1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Promotion commences at 9.00am AEST on 19 May 2014 and ends at 11:59pm AEST on 5 September 2014 ("Promotional Period").

3. Entry is only open to Australian residents who:
a) are a student in Grades 3 to 8 in Australia. Individuals can be in the relevant Grades in a primary or secondary school or they can be home schooled in these year levels;
b) are available to attend the Awards Ceremony (defined below) for the promotion which will be held in Sydney on Friday 3 October 2014, if selected as a Finalist; and
c) can travel (together with their parent/guardian) to the USA (and have or can obtain all appropriate travel documentation), within six (6) months of the Awards Ceremony, if selected as the Major Prize winner;

("Eligible Entrants").

4. Eligible Entrants must have permission and consent from their parental/guardian, their nominated teacher or educator and their nominated primary or secondary school (where and as applicable) to enter and further, the parent/guardian, nominated teacher or educator and an authorised representative of the school must read and consent to these Terms and Conditions. Parents/guardians, teachers/educators and an authorised representative of the relevant schools may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

6. To enter, an Eligible Entrant must complete one (1) of the following entry methods:

(a) ONLINE: Visit www.littlebigidea.com.au and: (i) complete the online promotional entry form, including their name, the full name of one (1) teacher from their primary or secondary school (or their home educator if home schooled) that they would like to nominate (and whom will be awarded a prize in the event the Eligible Entrant is deemed one of the winners), the name of their primary or secondary school (if applicable), the name and contact details of a parent/guardian, and an answer in 200 words or less to the promotional question: "What is your brilliant idea for the future?; and (ii) if they wish, upload a picture, illustration or a drawing of their invention/idea or a video no longer than one (1) minute (any video entries over one-minute will be deemed invalid and will not be considered for the competition) which outlines their invention/idea in more detail; and (iii) submit the online entry form so that it is received by 11:59pm AEST on 5 September 2014. For the avoidance of doubt, Eligible Entrants do not have to submit a picture, drawing, illustration or a video with their entry and this step on the entry form is optional. OR

(b) MAIL: Download and print an entry form from www.littlebigidea.com.au and: (i) complete the form, including their name, the full name of one (1) teacher from their primary or secondary school (or their home educator if home schooled) that they would like to nominate (and whom will be awarded a prize in the event the Eligible Entrant is deemed one of the winners), the name of their primary or secondary school (if applicable), the name and contact details of a parent/guardian, and an answer in 200 words or less to the promotional question: "What is your brilliant idea for the future? ; and (ii) if they wish, attach a picture, illustration or a drawing of their invention/idea or enclose a DVD or USB containing a video no longer than one (1) minute (any video entries over one-minute will be deemed invalid and will not be considered for the competition) which outlines their invention/idea in more detail; and (iii) send together to: Attention: littleBIGidea, Level 9, 321 Exhibition St, Melbourne Victoria 3000, so that it is posted by last mail on 5 September 2014. In any event, must be received by the promoter within 1 week of 5 September 2014. For the avoidance of doubt, Eligible Entrants do not have to send a picture, drawing, illustration or a video with their entry and this is optional. Please note that postal entries will not be returned.

Eligible Entrants must have the permission of their teacher or home educator (as applicable) and their primary/secondary school, as well as their parent/legal guardian to enter and to nominate them on the entry form. The idea/invention submitted in the entry must be realistic and hypothetically possible to implement. The idea/invention and the answer to the promotion question must be the original work of the Eligible Entrant created without assistance from their parent/guardian or any other person.

7. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including their identity, age and place of residence and schooling) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

8. Each Eligible Entrant can only enter in their own name. Group entries will not be accepted. Incomplete, indecipherable, or illegible entries will be deemed invalid. Entries that do not comply with these Terms and Conditions will also be deemed invalid (for eg, entries that exceed the 200 word limit or video entries that exceed 1 minute), at the Promoter's complete discretion.

9. Only one (1) entry is permitted per Eligible Entrant.

10. If there is a dispute as to the identity of an Eligible Entrant, a teacher, school or a parent/guardian, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant, teacher, school or parent/guardian.

11. The nominated parent/guardian of each winner will be notified by telephone.

12. This is a game of skill and chance plays no part in determining the Finalists/winners. Each entry will be individually judged based on the creative merit, originality and innovative value, clarity, practicality and ease of understanding of the answer provided to the promotional question and the supporting picture/drawing/illustration or video provided on entry (if any). The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The judges will be determined by the Promoter in its absolute discretion.

