Entry Restrictions
Entry is only open to Australian residents who receive the promotional email (“eDM”) or promotional direct mailer (“DM”) from the Promoter inviting them to enter. The eDM or DM may be addressed to either an individual directly or a business. If the eDM or DM is addressed to a business, an authorised representative must enter on behalf of the business, in accordance with clause 4 below. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion Period
Promotion commences on 01/01/2014 and final entries close at 11.59pm AEDST on 31/12/2014 (“Promotional Period”).
Verification Requirements
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Entry Procedure
To enter, individuals or an authorised representative on behalf of an eligible business (if applicable) must complete the following steps within the time period specified in their eDM or DM and during the Promotional Period:
a)     click on the link provided within the eDM or follow the prompts as instructed within the DM, in order to fully complete the promotional survey by inputting the required information and submitting the fully completed survey online; OR
b)     call 1800 852 454 as stipulated in the eDM or DM, leave the requested details when prompted and complete the promotional Sales survey as instructed; OR
c)     call 1800 727 494 as stipulated in the eDM or DM, leave the requested details when prompted and complete the promotional Service survey as instructed. Service provider: Primus Telecom.
It is the responsibility of the individual to complete the survey within the allocated timeframe as stipulated within the eDM/DM in order to receive entry into the draw. For the sake of clarity, the link provided within the eDM/DM will become inactive if it is not accessed within the specified time period.

Incomplete, indecipherable or inaudible entries will be deemed invalid.

Prize Details
 
The first four (4) valid entries drawn, in each monthly draw, will each win one (1) x $500 Caltex Star Cash Card.
There will be twelve (12) draws conducted for this promotion. Entries into each Monthly Prize Draw close at 11.59pm (AEST or AEDST, as applicable in Victoria) on the last day of each month of the Promotional Period:
·          31 January 2014 (for January entries);

·          28 February 2014 (for February entries);

·          31 March 2014 (for March entries);

·          30 April 2014 (for April entries);

·          31 May 2014 (for May entries);

·          30 June 2014 (for June entries);

·          31 July 2014 (for July entries);

·          31 August 2014 (for August entries);

·          30 September 2014 (for September entries);

Entries in each draw will not be entered into any subsequent draws.
Prize Restrictions (if any)
Any ancillary costs associated with redeeming the Caltex Star Cash Card are not included. Any unused balance of the Caltex Star Cash Card will not be awarded as cash. Redemption of the Caltex Star Cash Card is subject to any terms and conditions of the issuer including those specified on the Caltex Star Cash Card.
Prizes won by a business (whereby applicable) will be awarded to the owner of the respective winning business who may, in their absolute discretion, allocate the prize to any employee of that business.

Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. The Promoter’s decision is final and no correspondence will be entered into.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
If for any reason a winner does not take the prize (or an element of the prize), by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
Total Prize Pool
Total prize pool value is $24,000 (Inc. GST).
Notification of Winners
Winners will be notified in writing within two (2) business days of the draw and winners will be published in The Australian newspaper on the dates specified.

Unclaimed Prize Arrangements
A draw for any unclaimed prizes may take place on 07/04/2015 at the same time and place as the original draws, subject to any written directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on 14/04/2015.

Time: 2:00pm AEDST/AEST (as applicable).

Additional Terms – entrants

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Additional Terms – entry mechanic

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

Additional terms – Privacy

 

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

 


Conditions of Entry

1.             Instructions and information on how to enter form part of these Conditions of Entry.  Participation in this Promotion constitutes acceptance of these Conditions of Entry (and Schedule).

2.             Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

3.             Directors, management, employees and contractors of the Promoter and those of any agencies, retailers and suppliers associated with this Promotion and the immediate family members of these people are ineligible to enter. “Immediate family member” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manger, employee, officer or contractor.

4.             The Promotion will be conducted during the Promotion Period.

5.             Eligibility to enter the Promotion is subject to the Entry Restrictions.

6.             To enter the Promotion, entrants must complete the Entry Procedure and comply with all other applicable requirements during the Promotion Period.  Entries must be submitted in accordance with the Entry Procedure and will not be accepted in any other form.  No responsibility is accepted by the Promoter for late, lost, misdirected, ineligible or illegible/inaudible entries (including lost, stolen, forged, defaced or damaged proof of entry or things required by the Verification Requirements).  The Promoter and/or its representatives may conduct security and/or verification checks (including enforcement of the Verification Requirements) in their absolute discretion to determine the bona fides of an entrant’s eligibility to enter the Promotion.  Ineligible entries will be deemed to be invalid.   

