Terms and Conditions
By entering Sunrise ‘Taubmans Paints Your Community’ Competition (“the Competition”), you are agreeing to the following terms and conditions:
1.STANDARD TERMS
1.1Information on how to enter forms part of the terms of entry.
2.WHO CAN ENTER?
2.1Subject to clause 2.2, entry is open to all residents of Australia where the Channel Seven signal is received.
2.2Employees and their immediate families of Seven Network (Operations) Limited, PPG Architectural Coatings and their associated agencies and companies are not eligible to enter.
3.HOW TO ENTER
3.1The Competition commences on Tuesday 8 April 2014 at 7.00am (AEST) and concludes on Thursday 10 April 2014 at 12.00pm (AEST) (“the Competition Period”).
3.2In order to enter the Competition, viewers must watch Sunrise (“the Program”) on the Seven Network during the Competition Period where there will be a Competition segment aired during the Program (or any replacement program broadcast in the Sunrise timeslot).
3.3To enter, viewers must log into the Sunrise website (
www.yahoo7.com.au/sunrise) between Tuesday 8 April 2014 at 7.00am (AEST) and Thursday 10 April 2014 at 12.00pm (AEST). Viewers must:
(a) Tell us in 25 words or less) why your community building needs a paint makeover. Entrant must also complete the registration form including entrant’s name, full name, address (including postcode) and daytime telephone number (including STD area code), name of community project and project location; and
(b) send in a photo of the of the inside of the building that needs re-painting (1MB size limit).
3.4The entry must be:
(a)the original independent creation of the entrant; and
(b)free from any claims, including copyright or trademark claims, by other parties.
3.5Only one entry per person will be accepted from entrants online. No scripting is allowed for online entries (which will be deemed invalid).
3.6The time of entry will in each case be the time the registration form is received by the Yahoo7 online database.
3.7Entries remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
4.PRIZES
4.1 There will be one (1) major winner of the Competition. The major prize winner will receive:
• a Taubmans paint makeover on their nominated community project scheduled for either 15 April or 16 April 2014 including.
200 litres of Taubmans paint, Expert DIY team and painting tools required for makeover – value $13,000;
Furnishings/fitting/furniture as deemed necessary to complete the community project – value $5,000.
4.2 There will be one (1) runner up winner of the Competition. The runner up prize winner will receive:
• 100 Litres of Taubmans Endure paint – value $1000.
TOTAL PRIZE VALUE $19,000.
Total Combined Prize Value is: AU$19,000 (including GST). Prize value is correct as 1 April 2014. The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value and the actual prize value at the time of the draw.
4.2Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
4.4 Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the promoter. This is the maximum retail value of the prize.
4.5 Prize must be taken to coincide with the scheduled makeover 15 April or 16 April 2014 or the prize will be forfeited. If the prize is forfeited no cash credit will be issued for any unused option of a prize.
4.6 There will be a required site visit on either 12 April or 13 April by Taubmans and the Sunrise producers to inspect the community building/location in advance of the makeover. There must be approved access to the building on one of these dates for the Taubmans makeover to proceed. If access cannot be granted the prize will be forfeited.
4.7 Colour schemes for the community building will be made in consultation with Taubmans, Sunrise and the owner of the building, however, the ultimate decision will be at the discretion of Taubmans and Sunrise. Colour nominated is subject to availability.
4.8 The makeover furnishings/fittings/furniture required for the community project will be in consultation of the producers, however, the ultimate decision will be at the discretion of Taubmans and Sunrise.
4.9 The Promoter and Sponsor require pre-approval from the owner of the community building in advance of the community makeover on 15 April or 16 April 2014. The entrant is responsible for seeking any required approvals.
4.10 In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winner grants the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.
4.11 The winner agrees that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.
4.12 If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification.
4.13 The Winner should seek independent financial advice about any tax implications that may arise from the prize winnings.

5.HOW TO WIN
5.1The winner will be the entry judged by a panel of representatives appointed by the Promoter to be the most creative and/or original from the national pool received. All entries will be judged at the office of the Sunrise, 52 Martin Place, Sydney on Thursday 10 April 2014 at 1.00pm (AEST). The competition is a game of skill.
5.2The prize will be awarded to the entry judged the most creative and/or original.
5.3Winner will be notified by telephone before Friday 11 April 2014 at 5.00pm AEST.
5.4The judges’ decision is final and the Promoter will not enter into correspondence regarding the result.
5.5Incomprehensible and illegible entries will be deemed invalid.
5.6It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.7It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter or the Sponsor, as the case may be, in their absolute discretion.
6.NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel, modify or suspend the competition. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award a substitute prize.
6.2Neither Seven Network (Operations) Limited, nor the Sponsors and its franchisees and their associated agencies and companies will take any responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3Neither Seven Network (Operations) Limited and affiliates and their associated employees, agencies and companies associated with this promotion will not be liable for any misadventure, accident, injury, loss or claim, damages, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with this promotion and/or its prizes that may occur:
a) during the judging;
b) whilst undertaking any travel won on or connected with their entry into the competition; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
f) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion;
g) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion
h) due to circumstances outside the promoter’s reasonable control.
6.4The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements.
6.5The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
6.5Seven Network (Operations) Limited and the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.6If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition

7.3Seven Network Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant’s personal information may be disclosed to the PPG Architectural Coatings for this purpose.
