THE SUNDAY FOOTY SHOW – ISUZU D-MAX

Information on how to enter and prizes form part of these Conditions of Entry. Participation in the competition deems the entrant’s acceptance of the terms and conditions. Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete or inaudible entries will be disregarded. The judge’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into.
Entry is open to all residents of Australia, aged 18 years and over, except for employees of the Promoter, Salmat Digital Pty Ltd and their immediate families, and all companies and agencies associated with this promotion.
The winner of the Major Prize must have a current valid Australian driver’s license. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter in writing confirming the person’s full name and details of who consents to such assignment and provide all certified copies of all required documentation as required by the Promoter before the car is awarded.

ENTRY INTO THE COMPETITION

Entry into the competition commences 11:00 AEDST on Sunday 23 March 2014 and closes on Wednesday 1 October 2014 at 11:59 AEST. All Draws will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060 at the date and time stipulated in TABLE A. All times are in AEST and AEDST during daylight savings periods. Lines will open and close in the times and dates stipulated within TABLE A. All winners will be notified within 2 days via phone, in writing and the Major winner will be published in the Australian newspaper on the dates stipulated in table A.

For Draw Periods 1 – 26 (inclusive) during the Promotion Period, entrants must be watching the Sunday Footy Show to find out which two (2) performances are nominated as the “performance of the week”. Entrants will be given the option of choosing either performance “A” or “B”. To be a valid entrant, entrants must be 18 years and over and can enter by either:

On each Draw Date during Draw Periods 1 – 26 (inclusive), one (1) winner will be randomly drawn from all entries that have submitted entries for the option which is voted the “performance of the week” and that winner will receive a cheque for $500 and will automatically enter the Final Draw (Performance of the Week Winner).

Performance of the Year Round

From Sunday 21 September 2014 (Draw Period 27) entrants will be able to enter the competition by voting for the “performance of the year”. Entrants must be watching the Sunday Footy Show to find out which four (4) performances are nominated as the “performance of the year”. Entrants will be given the option of choosing performance “A”, “B”, “C”, or “D”. To be a valid entrant, entrants must be 18 years and over and can enter by either:

THE FINAL DRAW
13) All Performance of the Week Winners and the Performance of the Year Winner will go into the draw for the major prize.
14) The Draw will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street North Sydney NSW 2060 on Thursday 2 October 2014 at 10:00 AEDST/AEST (Grand Final Winner) and winner will be published in the Australian Thursday 9th October 2013.
15) The Grand Final Winner will win the following:
1 x Isuzu D-Max Ute 4x2 LS (High Ride) Automatic Crew Cab Ute up to the value of $41,330 including GST (depending on statutory charges in the state/ territory in which the Ute is redeemed).

