1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
2. Entry is only open to Australian residents aged 18 years of age and over. Employees (and their immediate families) of the Promoter, Kia Motors Australia Pty Limited Dealers and agencies associated with this promotion are ineligible to enter.
3. Promotion commences at 12.01am (AEST) on 5 June 2014 and ends at 11.59pm (AEST) on 15 August 2014 ("Promotion Period").
4. To become an eligible entrant ('entrant'), participants must, during the promotion period, be a current Kia vehicle owner and have had their Kia vehicle serviced at least twice between 5 June 2012 and 15 August 2014, and be available to accept the prize as stated on the dates indicated in condition 8 of these Terms & Conditions. Entrants must visit
www.kia.com.au and complete the entry form details including their name, phone number and address, the date and location of the service and answer the question: In 25 words or less, tell us why you continue to have your vehicle serviced at a Kia dealership. Maximum of one entry is permitted in the judging. This is a Game of Skill and chance plays no part in determining the winner.
5. The Promoter accepts no responsibility for late, lost or misdirected entries. Incorrect, incomplete or incomprehensible entries will be ineligible to enter.
6. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
7. All eligible entries will be judging by the Judging Panel appointed by the Promoter at 10.00am (AEST) on 18 August 2014 at MDSA, 15 Grosvenor Street, Neutral Bay NSW 2089. The winners will be the three (3) entrants who in the opinion of the Judges have submitted the most creative and apt responses to the 25 word or less question, as to why the entrant continues to have their vehicle serviced with Kia. The winners will be notified by phone and in writing by email, and their name, suburb and state will be published in The Australian newspaper on 25 August 2014. The Promoter's decision is final and no correspondence will be entered into.
8. The 3 entrants will each receive a trip to Seoul, Korea (for arrival on 22 September 2014 and departure on 26 September 2014) to visit the Kia Motors Head Office and Manufacturing Plant. Each prize includes;
2 return economy airfares from the winner's nearest Australian capital city to Sydney (if required for an interstate winner/s) and on to Seoul, Korea (flight associated taxes are included)
1 night twin share accommodation in Sydney for any interstate winner/s, if flight schedules dictate (as determined by the Promoter)
4 nights twin share accommodation in a 5 star property of the Promoter's choice
Transport to & from the airport in Seoul, Korea
Tours through Kia Motors Head office and Manufacturing Plant
Korean Cultural Event & Sightseeing
2 x Evening Meals for two people Total maximum value of each prize is $9,805.00. Maximum value of the total prizepool is $29,415.00.
9. The Promoter accepts no responsibility for any variation in the prize value. The prize value is correct at 26 May 2014. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The prize is not transferable or exchangeable and cannot be taken as cash. The prize must be taken as offered and cannot be varied.
10. If for any reason the winner is unable to accept the prize as stated on the dates outlined, the winner will forfeit the prize and no compensation will be given in lieu. The contents of the Prize will be at the Promoter's sole discretion. The Prize is subject to availability and the terms and conditions of the entities supplying the Prize. It is a condition of accepting the Prize that the Prize winner and his/her guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. The Prize winner and guest are responsible for ensuring that they are able to travel to the relevant country/city in taking the Prize. As a condition of entry, the Prize winner and or his/her guest must not be subject to any restrictions on their rights to travel to and from the applicable country or countries. Entrants must have a valid passport with more than six months until expiry (from the date the Prize winner is judged) to be eligible for the Prize. It is the responsibility of the Prize winner and his/her guest to check and comply with all applicable requirements.
The Prize winner and guest must travel at the same time and depart from the same capital city and are responsible for transport from their respective residence to the airport at their nearest capital city for the flights (Sydney, Melbourne, Brisbane, Adelaide, Perth, Canberra, Hobart or Darwin).
It is the sole responsibility of the Prize winner and guest to ensure that their personal travel documentation is valid and check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the Prize winner and his/her guest. Travel insurance is advisable for the Prize winner and guests to protect against the additional costs incurred in the event of unforeseen circumstances, however, such arrangements are the sole responsibility of the Prize winner and his/her guest.
Airfare tickets are available on the regular scheduled services of the airline. Flight itinerary may have to be adjusted depending on the airline's departure city and their current flight schedule. Frequent Flyer points are not available. A credit card imprint or cash deposit may be required from the Prize winner at check in to the hotel for any incidental charges, not included in the Prize.
The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Prize winner and guest to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event. The Promoter is not responsible for any cancellation, postponement, delay or rescheduling of transport and any costs incurred as a result. Including, without limitation, any accommodation costs will be the sole responsibility of the Prize winner. The Prize winner and his/her guest are advised to consult their healthcare professional regarding recommended immunisations and/or health checks prior to travelling and to check for travel warnings and any perceived hazards with appropriate authorities, including
www.dfat.gov.au. The Promoter reserves the right to refuse to allow the Prize winner or one or more of his/her guests to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or one or more of his/ her guests are not in the mental or physical condition necessary to be able safely to participate in the Prize.
11. The Promoter reserves the right to re-judge in the event of the prize winner being unable to satisfy these terms and conditions or forfeiting or not claiming the prize. If a prize remains unclaimed or is forfeited through ineligibility or otherwise the Promoter will conduct a further judging at the same time and place as the original judging on 8 September 2014 (subject to any applicable law), and the unclaimed prize/s will be awarded to the entrant/s who in the opinion of the Judging Panel has the next most creative and apt response to the 25 word or less promotion question. The winner/s (if applicable) will be notified by phone and in writing immediately and their name will be published in The Australian newspaper on 15 September 2014 .
12. Employees and family member of employees of the promoter and its agencies are not eligible to enter.
13. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the winner's identity, age, residential address, email address, eligibility to enter and claim the prize and any information submitted by the winner in entering the promotion, before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter's satisfaction within the time requested, that winner's entry will become invalid. The prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
14. The Promoter and its related bodies corporate, their officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained as a result of taking or using the prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). All warranty claims should be directed to the manufacturer of the prize and not the Promoter.
15. The Promoter and its related bodies corporate shall not be liable for any problems or technical failures including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment or software. This includes the unavailability or inaccessibility of any service whether or not caused by traffic congestion o the internet or at any website.
16. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
17. Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote this competition and its winners. If an entrant consents by checking the box in the entry form, the entrants PI may be used to market the services of the Promoters. The PI of the winner may be provided to other parties assisting the Promoter conduct this competition, including prize suppliers and deliverers, and to authorities that regulate this competition. Entrants may contact the Promoter at the address given below to request access to any of their collected PI that is still held. If an entrant does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to win a prize. By participating in the promotion, the entrant consents to receipt of any communication regarding the promotion.
18. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
19. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services.
20. If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to disqualify any individual who tampers with the entry process.
21. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
23. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and, where appropriate, award prizes. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by the entrant.
