1. Information on how to enter the Promotion and a description of the prizes that may be won in the Promotion form part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Cardholder from the Promotion if any entries do not comply with these Terms & Conditions of Entry.

3. Definitions within this Promotion:
Card-means a Registered Everyday Rewards Card issued by the Promoter as part of the Everyday Rewards Program or Frequent Shopper Club Card as part of the Frequent Shopper Club Program (Tasmania only).
Cardholder -means a person who holds an Everyday Rewards Card, and who is Registered according to the Everyday Rewards Program database or a person who holds a Frequent Shopper Club Card, and who is registered according to the Frequent Shopper Club Program database.
Participating Stores-means any Woolworths supermarket across Australia promoting the Everyday Rewards program or the Frequent Shopper Club Program.

6. Registered Cardholders will receive one (1) entry for every 1 kg of pre-packed or loose pears purchased during the Promotional Period.
7. Breaking a single transaction into multiple amounts for use with one or more Cards is not permitted, and will void all Promotion entries attributable to such Cardholders.
8. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
9. There will be a total of seven (7) Major prizes:
•One of each for the following states/territories: QLD, VIC, NT, SA, WA and TAS
•There will be a combined draw and one combined prize for NSW and ACT entries.
Each Major prize comprises of a 2014 Holden Barina CD TM Hatch with a manual transmission in red or white valued at $14,990. Prize includes: all on-road cost of 12 months registration, compulsory third party insurance, stamp duty and dealer delivery charges. Prize is not transferrable or exchangeable and cannot be redeemed for cash any additional option extras are the responsibility of the winner. Collection of the prize is the responsibility of the winner and the winner should allow 28 days from prize draw for the availability of their prize. Prize will delivered to the Holden dealership closest to the Prize winner's home residence in Australia. The promoter will negotiate a date and time suitable for collection of the prize. The promoter will advise the location that the vehicle will need to be collected from. If the winner is unable to register the vehicle in their name they are to nominate another person who agrees to have the vehicle registered in their name. The winner should look to the manufacturer of products awarded as prizes for all warranties. The total major prize pool value is $104,930. Prizes are not transferable or exchangeable and Gift cards cannot be redeemed for cash.
10. The Prize winners will be determined by an automated random draw of all valid entries. The prize draw will take place at 10:00am AEST on Monday, 26 May, 2014. The prize draw will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney, NSW 2060.
11. The first valid entry randomly drawn for each state/ territory (one for QLD, one for VIC, one for NT, one for SA, one for WA, one For TAS and one combined draw for NSW and ACT), will be the winners of the Major prizes. The major prize winners will be contacted by phone within 2 days and in writing within 7 days. All winners will have their names and state published in The Australian newspaper and on the Everyday Rewards website on Thursday, 5 June, 2014. If any winning entry is invalid, that entry will be discarded and the Prize will be awarded by randomly drawing another entry in accordance with these Terms and Conditions of entry.
12. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter's reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value. Prize is not exchangeable and cannot be taken as cash. Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of the prize.
13. If the winner is under the age of 18 years, the prize will be awarded to the winner's parent/guardian on their behalf.
14. If a winner does not claim their prize within 3 months from the date and time of determination of that winner, their entry will be deemed invalid and the Promoter may conduct such further draws at the same place as the original draws as are necessary, subject to regulatory authority. The unclaimed prize draw will take place at 12:00 noon AEST on Tuesday, 26 August, 2014 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060. In the event of an unclaimed prize draw, the prize winners will be contacted by phone within 2 days and in writing within 7 days of the draw. All prize winners of any subsequent draw will have their names and state published in The Australian newspaper and the Everyday Rewards website on Thursday, 4 September, 2014.
15. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.
16. The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of these Conditions or the Terms and Conditions of the Everyday Rewards Program, or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.
17. Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. The Promoter takes no responsibility for prize monies that are misplaced due to incorrect account details provided by the winner.
18. It is a condition of accepting the prize that the winner may be required to provide photo identification and sign a legal release in a form determined by the Promoter in its absolute discretion.
19. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law). The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
20. Certain legislation may imply warranties or conditions or impose other obligations including statutory consumer guarantees which cannot be excluded, restricted or modified except to a limit extent. To the extent permitted by law, the Promoter excludes all guarantees, warranties, conditions or other terms that apply under or are implied by statute, common law or trade custom or usage.
21. If in the conduct of this Promotion the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other commonwealth, state or territory law that cannot be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.
22. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. The Promoter, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
23. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given by regulatory authorities.
24. The Promoter may use any personal information that a Registered Cardholder has provided to it for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements the Promoter will only publish the winner's surname, first initial and state of residence. The Promoter may disclose the information for those purposes to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) which the Promoter engages for that purpose. 25. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
