Major Prize Draw:

Participation in the Competition
1. By participating in the Competition, the Participant agrees to these Terms and Conditions.
2. Information on the entry form also forms part of these Terms and Conditions.
3. To participate in the Competition, the Participant must be an Eligible Person who makes an Eligible Transaction and submits an Eligible Entry during the Competition Period.
4. An Eligible Person may obtain one (1) Scratch N Match Card and one (1) Major Draw Entry Form for each Eligible Transaction.
5. To obtain a Scratch N Match Card and/or a Major Draw Entry Form, proof of purchase in respect of an Eligible Transaction must be validated at the Participating Store that the Eligible Transaction was made.
6. There is no limit on the number of times a Participant may enter the completion during the Competition Period.
Entry into the Competition
7. To enter the Competition, the Eligible Person must during the Competition Period:
(a) make an Eligible Transaction;
(b) have their Eligible Transaction validated at the Participating Store at which the Eligible Transaction was made;
(c) be one of the first 25,000 people to collect a Scratch N Match Card or a Major Draw Entry Form;
(d) comply with clauses to 11 in order to win an Instant Win Prize;
(e) if the Eligible Person wishes, comply with clauses 13 to go into the draw to win the Major Prize; and
(f) if the Eligible Person is under the age of 18 years, be consented to by a parent or guardian of the Eligible Person.
8. The Promoter (in its sole discretion) has the right to add or to remove from the list of Participating Stores at any time.
Eligibility
9. The Competition is only open to Eligible Persons.
10. ThePromoterreservestheright,atanytime,toverifythe eligibility of any Participant (including a Participant’s identity, age and place of residence) and to disqualify any Participant who does not comply strictly with these Terms and Conditions or who tampers with the entry process. Incomplete, indecipherable or illegible entries will be deemed invalid. If requested by the Promoter, a Participant must provide the Promoter with evidence of eligibility. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Instant Win Prize Draw
11. To reveal if the Eligible Person has won an Instant Win
Prize, the Eligible Person must:
(a) scratch the three (3) marked square panels on the front of the Scratch N Win Card to reveal the symbols hidden underneath the panels. If two symbols in the shape of a pear are revealed, the Eligible Person will win an Instant Win Prize (Instant Win Prize Winner). To reveal which Instant Win Prize the Instant Win Prize Winner has won, the Eligible Person must scratch the fourth rectangular panel located on the bottom of the Scratch N Win Card ; and
(b) present the Scratch N Win Card at the Prize Collection Location during the Redemption Period to collect the Instant Win Prize identified according to the Scratch N Win Card.
Major Draw
12. Every Eligible Person that receives a Major Draw Entry Form is eligible for entry into the draw for a Major Prize.
13. To enter the draw for the Major Prize, the Eligible Person must during the Competition Period:
(a) enter the Eligible Person’s full name, telephone number, e-mail address and postcode in the space provided on the Major Draw Entry Form; and
(b) place the completed Major Draw Entry Form in either the entry barrel located in the fresh food markets on level 2, outside the Woolworths within the Centre or the entry barrel
14. There will be four (4) draws at the times set out below:
• Major Draw 1 - 10:00AM on 26 May 2014;
• Major Draw 2 - 10:00AM on 2 June 2014;
• Major Draw 3 - 10:00AM on 9 June 2014; and
• Major Draw 4 - 10:00AM on 16 June (the Major
Draws, each being a Major Draw).
15. Thefirstone(1)EligibleEntrydrawnatrandomateach
Major Draw will win a Major Prize (Major Prize Winner). 16. TheMajorDrawswillbeconductedattheCentre
Management Office within the Centre.
17. TheentrybarrelwillbeemptiedbetweenMajorDraws.
The Competition
18. The Competition will be conducted at the Centre during the Competition Period.
19. There will be
(a) two thousand, six hundred (2,600) Instant Win Prizes; and
(b) four (4) Major Prizes.
20. All valid claims to Instant Win Prizes under Scratch N Win Match Cards distributed to Eligible Persons during the Competition Period will be met notwithstanding the advertised Instant Win Prizes pool being exceeded.
