ERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 21 years or over who are available to travel to Kentucky, USA from 30/04/2014 to 08/05/2014.
3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences on 01/02/2014 and ends at 11:59pm AEDST on 31/03/2014 (“Promotional Period”).

To be eligible to enter, individuals must spend $20 or more in a single transaction on any Wild Turkey or American Honey product(s) from a participating retailer during the Promotional Period (“Qualifying Transaction”). Individuals must retain their original purchase receipt(s) as proof of purchase.

www.wildturkeybourbon.com.au, follow the prompts to the promotion entry page, input the requested details (including their full name, State/Territory of residence, a telephone number, a valid email address and the last five digits of the barcode number of a Wild Turkey or American Honey product purchased in the Qualifying Transaction), and submit the fully completed entry form;

(b)SMS Entry: send an SMS in the required format to 1996 5556. The required SMS format is “LAST FIVE DIGITS OF THE PRODUCT BARCODE NUMBER” + space + “ENTRANT’S FIRST NAME” + space + “ENTRANT’S LAST NAME” + space + “ENTRANT’S POSTCODE” (in that order with no commas). Example of correct entry: “6LKKG John Smith 2000”.
Premium SMS cost is 55c. Entrants must have premium service access. SMS helpline: 1800 205 596. SMS winners will be contacted by SMS and/or phone and, if necessary, the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
7. Individuals that submit an entry via SMS will receive a free reply SMS immediately after their entry has been received by the Promoter, confirming their entry has been received. If the SMS entry was submitted successfully they will be advised that their entry has been entered into the draw. If a SMS entry is not in the required SMS format (as specified in clause 6B) or the product barcode number submitted is not recognised by the Promoter as an eligible product for the promotion, an “invalid code” message will be sent to the originating phone number. The “invalid code” message will prompt the entrant to re-enter the product barcode number and resubmit their SMS entry in the required form. If an entrant elects to resubmit their SMS entry via premium SMS, the entrant will be charged again at a maximum SMS cost of $0.55 (including GST) per message sent.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the amount spent in excess of $20 in that transaction); (b) each entry must be submitted separately and in accordance with entry requirements; (c) a maximum of one (1) entry per person per day is permitted; and (d) a maximum of ten (10) entries per person is permitted.
10. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. The entries received during the Promotional Period will be divided into the following four (4) groups, based on the entrant’s State/Territory of residence: (1) NSW/ACT; (2) QLD; (3) VIC/TAS; and (4) SA/WA/NT. There will be a draw conducted for the entries received in each State/Territory group (“State/Territory Group Draw”), for a total of four (4) State/Territory Group Draws. The State/Territory Group Draws will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, VIC 3004 on 04/04/2014 at 11:00am AEST. The Promoter may draw additional reserve entries in each State/Territory Group Draw and record them in order in case an invalid entry or ineligible entrant is drawn.
14. The winners will be notified by telephone and in writing within two (2) business days of the draw, and their names will be published in The Australian on 09/04/2014.
15. The Promoter’s decision is final and no correspondence will be entered into.
16. The first valid entry drawn in each State/Territory Group Draw will each win a trip for two (2) adults (aged 21 years or over) to Kentucky, USA valued at up to AU$15,000 depending on the point of departure. Prize includes:
- return economy airfares from winner's nearest Australian capital city to Louisville, Kentucky for two (2) adults, with flights departing on 30/04/2014 and returning on 08/05/2014;
- return transfers from the Louisville, Kentucky airport to the accommodation for two (2) adults;
- six (6) nights twin-share accommodation in a minimum 3-star hotel in Louisville, Kentucky for two (2) adults (exact hotel to be determined by the Promoter in its absolute discretion);
- two (2) ‘Kentucky Experiences’ packages (from the official Kentucky Derby ticket and hospitality provider) to the 2014 Kentucky Derby on 03/05/2014;
- a behind the scenes tour of the Wild Turkey distillery in Louisville, Kentucky for two (2) adults;
- one (1) empty 3L Wild Turkey barrel and 3L of Wild Turkey Single Barrel Bourbon (awarded in the form of four (4) 750ml bottles) for the winner, to be delivered to the winner’s nominated Australian mailing address. The winner will be able to select the exact Wild Turkey Single Barrel Bourbon product awarded from those available at the Wild Turkey distillery at the time of the tour;
- four (4) 750ml bottles of the Wild Turkey Single Barrel Bourbon selected by the winner in accordance with the above (two (2) bottles for the winner and two (2) bottles for their companion), awarded at the Wild Turkey distillery at the time of the tour; and
- AU$1,000 spending money for the winner, awarded in the form of a cheque made payable in the winner’s name.
17. Prize must be taken from 30/04/2014 to 08/05/2014, and is subject to booking and flight availability. All additional costs not expressly stated, but which may be incurred in acceptance and use of the prize, are NOT included in the prize and remain the sole responsibility of the winners and their companions. Such additional costs include, but are not limited to, meals and beverages, room service, telephone calls, laundry services, additional spending money, transport to and from airport departure point, additional transfers, destination taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the prize, insurance, travel insurance, passports and visas (if applicable). The Promoter recommends that the winners and their companions obtain travel insurance at the responsibility and cost of the winners and their companions before taking the prize.
18. Taking the prize is subject to any prevailing terms and conditions of any accommodation/transport/experience/services/transfers/travel insurance or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winners or their companions are unable to use any element of the prize as stated for whatever reason, including refusal of entry or departure into or out of Kentucky USA, or refusal of entry or ejection from the Kentucky Derby, or participation in any other activities for health, age, behaviour or safety reasons. The winners and their companions must follow all reasonable directions given by the Promoter and any prize supplier during the course of their participation in the prize, including all directions in relation to health, behaviour and safety. The winners and their companions must also obey all prevailing laws and regulations of Kentucky, USA when participating in the prize. If any winner and/or their companion fail to participate in the prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter and/or any Prize supplier, the balance of the prize will be forfeited with no compensation payable.
19. The winners and their companions are responsible for ensuring that they have passports valid for entry into the USA, and any requisite visas, vaccinations and travel documentation. The winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Prize is subject to the standard terms and conditions of individual prize and service providers. The winners may be required to present their credit card at time of accommodation check in. Frequent flyer points will not form part of the prize.
20. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at
www.nhmrc.gov.au/publications/synopses/ds10syn.htm. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
21. If a winner resides in a dry area/zone where possession and/or consumption of alcohol is not permitted, the winner will be awarded cash in lieu of the alcohol component of the prize.
22. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
24. The 2014 Kentucky Derby ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
25. Total prize pool value in each State/Territory is up to AU$15,000.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
27. A draw for any unclaimed prize in any State/Territory group may take place on 22/04/2014 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and in writing within two (2) business days of the draw, and their names will be published in The Australian on 24/04/2014.
28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate..
30. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
31. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2014 Kentucky Derby event is suspended, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in a prize.
34. As a condition of accepting a prize, each winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
35. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
