Terms and Conditions of Entry



1. Promoter



The Promoter is Roadshow Films Pty Ltd (ABN 28 100 746 870) trading as Roadshow Entertainment (“Roadshow”), First Floor, The Jam Factory, 500 Chapel St, South Yarra, VIC, 3141 Australia (“the Promoter”).



2. Who may enter



The only persons who may enter and be awarded prize are:

(a) Residents of Australia aged 18 years and older;

(b) Persons who are not employees or immediate family members of the Promoter or its retailers, suppliers, advertising agencies and associated companies. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household as the employee.



3. How to Enter



To enter, individuals must go bbcondvd.com.au/signup or bbcondvd.com.au/signupnow and follow the prompts on the competition entry page and complete the form as required including (but not limited to): their favourite genre, sign up to BBC on DVD newletter, agree to the terms and conditions of the promotion and click submit.



One (1) entry per person permitted.



Any cost associated with accessing the competition website is the responsibility of the entrant and is dependent upon the entrants chosen internet service provider.



The Promoter’s decision in relation to any aspect of the competition is final and binding on each entrant. No correspondence will be entered into.





4. Competition Period



The competition commences at 9:00 a.m. (AEST) on 02/06/2014 and closes at 11.59 p.m. (AEST) on 29/08/2014.



5. Selection of winner



The prize draw will take place at 11:00amon 03/09/2014 at Oxygen Interactive Marketing, 117 Wellington St, St. Kilda, VIC, 3182



If the prize remains unclaimed a second chance draw will take place on 03/12/2014 at the same time and place as the original draws, subject to any directions from a regulatory authority. The winner (if any) will be notified in writing within two days of the prize draw and will have their name and postcode published in The Australian on 09/12/2014.





6. Notification of winner



Winner will be notified by phone and in writing by 05/09/2014 and will have their name and postcode published in The Australian on 09/09/2014.



7. Prize Information



There will be (1) major prize.



The major prize winner will receive:



· Two (2) adult return economy flights from winner’s nearest mainland capital city within Australia to London, England valued at up to $5,000 AUD (including taxes)*;

· Five (5) nights’ accommodation with breakfast valued at up to $2,750 AUD;

· Return airport-hotel transfers valued at up to $250 AUD;

· $2,000 Spending money



· Total prize valued at up to $10,000* (*value of flights will depend on winner’s nearest mainland capital city) AUD. (“Prize”)



Prize must be used no later than 12-months’ from competition close date and is subject to booking and availability. In the event that, for any reason whatsoever, a winner does not make a booking to take up the prize by 09/04/2015 then the the prize will be forfeited by the winner and cash will not be awarded in lieu of that element.



Dates of travel are subject to availability excluding national holidays.



There is no cash alternative and the prize is non-transferable and non-refundable.



Hotel is based on 2 people sharing one room. Room, tax and breakfast.



The hotel will require a credit card imprint to cover any incidentals incurred.



At least one person travelling must be over 21.



The winners (and their travelling companions) are responsible for all other expenses including, meals, drinks, laundry charges, activities, incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.



The winners (and travelling companions) must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure.



Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.



The winners (and travelling companions) must ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.



The Prize is not transferable or exchangeable. If the any prize is unavailable, the Promoter, in its discretion and subject to state permit approval, reserves the right to substitute all or any part thereof with a product or prize to the equal.



Winner must provide at least 6 weeks’ notice of intention to travel to avoid disappointment.



Unless expressly stated, all other expenses become the responsibility of the winner.



8. Entries



All entries become the property of the Promoter. Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered. Indecipherable or incomplete entries will be disregarded. No responsibility is taken for late or misdirected email.



Entrants warrant that their entry does not breach the intellectual property rights of any third party and the entrant indemnifies and keeps indemnified the Promoter and its associated agencies against any loss, costs, expenses or liability that the Promoter and its associated agencies may suffer arising out of a breach by the entrant of any third party intellectual property right.



The Promoter reserves the right to request prize winners to provide proof of identity (including proof of age) and/or proof of residence for the verification of any prize winner. Where a prize winner cannot provide adequate proof of identity, determined in the Promoter’s absolute discretion, that prize winner may forfeit the prize.



The Promoter reserves the right to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses or entering multiple times, postal addresses to registering multiple entries. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.



In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.









9. Publication of names



Entrants agree to, at the Promoter’s request, participate in any promotional activity (such as being profiled as a winner on Facebook, photographed, filmed, voice recording, etc.) surrounding this Promotion or the winning of any prize. Entrants agree this participation will be free of charge. Entrants consent to the Promoter and its associated agencies using their name and image in any media in perpetuity, without limitation and without compensation to the entrant.



10. Privacy



The personal information collected as part of the entry is collected for the purposes set out in this Clause 10, and to enable identification of the winner. In addition to any required disclosures referred to in Clause 9 above, the entrant’s personal information will be disclosed to the Promoter and its related bodies corporate for these purposes only.

The Promoter will collect personal information for its marketing and promotional purposes. The Promoted will also collected personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers in order to fulfil the Prize.



11. Conduct of competition



If for any reason the competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition. The Promoter also reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or has engaged in conduct to jeopardize the fair and proper conduct of the competition. The Promoter is not responsible for any:



(a) malfunction, delay or traffic congestion on any communication network or line, computer on-line system, servers or providers, computer equipment, software, or website;

(b) failure of any SMS, email or entry to be received by the Promoter; nor

(c) any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials in a competition.



12. Limitation of liability



The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter, its employees and agents are not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.



13. Conditions of Entry



By entering this Promotion, the entrant agrees to be bound by these terms and conditions. The instructions on how to enter form part of the terms and conditions of entry. The Promoter reserves the right to verify the validity of any entry and to disqualify any entrant who it reasonably believes has tampered with the entry or submitted an entry that breaches these terms and conditions.



These terms and conditions do not, nor do they purport to, limit, exclude or modify any non-excludable statutory guarantees as provided under the Competition and Consumer Act Cth (2010), or any other warranties (whether express or implied) under any state or federal legislation which cannot be excluded.



Except for any liability that cannot by law be excluded, the promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.



To the fullest extent permitted by law and without limiting any other conditions of entry, the Promoter may, in its discretion, terminate, modify or suspend the promotion subject to relevant state authorities. All entrants participating in the promotion at the point of termination, modification or suspension of the promotion will be notified by the promoter in writing. In the event of modification or suspension of the promotion, the entrant may choose to terminate their participation in the promotion at no cost.



The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