21. Any printing errors or other quality assurance matters outside the control of the individual Eligible Person must not be used by the Promoter as the sole basis for refusing to award an Instant Win Prize.
22. The Prizes are not transferable, refundable or exchangeable and cannot be taken as cash.
23. The values of the Major Prize and the Instant Win Prizes
(as set out within these Terms and Conditions) are correct as at 15 April 2014. The Promoter is not responsible for any subsequent variation in values.
24. If the Instant Win Prize Winner or Major Prize Winner is under the age of 18 years, the parent or guardian of the Instant Win Prize Winner or Major Prize Winner who gave permission for entry into the Competition will be deemed to be the Instant Win Prize Winner or Major Prize Winner for the purposes of the Competition.
25. ThePromoterwillusereasonableeffortstonotifythe Major Prize Winners by mail, telephone, email or otherwise to arrange delivery or collection of the Prize.
26. IfdespitereasonableeffortsthePromoterisunableto locate or contact a Major Prize Winner within two (2) weeks after the Major Prize Winner is decided, another Major Prize Winner will be drawn at the times set out below. Any subsequent winner will be notified in accordance with these Terms and Conditions:
• Major Draw 1 – 10:00AM on 9 June 2014;
• Major Draw 2 – 10:00AM on 16 June 2014;
• Major Draw 3 – 10:00AM on 23 June 2014; and
• Major Draw 4 – 10:00AM on 30 June 2014.
27. AnInstantWinPrizeWinnermustclaimtheirInstantWin Prize during the Redemption Period. An Instant Prize Winner claiming an Instant Win Prize after the Redemption Period has expired will not be entitled to an Instant Win Prize, an alternate prize or any form of compensation in relation to the Competition whatsoever.
28. ThePromotermay,butisnotobligedto,publishthe results of the Competition. By participating in the Competition, the Participant gives their consent for their personal details to be published in the manner prescribed in this clause if they are the recipient of a Prize. If the Promoter decides to publish the results of the Competition, then the Promoter will publish the results on the Centre Website.
29. A Participant claiming to be an Instant Win Prize Winner or a Major Prize Winner will be required to provide proof of identity.
30. ThePromoter’sdecisionastothewinnerofaPrizeis final and binding and no correspondence will be entered into in relation to the conduct of the Competition or otherwise.
31. TheQualifiedPrizesaresubjecttoconditionsrelatingto the use of the Qualified Prizes (including validity period) which are available at the Centre Management Office. Where the use of the Qualified Prizes is subject to the terms and conditions of any party other than the Promoter any dispute in relation to those terms and conditions must be directed to that party and the Promoter has no responsibility for resolving such disputes.
Other General Terms
32. ThePromoterEntitiesshallnotbeliable(including, without limitation, in negligence) for:
(a) any loss or damage whatsoever that is suffered (including, but not limited to, indirect or consequential loss); or
(b) any personal injury suffered or sustained,
during the course of participating in this Competition or using the Prize, except for and to the extent that any liability cannot be excluded by law.
33. Each Participant indemnifies and keeps indemnified the Promoter Entities against all claims, losses, damages, costs and expenses suffered or incurred by the Promoter Entities or any third parties arising out of the breach of these Terms and Conditions by the Participant, the conduct of the Participant in the Competition or the use of the Prize by the Participant.
34. If this Competition is interfered with in any way or is not capable of being conducted as reasonable anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions from a regulatory authority (if any) to:
(a) disqualify any Participant; and/or
(b) modify, suspend, terminate or cancel the Competition as appropriate.
Privacy
35. UnderthePrivacyAct1998(Cth),thePromotermust notify Participants of certain matters when it collects personal information about them including how it plans to use or disclose it. If a Participant chooses to enter or take part in the Competition, the Participant will be required to provide the Promoter with personal information about themselves such as the Participant’s name, telephone number, email address and postcode.
