchases for all entries made. If an Entrant is unable to provide proof for all entries made within the required timeframes, then all the entries of that Entrant may be ineligible and deemed invalid. Proof may include showing the original and providing a photocopy of the original purchase receipt or Game Card for each Eligible Purchase made during the Promotional Period. As relevant, purchase receipt(s) and Game Card(s) must be intact, must clearly display the Unique Code utilised by the Entrant, must clearly state the participating McDonald’s restaurant and indicate that the Eligible Purchase was made during the Promotional Period but prior to entry.
All prize winners will be notified by telephone and in writing. Winners’ full names and localities (including postcode) will be published at www.mcdonalds.com.au/amorepromo within three (3) business days of receiving a message from the Promoter that they are a winner. Winners’ names (and localities, where available) will be published in The Australian on 3/03/2014. All reasonable steps to notify winners of the results of the promotion will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
Within three (3) business days of a winner receiving an online or SMS message that they are a winner, the Promoter will contact the winner by telephone to facilitate their prize claim (Claim Call). If a winner has not heard from the Promoter within (3) business days of the Entrant receiving an online or SMS message that they are a winner, the winner should contact the Promoter’s customer service line on 1300 060 106. During a Claim Call the winner must provide all details requested including full name, current and valid email, mobile telephone number and nominated postal address. The Promoter will also carry out prize validation checks (including those set out in these Conditions of Entry) and may require the winner to send to it various documents for validation. Once the Claim Call has been completed successfully and the Promoter has successfully carried out its prize validation processes, the Promoter will contact the winner to notify it is a verified winner and organise collection of the prize.
Prizes: Each Promotional Day will commence at 12:00am (AEDT) and close at 11:59pm (AEDT) on the same day during the Promotional Period. Subject to Condition 19, one (1) prize will be awarded each Promotional Day. On one (1) occasion per Promotional Day at a randomly determined time an instant winner will be selected. The prize winning time slot will be randomly determined for each Promotional Day (Prize Winning Time Slot). The first eligible entry received after the Prize Winning Time Slot, will win one (1) 2013 FZ Suzuki Swift GL (Auto), valued at up to $16,490.00 each depending on winner’s location (Daily Prize). On four (4) Promotional Days selected by the Promoter during the Promotional Period, the Daily Prize will be substituted with a Suzuki S-Cross GLX (Auto), valued at up to $33,244.00 each depending on winner’s location (Special Daily Prize).
Total of twenty-four (24) Daily Prizes and four (4) Special Daily Prizes to be given away across the Promotional Period, with the total maximum prize pool for all prizes valued at up to $528,736.00 depending on winner’s location.
If there is no eligible entry received by the Promoter after a Prize Winning Time Slot on any particular Promotional Day then the Daily Prize or Special Daily Prize (as applicable) for that particular Promotional Day will roll over to the immediately following Promotional Day and the winner will be the first eligible entry submitted on that subsequent Promotional Day. In the event that there is no subsequent Promotional Day, the process under Condition 20 will take place.
If there is no eligible entry received by the Promoter, after, the final Prize Winning Time Slot then a draw will be carried out at 3:00pm (AEDT) on 3 March 2013 at Level 2, 106 Parramatta Road, Stanmore NSW 2048 for all eligible entries received on the relevant Promotional Day to determine a winner.
Each of the Daily Prizes and Special Daily Prizes are inclusive of 12-months registration in each winner’s State or Territory of residence, 12-months third party compulsory insurance, on road costs, stamp duty and dealer delivery costs, dependent upon the State or Territory of each winner’s usual residential address. Daily Prizes are available in silver, red, copper and gray. Special Daily Prizes are available in red, silver and metallic white. All ancillary costs or accessories not expressly provided are the responsibility of each winner. Each prize excludes comprehensive insurance, operational costs, fuel, personal costs and any other ancillary or incidental costs related to each prize or anything else not specifically mentioned in this Condition 21, which are the responsibility of each winner. It is a condition of accepting a prize that a winner acknowledges that they may incur ongoing costs associated with a prize which are the entire responsibility of each winner. Confirmation of ownership of the vehicle will be provided to the winner within 28 days from the date of winner verification. Delivery or collection of the vehicle (as applicable) is subject to availability of the vehicle, but is anticipated to be within eight (Cool weeks from the date of winner notification. To be eligible to claim a prize, a winner must be capable of obtaining motor vehicle registration of the motor vehicle prize in his or her name in accordance with the applicable legislation in the Australian State or Territory in which each prize is collected (as applicable). If a winner is, through any legal incapacity or otherwise, unable to register the motor vehicle prize in his or her name then such winner may assign the motor vehicle prize to another person with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between winner and an assignee.