$1,800 Dealer Delivery

Total major prize valued at $45,530.00 Total weekly prizes valued at $13,500.00
The total prize pool (includes the weekly prizes and major prize) is valued at $59,030.00
16) Prize includes standard fittings, metallic paint, registration and on road costs. Prize does not include; petrol, comprehensive insurance and all other ancillary costs associated with redeeming and owning the prize.
17) The winner will be required to pick up the vehicle from their nearest Isuzu UTE Australia dealership nominated by the winner.
18) Prize vehicle specification change is subject to Isuzu UTE Australia’s discretion and stock availability.
19) Receipt of a prize vehicle is subject to the winner being able to lawfully take possession of the prize vehicle and comply with all registration and compulsory third- party insurance requirements of the state/territory in the state/territory the winner elects to register the prize vehicle.
20) The Promoter takes no responsibility for any mechanical body or paint repairs from the date and time of delivery. Vehicles depicted in all promotional material are not necessarily the same colour or grade as the prize vehicle.
21) The winner will not be able to select the vehicle colour or transmission type, this will be determined by the Promoter. Additional insurance, options, accessories, fuel and all other ancillary costs are the responsibility of the winner.
22) In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
23) The Promoter will organise the vehicle to be delivered to the dealership. The winner is advised that it may take several weeks for the vehicle to have its pre-delivery work finalised and delivered to the dealership, subject to the winner’s location, state and territory vehicle registration, and dealership requirements. The winner should allow 28 days for this process.
24) If the winner is unable to collect the vehicle, the winner may incur cost of transporting the vehicle, if needed, from their nearest dealership to an alternate prize claim point as nominated by the winner and deemed acceptable by the Promoter. Any costs associated with the transport of the vehicle to an alternate location will be responsibility of the winner.
25) It is a condition of winning that the prize winner provides the Promoter with their full name, address, license and a copy of their current Australian driver’s license prior to the awarding of the prize.
26) Winner must have a current valid Australian driver’s license. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded.
General
27) Cash prizes will be awarded in the form of a cheque made in favour of the winner. Prizes are not transferable or exchangeable. Any prizes won by a contestant will be sent to their last known address within 28 days of broadcast of the episode of the program.
28) The Promoter reserves the right to request that entrants provide proof of identity. Identification considered suitable for verification is at the discretion of the Promoter.
29) It is a condition of participation that an entrant will be required to sign legal releases in any form to be determined by the Promoter at its absolute discretion.
30) In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
31) In the event that for any reason whatsoever the prize winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner.
32) If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
33) All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
34) By entering the promotion via SMS an entrant consents to the Promoter using the their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of your entry in the promotion.
35) It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and filmed at any time during the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured on the Nine Network (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature on Nine Network on a date to be determined by the Promoters. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
36) Participants must ensure that all care is taken when dialing or sending messages to the promotional number. It is the complete responsibility of the participant to ensure that they dial or SMS the correct number, in the event that an error occurs the Promoter accepts no responsibility for either, costs incurred, responses received or all other consequences. This is the responsibility of the participant.
37) The Promoter accepts no responsibility for any SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the handset.
38) In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to all relevant state and territory regulations) to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.
39) The Promoter may conduct such further draws at the same place as the original draw as are necessary on Tuesday 3 February 2015 at 10:00 AEDST in order to distribute the prize if unclaimed by that date, subject however to all reference to any relevant state and territory regulations. In the event of a winner, the winner will be notified in writing and their name will be published in The Australian on Thursday 6 February 2015.
40) The Promoter reserves the right to verify, at any time during or after the closing of the promotion, the validity of all entries and to disqualify any entrant who tampers with the entry process, including techniques designed to avoid payment of call costs or who submits an entry that is not in accordance with these Conditions of Entry. SMS entries via the internet are not valid and will not be accepted. The use of any automated entry software, or any other mechanical or electronic means, that permits the participant to automatically enter repeatedly, are not valid and will not be accepted. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
41) The Promoter is not responsible for any error, omission, interruption, deletion, defect in operation or transmission, communications line failure, theft, destruction or unauthorised access to, or alteration of entries occurring in relation to the conduct of the Promotion. Additionally, the Promoter accepts no responsibility for any SMS message not received by the promoter or delays in the delivery of the SMS message due to technical disruptions or for any other reason (including, without limitation, any failure or delay by a carriage service provider in delivery of any SMS sent by you in relation to the Promotion.
42) If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.
43) Entry details remain the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the purpose of conducting and promoting this Competition (including for the purpose of identifying and notifying winners). Without limiting the foregoing, the Promoter may disclose entrants’ personal information to other parties assisting in the administration of the Competition including to the Promoter’s related entities, prize suppliers, external service providers and authorities that regulate this Competition. If the entrant consents, the Promoter, its related entities and business partners (as applicable) may also use the entrant’s personal information for the purpose of sending direct marketing messages with respect to programs, products and services available through any or all of them. Nine will handle the entrants’ personal information in accordance with Nine’s Privacy Policy which is available on its website. Entrants may request access to or correction of their personal
information by writing to: Privacy Officer, Nine Network Australia Pty Ltd, Legal Department, PO Box 27, Willoughby NSW 2068 or emailing privacy@nine.com.au.
44) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) redemption of the prize.
