Conditions of Entry
Apple Inc is not a sponsor of or in any way involved with any promotional activity associated with this promotion.
To claim an Item:
Claimants must download the free Hungry Jack's® Australia Pty Ltd application "Check in and Shake to win" ("App") on to their smartphone and enter the required Facebook account details. Facebook details need only be entered once, upon first instance of use of App. Claimants must allow the App to detect and transmit information as to their location. Claimants must open the App on their smartphone. Once the smartphone detects that a claimant is within the vicinity (e.g. approximately 1km) of an Australian outlet of the Promoter, their smartphone will be triggered to prompt them to select the check-in feature ("Check-In") in the App. Claimants must then Check-In, and shake their smartphone as prompted to generate an electronic coupon redeemable at any participating outlet of the Promoter ("Coupon").
To redeem the Coupon, and obtain the food item or discounted food item specified in the Coupon ("Item"), claimants must present their smartphone with the Coupon displayed on the screen to a member of counter staff at a participating outlet of the Promoter within the time specified on the Coupon. Once claimants have been informed by a member of the Promoter's counter staff that their Coupon has been redeemed they must press the 'Done' button displayed on the screen of their smartphone.
The App will only allow claimants to generate one (1) Coupon in any ten (10) hour period.
A Coupon generated by a claimant's smartphone is valid for redemption until the earlier of:
twenty (20) minutes from the time of generation of the Coupon; or
the generation of a new Coupon generated in accordance with clause 2; or
the Coupon being deleted by the claimant from the App; or
the Coupon being redeemed.
Participation is open to Australian residents who have a registered Facebook account.
Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to claim.
Promotion commences 19 January 2014 at 00:00 AEDT. Coupons may be generated in line with clause 2 until 23:59 AEDT on 18 March 2014. All Coupons must be redeemed by 19 March 2014 at 00.20 AEDT ("Promotional Period").
The Promoter reserves the right to verify the validity of claims and claimants and to disqualify any claimant who the Promoter suspects has submitted a claim that is not in accordance with these conditions of entry or who has tampered with the claims process, including through the use of fake applications or by hacking the App. The Promoter reserves the right to prosecute persons who have tampered with the entry/claims process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter's decision is final and no correspondence will be entered into.

* Only the "Hashbrown & Brekky Wrap for $3" coupons will be generated by the App between 5.00am to 10:00am, at the claimant's local time. All other Coupons are available between 10:00am to 5:00am at the claimant's local time only.
Once a Coupon has been redeemed, the corresponding Item specified in that Coupon will be removed from the prize pool. The Coupon generated in accordance with clause 2 will be allocated at random at the time of generation according to the Coupons remaining in the prize pool.
Coupons cannot be used in conjunction with each other, or any other offer (except "Value Meals").
If an Item is unavailable, the Promoter, in its discretion, reserves the right to substitute the Item with an alternative item to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any claimant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the Promotion.
Unless expressly stated within these conditions of entry regarding all Items, all other expenses become the responsibility of the winner.
Items are not exchangeable and are not redeemable for cash.
Any costs associated with downloading the App is the claimant's responsibility and is dependent on the telephone service provider used.
Unless otherwise due to fraud or ineligibility under these terms and conditions, all prize claims in excess of the advertised prize pool will be honoured.
Printing and other quality control errors will not invalidate an otherwise valid prize claim.
Nothing in these conditions of entry limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these conditions of entry would contravene any statute or cause any part of these conditions of entry to be void ("Non-Excludable Guarantees"). Subject to the limitations in the preceding sentence, the Promoter excludes from these conditions of entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in Item value to that stated in these conditions of entry; (f) any tax liability incurred by a successful claimant and/or (g) the Item or use of the Item.
The Promoter collects personal information in order to conduct the Promotion. Claimants' personal information will only be used for this purpose and the Promoter may, for this purpose, disclose such information to third parties, including for any purpose required under Australian lottery legislation or any other regulatory authority. Participation in this Promotion is conditional on providing this information. Claimants should direct any request to access, update or correct information to the Promoter.