It is a condition of being awarded a prize that a winner must, following winner notification and prior to the awarding of a prize, confirm their full name and address, and provide the Promoter with a copy of their current and valid Australian driver’s license. A winner of a prize must provide all information and sign all documentation necessary to enable the Promoter (or its nominated dealer) to register a vehicle in a winner's name prior to a winner’s collection of the car from the Suzuki dealership. Each prize will be available for collection by a winner at the Suzuki dealership closest to a winner’s place of residence as stated in their entry details. All costs associated with travel to and from the dealership is at the winner’s own cost. Further details and locations of Suzuki dealerships can be found at www.suzuki.com.au. The Promoter accepts no responsibility for any mechanical, body or paint repairs or repairs or maintenance of any kind relating to the prize after the date and time of prize collection by a winner. Any vehicles depicted in any promotional material are not necessarily the same colour or grade as each prize vehicle, and are for illustration purposes only.
The prizes are not transferable or exchangeable. The prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize, that the Entrant obtained the bill payer’s consent to enter by SMS (where applicable) before submitting their entry, that the Entrant has a clear relationship with the end mobile device used to enter via SMS (where applicable), and any information submitted by the Entrant in entering the promotion, before issuing a prize (including confirming consent of an Entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an Entrant is under 18 years of age).
If any documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant may be ineligible and deemed invalid.
Unclaimed Prize Draw: The Promoter may conduct a draw at Level 2, 106 Parramatta Road, Stanmore NSW 2048 as is necessary at 3:00pm (AEST) on 4/6/2014 in order to distribute any prize(s) unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of a winner(s) in the unclaimed prize draw, the winner(s) will be notified by telephone and in writing (mail or email) and any winner’(s) names (and localities, where available) will be published in The Australian on 11/6/2014. All reasonable steps to notify the winner(s) (if any) of the results of the unclaimed prize draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
It is a condition of accepting a prize that a winner may be required to sign a legal release(s) in a form determined by the Promoter in its absolute discretion. A winner must sign any document required by the Promoter (in its absolute discretion) with respect to the assignment of any prize (if applicable).
Prizes will only be awarded where the Unique Code fulfils all of the requirements of the Promoter’s verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.
Unless otherwise due to fraud or ineligibility under these Conditions of Entry all prize claims in excess of the advertised prize pool will be met.
The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
Any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, the Promotional Website, or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.
The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to Entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
If for any reason this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s name, locality (residential State/suburb) likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects Personal Information about an Entrant to include the Entrant in the promotion and, where appropriate, award prizes. If the Personal Information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible.
An Entrant agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation.
An Entrant can gain access to, update or correct any Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at PO BOX 392, Pennant Hills NSW 2120. All Personal Information will be stored at the office of the Promoter and/or its promotional partners, promotional agents and prize suppliers. A copy of the Promoter’s Privacy Policy in relation to the treatment of Personal Information collected may be accessed on www.mcdonalds.com.au/amorepromo. These Conditions of Entry will prevail to the extent of any inconsistency between these Conditions of Entry and the Promoter’s Privacy Policy.
By participating in the promotion and opting in, an Entrant also acknowledges that a further primary purpose for collection of the Entrant’s Personal Information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies, promotional partners, promotional agents and prize suppliers, who may contact the Entrant with information about McDonald’s, including special offers, market research or to provide the Entrant with marketing materials in this way. By entering the promotion and opting in, an Entrant acknowledges and agrees that the Promoter may use the Entrant’s Personal Information in the manner set out in this condition.
In these Conditions of Entry: “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth). “Personal Information” has the same meaning as in the Privacy Act 1988 (Cth).