13. The Promoter's decision is final and no correspondence will be entered into.

14. Finalists Selection: All entries will be divided into three (3) groups, depending on what Grade the Eligible Entrant is attending as at the time of entry (each a "Grade Category"), as follows: Grade Category One – Grades 3 & 4; Grade Category Two – Grades, 5 & 6; and Grade Category Three – Grades 7 & 8. The best four (4) valid entries (as determined by the judges in their sole discretion and based on the above judging criteria) in each Grade Category will each be deemed a finalist ("Finalists"). There will be a total of twelve (12) Finalists (four (4) in Category One, four (4) in Category Two and four (4) in Category Three).

15. Each Finalist (together with their parent/guardian) will be required to attend and take part in the "littleBIGidea Forum" ceremony which will be held at the Powerhouse Museum in Sydney, NSW, on Friday 3 October 2014 ("Awards Ceremony"). In the event that any Eligible Entrant selected as a Finalist is unable to attend or participate in the Awards Ceremony, they will be disqualified and will not be eligible to win any prize, and the Promoter reserves the right to select another Finalist in their place. Each Finalist and his/her parent or legal guardian will receive return economy airfares from their nearest capital city to Sydney, NSW (if required), and one (1) night minimum 3-star twin-share accommodation in Sydney, NSW so that they can attend the Awards Ceremony. If a Finalist lives in Sydney or surrounding area, then airfares are not included and the airfare component of the prize is forfeited and not redeemable for cash. Each Finalist and their parent/legal guardian must make their own way to/from the accommodation and the Awards Ceremony. Each trip is also subject to the conditions specified in clause 21.

16. The Promoter may build a model or professionally illustrate each idea/invention submitted by a Finalist and display and publish it, including but not limited to at the Awards Ceremony, and each Finalist and their parent/guardian consent for this to occur by entering the promotion. By agreeing for their child to enter, each parent/guardian also agrees to execute any documents to confirm this consent upon request of the Promoter. Each Finalist (and their parent/guardian in some instances) will be required to interact with the judges and any media present at the Awards Ceremony and explain the Finalist's invention/idea. Each Finalist (and their parent/guardian in some instances as specified by the Promoter) must take part in any promotional and media activities reasonably specified by the Promoter, including but not limited to at the Awards Ceremony (such as participating in interviews and being recorded and/or photographed). In the event that any Finalist or a parent guardian refuses to perform any of the activities reasonably requested by the Promoter, the Promoter reserves the right to disqualify any such Finalist (in which case any such Finalist will be ineligible to win any prize).

17. Selection of Major Prize Winner and Runners Up: The Finalist that submitted the entry deemed to be the best (as determined by the judges in their sole discretion and based on the above judging criteria in clause 12) in each Grade Category will be deemed a major prize winner (each a "Major Prize Winner"). The remaining three (3) Finalists in each Grade Category will each be deemed runner ups ("Runner Ups"). There will be a total of three (3) Major Prize Winners (one (1) in each Grade Category) and nine (9) Runner Ups (three (3) in each Grade Category).

18. Major Prize Winners and the Runner Ups will be announced at the Awards Ceremony.

19. Each Major Prize Winner will receive a trip to the United States of America for themselves and their parent/guardian, valued at up to AU$10,085 depending on date and point of departure ("Major Prize"). Each Major Prize consist of the following:

    Two (2) return economy flights to Miami USA from the Major Prize Winner's nearest capital city airport in Australia. Airline will be selected by the Promoter in its discretion;
    Seven (7) nights' accommodation at Wyndham Bonnett Creek in a two (2) bedroom suite or similar if there are no vacancies available at Wyndham Bonnett Creek during the winner's preferred travel dates;
    2 x day passes to the NASA Kennedy Space Centre, Florida (see the Kennedy Space Centre website http://www.kennedyspacecenter.com/ for details);
    2 x day pass to Epcot Theme Park, Disneyworld Florida (see https://disneyworld.disney.go.com/destinations/epcot/ for details)
    2 x tickets to Orlando Science Centre (see osc.org for details)
    2 x tickets to Ripley's Believe it or Not (see Orlando.ripleys.com for details); and
    AU$2,500 spending money, awarded in the form of a cash passport issued by www.travelex.com.

Each Major Prize Winner and their parent/ guardian must make their own way to/from their nearest capital city airport, and organise all other transfers not mentioned above, at their own cost. The Major Prize must be taken within twelve (12) months of the Major Prize Winner announcement at the Awards Ceremony. The parent/guardian of each Major Prize Winner will be required to contact the Promoter and give at least three (3) months prior notice of the dates they would like to travel (so that sufficient time is allowed for travel arrangements to be made). Major Prizes must be booked through the Promoter's travel service. Each Major Prize is also subject to the conditions specified in clause 21.

20. Each Runner Up will receive $1,000, either (i) awarded as a cheque made payable to the Runner Up's nominated parent or legal guardian or (ii) deposited into the bank account of the winner's nominated parent or legal guardian ("Runner Up Prize"). The Runner Up's nominated parent/guardian will select their preferred option for how they wish for the Runner Up Prize to be awarded, from the two options mentioned above.

