1. Information on how to enter and prizes form part of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid. Participation in this competition is deemed acceptance of these Terms and Conditions.

 

2. Entry is open to all residents of Australia. Officers, employees and immediate families of officers and employees of the Promoter, the associated companies and contractors of the Promoter, the Promoter’s Competition Partner, retailers at Direct Factory Outlet (DFO) shopping centres and any other agencies associated with this competition are ineligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.

 

3. The entire promotional period commences at 12:01am AEDST on 5th May 2014 and closes at 11:59am on the 23rd June 2014 (“Competition Period”). The individual entry period for each event and judging dates are as stipulated in the Table A below.

4. To enter, individuals must visit www.dfoshopperoftheyear.com.au, and follow the prompts to the competition page and fill in the entry form including their first name, last name , date of birth, gender, residential address, valid email address, daytime telephone number and area code, nominate a preferred DFO centre where they would like to attend the promotional event if chosen as a semi-finalist (from those outlined in clause 11 below) and provide an answer to the competition question in 25 words or less “What makes you Australia’s best shopper?”, and submit the fully completed entry as instructed.

 

5. Entries will be divided into their DFO centre location groups and judged separately. The Judging will take place at the Promoter’s premises, 54 Park Street, Sydney NSW 2000, at the time and dates as stipulated in Table A. The judges will then determine fifty (50) of the best entries from each group and these fifty (50) entrants will be deemed semi-finalists for their DFO store (as nominated in their entry) and will be chosen to compete at the promotional event at their nominated DFO centre. The semi-finalists for Homebush & South Wharf locations will be notified by telephone and in writing on Wednesday 25th June 2014. Semi-finalists for Essendon Fields & Moorabbin will be notified by telephone and in writing on Wednesday 25th June 2014

 

6. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

 

7. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

 

8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

 

9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.

 

10. This is a game of skill and chance plays no part in determining the semi-finalists, finalists and major prize winner.

 

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

12. The semi-finalists are responsible for all other expenses including travel, domestic flights, accommodation, spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs.  Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

 

13. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the event venue) become the responsibility of the winner.

 

14. Semi Finalist Stage: If chosen as a semi-finalist, entrants must be available and attend the promotional event taking place at the DFO centre selected by them at the time of entry on the following dates and times:

DFO, 3-5 Underwood Road, Homebush, Sydney, NSW on Friday 4th July 2014 between 2pm and 6pm;
DFO, 4-9 South Wharf Rd, South Wharf, Melbourne, Victoria onWednesday 9th July 2014 between 2pm and 6pm
DFO, 100 Bulla Rd, Essendon Fields, Melbourne, Victoria on Thursday 10th July 2014 between 2pm and 6pm;
DFO, 250 Centre Dandenong Road, Moorabbin, Victoria on Friday 11th July 2014 between 2pm and 6pm;
 