7.             Where an entry is deemed invalid (at the Promoter’s absolute discretion) prior to the Prize Claim Date, the Promoter may determine a new winner in accordance with the Unclaimed Prize Arrangements.

8.             The Promoter’s decisions in connection with the Promotion are final and no correspondence will be entered into.

9.             All entries and the content contained in those entries become the property of the Promoter.  Once submitted, no changes to or withdrawal of an entry will be permitted. Entries will not be returned by the Promoter.

10.           Entries must be received by the Promoter and will be deemed to have been received at the time of receipt by the Promoter.  Online, SMS and other electronic entries are deemed to have been received at the time of receipt into the Promotion database and not at the time of transmission by the entrant.

11.           If a Prize is awarded by draw, the prizes draw(s) will be conducted in accordance with the Draw Details.  The first valid entry randomly drawn will win a Prize.  If a winning entry is invalid, that entry will be disregarded and the prize will be awarded by drawing the next valid entry in accordance with these Conditions of Entry.

12.           Winners will be notified in accordance with the Notification of Winners and Publication Details.  Winners’ names and State/Territory of residence will be published as specified in the Schedule.  The Promoter and the companies and agencies associated with this Promotion may also publish the name and State/Territory of the winners on their website(s).

13.           The Prize(s) is/are specified in the Prize Details.  The Prize(s) is/are subject to any restrictions specified in the Schedule.  The Total Prize Pool is specified in the Schedule.

14.           The entrant acknowledges that there may be inherent risks involved in entering this Promotion or taking or participating in the Prize(s).  Any entrant, prize winner and/or participants in a Promotion event may be required to sign an acknowledgement of risk and waiver of liability for participation in the Promotion or a prize event and to expressly acknowledge that entry into this Promotion or participation in a Promotion event or Prize may be inherently dangerous, and that if they choose to participate they will do so at their own risk.  In particular, a reasonable level of health and fitness may be required.  The Promoter reserves the right to preclude participation of anyone refusing to sign the acknowledgement/waiver or any person who is suffering from asthma, epilepsy, significant back or neck problems, physical or mental disabilities, or is pregnant or in the Promoter’s sole discretion is not able to participate in any of the experiences for their own or anyone’s safety.  The Promoter will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person’s negligence) relating to this Promotion or the awarding or taking of the Prize(s) except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).

15.           The Prizes and/or parts of the Prize(s) is/are not transferable or exchangeable and cannot be taken as cash.    If a Prize, or an element of a Prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority.  The Promoter and its representatives will not be liable for any damage to or delay in transit of prizes.

16.           The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes.  Independent financial advice should be sought.

17.           The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any error, omission, alteration, tampering, deletion, theft destruction, transmission interruption, communications failure or otherwise, any injury or damage to entries or to participants’ or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion.  If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the Promotion subject to approval from any relevant authority.

18.           The Promoter reserves the right to disqualify all entries from any entrant who tampers with, or benefits from tampering with, the entry process or the Promotion.  Entrants can enter the Promotion up to the Maximum Number of Entries.  Entries must be submitted separately and each entry must individually meet the Entry Requirements and be subject to the Entry Restrictions.  Automatically- or computer-generated entries will not be accepted.

19.           The Promoter may, in its sole discretion, declare any or all entries made by an entrant invalid, and/or prohibit further participation by an entrant in this Promotion or a prize event/activity if the entrant:

(a)    disrupts, annoys, abuses, threatens, harasses or attempts to do any of these things to the Promoter, another entrant or potential entrant of, or anyone else associated with, this Promotion; or

(b)    engages in conduct in relation to this Promotion which is misleading, deceptive, fraudulent or damaging to the Promoter’s goodwill or reputation.

20.           The Promoter and its agencies and representatives associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person’s negligence) relating to this Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).

21.           The Promoter may use any personal information entrants provide in connection with this Promotion for the purpose of the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion.  The Promoter may disclose the information for those purposes to its related bodies corporate and contractors, and to Toyota dealers.  If entrants do not provide the information requested, they will not be able to enter the Promotion.    The Promoter is bound by the National Privacy Principles contained in the Privacy Act 1988 (Cth).  A copy of the Promoter’s privacy policy can be viewed at www.toyota.com.au. To request access to, or to update, personal information the Promoter holds about them, entrants can contact the office of the Promoter (an administrative fee may be imposed to access personal information).