21. Spending money (other than the AU$2,500 included in the Major Prize), meals, taxes (excluding airline/airport taxes), insurance, transport to and from departure point, transfers (other than airfares for the Major Prize Winners and the Finalists for the Awards Ceremony) items of a personal nature, in-room charges and all other ancillary costs are not included in the Major Prize or in the trip to the Awards Ceremony. Trips are subject to booking and flight availability. During the entire duration of each trip, the nominated parent/guardian must accompany the Finalist and Major Prize Winner (as applicable). Each Finalist and Major Prize Winner (as applicable) and their parent/legal guardian must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of any trip prize. All elements of each prize are subject to the standard terms and conditions of individual prize and service providers. Parent/legal guardian of each Finalist and Major Prize Winner (as applicable) may be required to present their credit card at time of accommodation check in.

22. Teacher Prizes: The teacher (or home educator where applicable) nominated on the entry form of each of the twelve (12) valid Finalists will receive one (1) entry ticket to an education conference of their choice in 2014 or 2015, being held in their home State or Territory, subject to availability. Travel to and from the chosen conference is each teacher's/educator's responsibility and at their own cost. Bookings for the relevant conference will be managed by and must be made through the Promoter. Each teacher/educator must notify the Promoter of their preferred conference and booking for that conference must be made within two (2) months of the Awards Ceremony. The Promoter reserves the right to request proof, to the satisfaction of the Promoter, be provided that the relevant teacher/Finalist is the relevant Finalist's teacher/home educator before a prize is awarded. For the avoidance of doubt, if an Eligible Entrant initially selected as a Finalist is disqualified, their nominated teacher/educator will then also become ineligible to receive any prize.

23. School Prizes: The primary or secondary school nominated on the entry form of each of the twelve (12) valid Finalists will receive a cash prize of $4,000, to assist the school with energy upgrades. The prize will be deposited in the school's bank account or awarded in the form of a cheque made payable to the school, as determined by the Promoter in is absolute discretion. In the event that a Finalist is home schooled, the $4,000 prize will be awarded to the parent/guardian of the relevant Finalist, toward energy upgrades to the Finalist's home. The Promoter reserves the right to request proof, to the satisfaction of the Promoter, be provided that the Finalist is attending the relevant school or is home schooled (as applicable) before a prize is awarded. For the avoidance of doubt, if an Eligible Entrant initially selected as a Finalist is disqualified, their nominated school (or parent if they are home schooled) will then also become ineligible to receive any prize.

24. If for any reason any winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

25. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

27. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize.

28. By accepting a prize, each Eligible Entrant, their parent/guardian, teacher, home educator and school consent to the Promoter using each of their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

29. When an Eligible Entrant submits any materials via the promotion including answers to the promotional question, pictures, images, videos, drawings and illustrations ("Content"), the Eligible Entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Eligible Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

Eligible Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Eligible Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, (b) Content submitted will not be defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children attending Grades 3 to 8 in Australia, or otherwise unsuitable for publication; (c) they will obtain prior consent from any person or the owner(s) of any property that appears in their Content; (d) the Content is their own original work or they have full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein, and the Content does not infringe the rights of any third party; (e) their Content shall not contain viruses or cause injury or harm to any person or entity; and (f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, the Eligible Entrant agrees to indemnify the Promoter for any breach of the above terms.

30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

31. Any cost associated with accessing the promotional website or creating and submitting an entry is the Eligible Entrant's responsibility.

32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; (f) if the Awards Ceremony is rescheduled or cancelled for any reason beyond the control of the Promoter; or (g) taking of, use or redemption of a prize.

34. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the relevant winner. Each person should seek independent financial advice in this regard.

35. As a condition of accepting a prize, the parent/guardian of each individual that is selected as a Finalist (and also ultimately as a Major Prize Winner or a Runner Up) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. Parents/guardians will also be required to sign a copy of Origin's Talent Release form which gives the Promoter consent to using the Finalist's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

36. The Promoter collects personal information (including the personal information described in clause 6) in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers (and also to government agencies where required or authorised by law). Entry is conditional on providing this information and entries may be invalid if all of the personal information requested in the promotional application form is not provided. The Eligible Entrant must notify each third party (being teachers and parents and relevant representatives of schools) whose personal information it provides to the Promoter of the matters contained in this clause, prior to providing the information. The Promoter will only use the personal information collected to contact participants in relation to the matters relating to the administration and conduct of this promotion. More information on how information is handled and how to make any request to access, update or correct information or to complain about the Promoter's treatment of any personal information (and how those complaints will be dealt with) can be found in the Promoter's privacy policy, which is available at www.originenergy.com.au/privacy. The Promoter will not disclose personal information overseas. All entries become the property of the Promoter.