36. ThePromoterwillcollect,useanddisclosethepersonal information which the Participant has provided for the following purposes:
(a) carrying out the Competition (in particular and in general for notification and promotion of Prizes); and
(b) carrying out marketing and promotions activities including, without limitation, sending newsletters or publications and/or other marketing and promotional material to the Participant about future competitions or promotional events (which may be undertaken by the Promoter or any other person or organisation to which the Promoter discloses the personal information (including contractors) for the purposes of assisting the Promoter to do this.
37. ByenteringtheCompetition,theParticipantconsentsto the collection, use and disclosure of his or her personal information in the manner outlined in these Terms and Conditions.
38. If a Participant would prefer that the Promoter does not use or disclose the Participant’s personal information in the way outlined in these Terms and Conditions and/or retain their personal information for the purposes described herein, the Participant should contact the Promoter on (07) 5575 0400.
39. A Participant has the right to access, in most circumstances, personal information which the Promoter holds about the Participant. A Participant may contact the Promoter on (07) 5575 0400 to ask for access to the Participant’s personal information, or if the Participant
has a complaint concerning a Participant’s information privacy. The Promoter may deny the participant’s request for access in some circumstances. If the Promoter does this, it will tell the Participant why.
40. ThePromoter'sPrivacyPolicycontainsfurther information on its processes in relation to access to and correction of personal information, about how a Participant may complain about a breach of the Australian Privacy Principles and how the Promoter will deal with such a complaint. The Promoter's Privacy Policy is available at the Centre Website.
41. IfaParticipantconsidersthatanypersonalinformation that the Promoter holds about the Participant is inaccurate or if at any time the Participant’s details change, the Participant may contact the Promoter on (07) 5575 0400 and the Promoter will take reasonable steps to ensure that such personal information is corrected. The Promoter will take reasonable steps to keep personal information secure from misuse, interference, loss or unauthorised access, modification or disclosure.

“Major Draw Entry Form” means the entry form to participate in the Major Draw given to Eligible Persons by a Participating Store in exchange for Eligible Persons providing satisfactory proof of an Eligible Transaction under clause 7.
“Major Prize” means a prize pack containing:
• one (1) Kenwood FPM270 Multipro Food Processor valued at $199.00; and
• one (1) Breville BEM410 Mixmaster from valued at $299.00.
“Non-Eligible Person” means the following:
(a) owners and managers of the Centre;
(b) retailers of the Centre;
(c) suppliers, associated companies and agencies of the Centre;
(d) the employees or contractors of the persons and entities in paragraphs (a) – (c); and
(e) any spouse, child, de facto or any other person living at the same premises as any of the persons mentioned in paragraphs (a) – (d).
“Participant” means any person who participates in the Competition.
“Participating Store” means the following stores within the Centre:
• Bakers Delight;
• Charis Seafood;
• Country West Gourmet Meats;
• Devour Bread & Coffee
• Go Vita;
• Healthy Life;
• Lenard’s Poultry;
• Robina Fruit Market;
• Robina Fresh Deli & Fruits; and
• Ming Mei Asian Supermarket
“Prize” means an Instant Win Prize or a Major Prize, as the context requires.
“Prize Collection Location” means the Centre’s Customer Service Desk or a Participating Store. The Prize Collection Location will vary depending on the Instant Win Prize being claimed and will be set out on each winning Scratch N Match Card.
“Promoter” means the owner of the Centre, QIC Robina Pty Ltd (ACN 080 215 354)
“Promoter Entities” means the Promoter, all associated companies, advisors and agencies and all those entities’ personnel.
“Qualified Prizes” means the following Instant Win Prizes:
• Event Cinema Double Pass Ticket; and
• Discount Card for Robina Fresh Deli & Fruits valued
at $5.00;
• Discount Card for Robina Fresh Deli & Fruits valued
at $10.00;
• Discount Card for Earth Markets Robina valued at
$5.00.
“Redemption Period” means the period from 8:30AM on 19 May 2014 to 4PM on Sunday 22 June 2014.
“Scratch N Match Card” means the card given to Eligible Persons by a Participating Store in exchange for Eligible Persons providing satisfactory proof of an Eligible Transaction under clause 7.