Each semi-finalist will be given a Prepaid Universal VISA Gift Card with $200 value on the day of their event and 45 minutes to shop for an outfit. The outfit chosen by each semi-finalist must be at minimum a dress and shoes or pants/shorts/skirt, a top and shoes. The outfit chosen by each semi-finalist must not be pornographic, sexually inappropriate, or contain any message/imagery that is or may in any way due to the choice/combination of clothes be abusive, harassing, threatening, objectionable/offensive with respect to race, religion or gender. If an outfit chosen by a semi-finalist is in breach of these Terms and Conditions, the semi-finalist will be disqualified from the competition and will not be permitted to compete in the fashion parade.
Semi-finalists must be changed into their outfit by the end of the 45 minutes and before the commencement of the fashion parade. Two changing rooms will be found next to the stage of the fashion parade, however in the event that a change room or both change rooms are occupied at the time of changing into their outfit, the Promoter recommends that all Semi-finalists change into their outfit at the store at which they purchased their outfit or at one of the restroom facilities at the DFO, so they do not miss out on taking part in the fashion parade.
Semi-finalists must hand back their Gift Card (including any unused credit) to the Promoter at the end of the 45 minutes. All semi-finalists will be able to keep their purchased outfit valued at up to $200. The total prize pool for the semi-finalist stage of the promotion is valued at up to $28,000. Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.
At the end of the 45 minute period the semi-finalists will compete in a fashion parade in front of a panel of judges where they will display their chosen outfit (by wearing the outfit). The top 2 best outfits at each promotional event as determined by the judges on the day (based on how fashionable and creative the outfits) will proceed to the next phase of the competition and will be deemed a “finalist”. A total of eight (Cool finalist will move onto the next phase of the competition during the entire promotional period.
All semi-finalists will be photographed wearing the outfit they purchased on the day of the event and will be featured online at www.dfoshopperoftheyear.com.au. The photographs will also be published in various magazines (the exact magazines will be determined by the Promoter in its absolute discretion). The photo-shoot will occur on the same day of the event at which the finalist appears.
Prizes, or any unused portion of a prize, are not transferable or redeemable for cash. Any ancillary costs associated with redeeming a prize will be the responsibility of the winner, including travel costs incurred in travelling to any DFO shopping centre and travel insurance. Entrants must agree to be available for their nominated event date, failure to confirm event attendance by the time and date stipulated by the Promoter will result in a forfeit and the next best entry will be awarded a semi-finalist place at the event.
 



15. Finalist stage: The eight (Cool finalist outfits will be displayed for public vote at www.dfoshopperoftheyear.com.au. Voting will commence at 12:01pm AEST on Monday 4th August 2014 and close at 11:59am AEST on 18th September 2014. The public will then be able to vote for their favourite outfit by clicking on the outfit they deem is best (from the 8 outfits displayed on the shop til you drop website). Maximum of three (3) votes per person per day. Each vote must be submitted separately and in accordance with the voting requirements.

 

16. The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.

 

17. Major prize winner: The major prize winner will be judged by a panel of judges appointed by the Promoter. Judges will take into consideration the online votes however the final decision to determine the best outfit (major prize winner) will be decided by the panel of judges appointed by the Promoter. The person deemed the best finalist entry as determined by the judges will be deemed the major prize winner. The major prize winner will be notified by phone and in writing using the contact details given in their original entry by 18th September 2014. The major prize winner’s name will also be published on the www.dfoshopperoftheyear.com.au website at 12:01pm AEST on 22nd September 2014. The major prize winner will win a $5000 visa pre-paid debit card. The total prize is valued at $5000.00. Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.

 

18. It is a condition of accepting a prize that the semi-finalist or finalist agrees to be interviewed, photographed and filmed at any time during the entire promotional period and the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured in any Bauer Media Limited magazine, website or social media page (or any other form of media it deems suitable) without further remuneration or reference to the participant. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

 

19. If the semi-finalist, finalist or major prize winner is unavailable to travel on the dates stipulated by the Promoter, the winner will forfeit the prize which they are unable to redeem. In the event that the winner is unable to redeem the prize on the dates stipulated by the Promoter, and the winner is unable to transfer the prize to a nominated person, then the prize will be forfeited by the winner and neither cash nor another prize will be awarded in lieu of the forfeited prize. In the event that the entire prize is forfeited by the winner, the Promoter will award the prize to the next valid entry judged.

 

20. The semi-finalist or finalists are responsible for all other expenses including travel, domestic flights, accommodation, spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

 

21. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the event venue) become the responsibility of the winner.

 

22. The major prize voucher is valid for six (6) months from the date of issue. Redemption of the voucher prizes are be subject to the terms and conditions stipulated on the voucher. The Promoter will not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way. Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of the voucher will not be awarded as cash.

 

23. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way.

 

24. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.

 

25. Prize is subject to the standard terms and conditions of individual prize and service providers.

 

26. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

 

27. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

 

28. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

 

29. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize

 

30. As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

 

32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

 

34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

 

35. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

 

36. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this promotion is governed by the Privacy Notice (see Contents Page for location in this issue).

 

37. By entering this promotion, the entrant consents to receipt of any email regarding the promotion, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
