2. Entry into this promotion is open to all Australian residents aged 18 years and over. Employees of De Bortoli Wines and their immediate families, associated agencies of De Bortoli Wines and companies associated with the promotion are not eligible to enter the promotion. Any person who within 365 days prior to the day on which the promotion first commenced has won a prize which is greater than or equal to $100 in value from another De Bortoli Wines promotion is not eligible to enter.

4. The competition commences on Tuesday, 1st April 2014 at 9.00am (AEDT) and registration commences at this time. All registrations must be received by 11.59pm (AEST) on Tuesday, 22nd April 2014.

7. By entering the competition, entrants give express consent to join the De Bortoli Wines eNewsletter Database as stated in the notification statement on the entry form.

9. Any participant who completes more than one online registration form per person will have all entries automatically disqualified.
10.To successfully enter the competition, an entrant must enter their own personal details into the competition. If an entry is entered on behalf of the participant by a third party, then that entry will be invalidated. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.
11. Entries must be received by 11.59pm (AEST) on Tuesday, 22nd April 2014. The time of entry will in each case be the time of receipt that the online entry is received by the Promoter’s database and not at the time of transmission by the entrant. The Promoter accepts no responsibility for any late, lost or misdirected entries, or any entries not received or included into the draw for any reason beyond the reasonable control of the Promoter due to technical disruptions or any other failure, network congestion or for any other reason.
12.The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider and the responsibility of the entrant.
13.Prize: There will be one (1) Prize Winner. The Prize Winner will receive a trip for two persons aged 18 years and over to Noosa, Queensland to attend the 2014 Noosa Food and Wine Festival valued at a maximum of $3999.00. Details below:
• 2 x return economy airfares for the Winner and their travelling companion from the Winner’s nearest capital city to Brisbane, Queensland Australia valued at a maximum of $1,276 and
• Airport transfer between Brisbane Airport and the Hotel valued at a maximum of $390; and
• 3 x nights’ accommodation at The Sebel Noosa for the Winner and their guest (the hotel and room type to be determined by the Promoter in its sole discretion) including breakfast daily, valued at a maximum of $1,143; and
• 2 x Gold Weekend Pass tickets to the 2014 Noosa Food and Wine Festival on Friday 15th May 2014 – Monday 18th May 2014, to the value of $600.00

14.The total Prize pool is valued at a maximum of $3,999.00
15. The Prize Winner will be drawn from all valid entries received during the promotion period. The draw will take place at the premises of Anisimoff Legal Suite 3, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 12:00pm (AEDT) on Tuesday 30 April 2014. 16. The Promoter shall conduct such further draws as may be necessary at the premises of Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 12:00pm (AEDT) on Thursday 1st May 2014 to distribute any Prizes unclaimed by that date subject to State Regulation. The Winner will be notified by telephone and e-mail immediately after the draw. The Winner will be announced on

17.If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
18.Travel must be taken at the time specified by the promoter and must coincide with the 2014 Noosa Food and Wine Festival. All travel arrangements, return economy flights, accommodation, transfers and event tickets including dates, times, logistics and mechanics are at the discretion of the Promoter and must be taken as specified by the Promoter. If a winner and travelling companions are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then the prize will be forfeited by the winner.
Cash will not be awarded in lieu of the major prize or any element thereof.
19.The Prize Winner and their guest must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure.
20.The Prize Winner and their guest are responsible for all other expenses including spending money (unless specified), meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, travel insurance, items of a personal nature, in-room charges and all other ancillary costs.
21.Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
22. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
23.The Noosa Food and Wine Festival tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or their companions) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any component of the prize.
24.De Bortoli Wines make no representation as to the safety, conditions or other issues that may exist at any destination.
25.It is each of the travellers’ personal responsibility to ensure that they have valid documentation, including but not limited to Drivers licence and other forms of identification, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Prize Winner and their guest.
26.The Promoter’s decision is final and no correspondence will be entered into.
27. Prizes will be awarded to person named in the entry. Prizes are not exchangeable, transferable or redeemable for cash.
28.All prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of similar value subject to state regulation.
29.The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
30.In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
31. Once prizes have left the Promoter's premises, De Bortoli Wines and each of their related bodies corporate, associated agencies, and companies associated with this promotion will take no responsibility for any delay in delivery, or prizes damaged, delayed or lost in transit.
32.Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
33.It is a condition of accepting the prize that the Winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
34.As a condition of accepting a prize, a winner (and any guests/companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
35.By accepting a prize, the winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and/or photographed.
36. The Promoter and each of their related bodies corporate, associated agencies and companies associated with this promotion will not be liable for (a) any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion; (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) if the 2014 Noosa Food and Wine Festival is cancelled for any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; (f) or accepting or taking of prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
37.Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
