Entry is open to residents of Australia over the age of 15 who are fans of the UNCLE TOBYS Facebook Fan Page (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter.
The promotion commences at 11.59am Australian Eastern Standard Time (“AEST”) on Monday 9 June 2014 and closes at 11.59am AEST on Wednesday 23 July 2014 (“Promotion Period”).
Eligible Entrants should follow these steps during the Promotion Period to be eligible for entry:
a) Visit
www.facebook.com/uncletobys and find The Simple Truth tab;
b) Like our UNCLE TOBYS Fan Page to access the quiz; and
c) Complete the quiz in full and then enter the necessary details to complete the entrant form.
Entry is limited to once per Eligible Entrant.
If the Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques to make multiple entries or for submitting an entry which is not otherwise in accordance with these terms and conditions.
If the Promoter finds evidence of tampering by an entrant in the entry process or the verification process, in addition to declaring any or all entries made by that entrant invalid, the Promoter may in its complete discretion preclude that entrant from participation in any or all future promotions of the Promoter.
All valid entries received during the Promotion Period will be entered in the draw to win a prize pack. A total of 6 prize packs are available.

Winners will be determined by 5pm on Wednesday 6 August 2014 at 61-63 Great Buckingham Street, Redfern NSW 2016. The winners of each of the 6 Prize Packs will be drawn at random from all Eligible Entrants who completed the quiz in full.
All winners will be notified in writing via an email to the address they supplied with their entry within 48 hours of their names being drawn and their names will appear on UNCLE TOBYS Facebook page. The winners will also have their name and postcode published in The Australian on Friday 8th August 2014.
The total prize pool is valued at $3167.70 RRP.
Prizes are not transferable and cannot be taken as cash.
Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prize.
The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.

The Promoter’s decision is final and no correspondence will be entered into.
The Promoter retains the absolute discretion to require a winner to provide proof of age and identity in a form determined by the Promoter before awarding the prize.
If any prize pack remains unclaimed by 5pm AEST on Wednesday 13 November 2014 despite the Promoter’s best efforts to contact the winner, then subject to any written directions given by a relevant lotteries or gaming authority, the Promoter may consider the prize has been forfeited and re-award the unclaimed prize as follows:
The relevant prize pack(s) will be awarded to the next Eligible Entrant drawn at random from all those Eligible Entrants who completed the quiz in full and were not initial winners.
Any winner of an unclaimed prize will be notified in writing via an email to the address they supplied with their entry within 48 hours of their name being drawn. The winner(s) will have their name and postcode published in The Australian on Friday 8th August 2014 and all winners’ names will appear on the UNCLE TOBYS Facebook page.
Each winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure it within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
Prizes will only be delivered in Australia and each winner should allow 28 days from the date that they confirm the delivery address details for their prize to the Promoter for delivery of their prize, provided that:
a) the 28 days stated is only applicable to the 6x 340g 10 pack of UNCLE TOBYS Quick Oats Sachets and $200 VISA Gift Voucher; and
b) for the appointment with a dietician, each winner should allow 56 days from the date that they confirm the delivery address details for an appointment to be scheduled.
If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
