Information on how to enter and the prizes, form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The promotion is only open to Australian residents aged 18 years or over, excluding residents of South Australia. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to claim/enter.
Privacy Collection Notice The Promoter collects personal information of entrants and authorised representatives in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Entry and claims are conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant or authorised representatives. Entry into this competition constitutes consent to receive marketing from all of the Carnival Corporation Plc brands and entrants agree that we may share their personal information with other Carnival brands for that purpose. Entrants or authorised representatives should direct any request to access, update or correct information to the Promoter. All entries and claims become the property of the Promoter.
Promotion commences on 15 January 2014 and closes at midnight 26 January 2015.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence, employment status, booking reference and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be deemed invalid.

By entering, the entrant warrants that the Entry:
does not include (or link to) any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. Without limitation, entrants must not include (or include a link to) any content that involves malice, swearing or which may be defamatory or in contempt of court;
contains no viruses or other computer code or material embedded in it which may have a negative impact on the Carnival.com.au website, this competition or any network or third party computer systems.
Prize Draw This promotion is a game of chance.

During the Promotional Period, one winner per month will be selected at random from the pool of entrants. In the event that the drawn entry is deemed ineligible, invalid or indecipherable, a new winner will be drawn. Winners will be notified via email and their details promoted on Facebook at
www.facebook.com/CarnivalOz.
Winners who are notified via email must claim the prize by following the instructions provided on the notification email (If a winner does not claim the prize within three calendar months of the relevant monthly draw date, the winner forfeits the prize.) In the event that the November and December Draw winners do not claim the prize before the departure date, for reasons beyond the winner’s control, Carnival in its discretion may offer a prize of equivalent value to the winners.

Prize Draw Each monthly winner will win a cruise for himself/herself and 3 travelling companions, travelling in a quad cabin on a Carnival Spirit 8 days New Caledonia Cruise departing Sydney 2 March 2015. Each cruise is valued at approximately $5,074.50, with a total pool prize value of $60,893.
The prize or any unused portion of the prize, cannot be transferred, exchanged or redeemed for cash. Where a prize, or part of a prize, is unavailable, the Promoter retains the right to substitute the prize (or part) with a prize (or part) of equal or greater value.
General The Promoter reserves the right to deny boarding to any winner or the travelling companion of any winner if the Promoter reasonably forms the view that the guest presents a risk to the health and safety of himself/herself or any other passenger or crew member.
Entrants consent to the Promoter using the entrant's name in the event the entrant is a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter may (but is not obliged to) at any time reject and/or remove from access by the public or disqualify or invalidate any Entry that it considers (in its sole judgment) infringes these terms and conditions. The Promoter will have no liability to entrants in that regard. If this occurs in respect of a winning Entry, the Promoter reserves the right to award the prize to the next best valid Entry. The Promoter’s decision is final and no correspondence will be entered into.
Any costs associated with entering the competition, accessing the promotional website and any cost associated with finalists redeeming or using the prizes is the responsibility of the entrant.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that entrant invalid.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the promotion, as appropriate or invalidate any affected Entries.
The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
Except for any liability which cannot be excluded by law, the Promoter:
is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participating in this promotion; and
accepts no responsibility for any incorrect or inaccurate information caused by any of the equipment or programming associated with or utilised in connection with this promotion, or by any technical error that may occur in the course of this promotion, including (but not limited to) any failure of the computer system or other equipment to determine finalists in accordance with these terms and conditions; and
accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of Entries or entrant's details; and
accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected Entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entries are deemed to be received at the time of receipt into the Promoter’s database, not time of transmission by the entrant.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) if any Carnival Spirit cruise is cancelled or delayed for any reason beyond the reasonable control of the Promoter; or (g) use of a prize.
The laws of NSW apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of NSW.
