2. Entry is only open to:
a) Australian residents aged 18 years or over holding an Australian PayPal
personal or premier account (“Eligible Individuals”); or
b) Small Australian merchants who have received less than AUD$120,000 in total payment volume in their Australian PayPal business or premier account during the period of 18/05/13 to 18/05/14 (“Eligible Merchant”).
3. Entrants must hold an active PayPal account in good standing (i.e. not restricted, or limited).
4. Entry is not open to employees, contractors (and their immediate families) of the Promoter, the Promoter’s related bodies corporate or any third parties associated with this promotion.
5. Promotion commences at 12:01am AEST on 18/05/2014 and closes at 11:59pm AEST on 30/06/2014 (“Promotional Period”).
6. To receive an automatic entry in Draw 1, Eligible Individuals must make payment for any purchase via their Australian PayPal account (“Qualifying Transaction”) during the Promotional Period. For each Qualifying Transaction, the Eligible Merchant receiving payment from Eligible Individuals will also receive an automatic entry into Draw 2 of the promotion. All entries are deemed to be received at the time of receipt by PayPal not time of transmission by the entrant. PayPal is not responsible for any entries not received by PayPal or for any delays in the delivery of any entries.
7. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete or cancelled purchases or purchases where payment is declined will be deemed invalid.
9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified Qualifying Transaction (for both the Eligible Individual and Eligible Merchant); and (b) each entry must be submitted separately and in accordance with entry requirements.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11. The two draws will take place at MDSA, 15 Grosvenor Street, Neutral Bay, NSW 2089 on 14/07/2014 at 11:00am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing within two (2) business days of the draw and their names will be published in The Australian newspaper on 28/07/2014.
12. The Promoter’s decision is final and no correspondence will be entered into.
13. Entries will be divided into the following Draws:
Draw 1 will be made from all Eligible Individual entries, and Draw 2 will be made from all Eligible Merchant entries. The first five (5) eligible entries drawn in each Draw will each win AUD$10,000. Total value of prizes in each Draw is AUD$50,000. Total prize pool value is AUD$100,000.
14. In accepting the prize, the winner acknowledges that they accept the Terms and Conditions. Tax implications may arise from prize winnings. Please seek independent financial advice before you accept the prize.
15. Prizes will be awarded in the winner’s PayPal account within 30 days of being notified after the draw date. If you’re a prize winner, we may be required to collect and verify information about your identity before you can access the funds in your PayPal account. This is in connection with our obligations under the anti-money laundering and counter terrorism financing laws. We’ll contact you and let you know what information and documents we require.
16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
17. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. For any prize that remains unclaimed on 14/10/ 14, a redraw/s for any unclaimed prizes may take place on 28/10/2014 at the same time and place as the original draw/s, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published in The Australian newspaper on 04/11/2014.
18. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19. PayPal may, at its absolute discretion, declare any or all entries made by an entrant to be invalid if the entrant:
a) fails to establish their entitlement to enter the promotion to PayPal's satisfaction; or
b) fails to produce documents as requested by PayPal to verify the validity of entries or produces items that are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way;
c) appears, to PayPal, to have tampered with, or benefited from tampering with, the entry process;
d) has submitted an entry that is not in accordance with these Terms and Conditions; or
e) does not hold an active PayPal account.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non- Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.
