Terms and Conditions of Entry – Participating Companies
GENERAL INFORMATION

    Information on the Competition Registration Form and a Company’s obligations to this Competition form part of these Terms and Conditions of Entry – Participating Companies. In the event of any inconsistency between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
    Entry to this Competition is subject to the Company (through the nominated Authoriser) having agreed to the Terms and Conditions of Entry – Participating Companies (these Terms and Conditions) and being successfully registered.
    The Authoriser will, on behalf of the Company and as a condition of registration, approve a Champion to manage the Great Aussie Breather webpage for your Company, participation by employees, and the internal promotion of the raffle.
    Entry is open to all Australian residents who are at least 18 years old and who are employed on a permanent full time, permanent part time, casual or contractual basis through a Company that is participating in the Competition and that has been successfully registered.
    By agreeing to these Terms and Conditions, the Authoriser acknowledges that an employee of the Company, regardless of their employment type (permanent part time, permanent full time, casual or contractual), who is an eligible entrant of the Competition, may win the Prize, and the Company must honour and award the Prize.
    Entry to the Competition costs $10 per entry. The number of entries per eligible employee (Participant) is unlimited.
    The number of tickets that can be sold per raffle varies depending upon the state or territory in which your company is located, and is determined by the prize value. New South Wales, South Australia, Western Australia and the Northern Territory: an unlimited amount of tickets can be sold in the raffle, as the prize value is under $5,000. Queensland, Tasmania and the ACT: the prize of the day off has a deemed value of $300, and therefore the total number of tickets that can be sold per raffle is 150 tickets. Victoria: the prize of the day off has a deemed value of $300, and therefore the total number of tickets that can be sold per raffle is 180 tickets.
    The Raffle Competition commences on Monday, 2 June 2014 at 07.00am (AEST) and ends on Friday Friday, 29 August 2014 at 5pm (AEST) (Competition Period). Your Company must be registered and nominate the draw date during this time in order for you to take part in the Competition. The raffle will close at 5pm (AEST) the day before your company's draw date.
    The Promoter of the Competition is Cystic Fibrosis Queensland Limited (CFQ), on behalf of cystic fibrosis organisations across Australia including Cystic Fibrosis Australia, Cystic Fibrosis NSW, Cystic Fibrosis ACT and Cystic Fibrosis VIC.

 
REGISTRATION OF THE COMPANY

    Agreement to these Terms and Conditions by the Authoriser constitutes an agreement between your Company and the Promoter.
    Registration for this Competition as a Company can be completed by the self-elected Champion for the Company, but participation is subject to approval by the Authoriser responsible for the Company.
    The Promoter will contact the Authoriser nominated by the Champion, to ensure that all Terms and Conditions of the Competition have been understood and agreed to by the Authoriser and in turn, the Company.
    Only after the Promoter has received confirmation from the Authoriser that the Terms and Conditions of the Competition have been understood and agreed to by the Company, will the Company be fully registered to take part in the Competition.
    As part of this agreement, the Authoriser represents and warrants that:
        the Company has received good and valuable consideration for entry into these Terms and Conditions;
        the Authoriser has the legal capacity and sufficient authority to bind the Company to these Terms and Conditions; and
        the Company has considered any tax implications arising from or in relation to the Competition.

 
RESPONSIBILITIES OF THE AUTHORISER

    By accepting these Terms and Conditions, the Authoriser agrees to honour and award the Prize to the Prize Winner identified by the Promoter through the process of random number generation (for more information, see ‘The Prize’ section below).
    By accepting these Terms and Conditions, the Authoriser confirms that they give consent for the Company’s Champion to liaise with the Promoter throughout the Competition, acknowledging that this will be undertaken in addition to the Champion’s workload and at the expense of the Company.

 
THE PRIZE

    The Prize is a day of paid leave which is donated by your Company to the winning Participant. The Prize is deemed to be valued at $300 based upon the average Australian wage. Should the value of the winner’s day off be less than the nominated amount of $300, the difference will be reimbursed by the Promoter upon the Promoter receiving written notification from your Company detailing the prize amendment required.
    A ‘day of paid leave’ is classified as a full working day (7.6 hours) of paid leave, not to be taken from the Prize Winner’s regular annual, personal or sick leave allowance but provided in addition to that allowance.
    The Prize will be awarded to the Participant (Prize Winner) whose ticket number is drawn from an electronic random number generator. This Competition is a game of chance and skill plays no part in determining the Prize Winner.
    Subject to item 17, the Prize will be awarded to the Prize Winner in accordance with the usual leave policies of the Company and the day off must be taken by the Prize Winner at a time mutually agreed with the Prize Winner.
    The Raffle Prize will be drawn between 25-29 August 2014, the date and time to be nominated by your Company. The name of the Prize Winner from each Company will be published on the Company page of the Great Aussie Breather website on Friday 12 September 2014.
    The Authoriser and the Company’s Champion will be notified of the Prize Winner by email so that they can liaise directly with the Prize Winner to award the Prize.
    If the Prize Winner is no longer employed or engaged by the Company at the time the Prize is drawn the Prize will be redrawn.
    The Company takes full responsibility for awarding the Prize and negotiating all terms of the day off specific to the Prize Winner’s terms of employment. The Promoter is not liable for non-receipt of the Prize for any reason.
    The Prize is not transferable and is not redeemable for cash from the Promoter.

 
USE OF ENTRIES

    All entries become the property of the Promoter.
    You grant to the Promoter a perpetual, irrevocable, royalty-free licence to use, reproduce, modify and communicate any material submitted to the Promoter for any purpose that the Promoter may, at its sole discretion, determine appropriate, without further reference, payment or any other compensation to you for the promotion of any products or services of the Promoter.
    If you enter this Competition, the Promoter will collect personal information about the Champion, the Authoriser and the Company so the Company can participate in the Competition and the Promoter can administer the Competition. To do this, the Promoter will disclose personal information to entities to which the Promoter outsources functions and entities associated with this Competition.
    The use and disclosure of personal information by the Promoter is subject to the Promoter’s Privacy Policy and the restrictions imposed by the Privacy Act 1988 (Cth). A copy of the Promoter’s Privacy Policy is available here.

 
LIABILITY AND INDEMNITY

    To the full extent permitted by law neither the Promoter nor any of its associated agencies is liable for any injury, damage, expenses or loss whatsoever (whether direct, indirect, special, exemplary or consequential and even if the Promoter was aware of the possibility of such injury, damage, expense or loss) to any persons or property arising from or in connection with this Competition or these Terms and Conditions.
    The Company is liable for and indemnifies the Promoter from and against any liability, loss, cost, expense or damage (including legal costs) however caused, suffered or incurred by the Promoter in connection with these Terms and Conditions (including but not limited to any act or omission of the Company or arising out of or in connection with the matters contemplated by clause 32).
    All liability for government charges, expenses, taxes or any other tax or duty is the sole responsibility of the Company.

 
UNFORESEEN CIRCUMSTANCES

    If for any reason CFQ (as Promoter, on behalf of cystic fibrosis organisations across Australia including Cystic Fibrosis Australia, Cystic FIbrosis NSW, Cystic Fibrosis ACT and Cystic Fibrosis VIC) determines in good faith and its sole discretion that:
        this Competition is not capable of running as planned (including but not limited to events such as infection by computer virus or bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which might corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition); or
        the Competition is or may be affected by the intervention of any outside agent or event which naturally changes the results or prevents or hinders its determination (including but not limited to vandalism, power failures, tempests, natural disasters, Acts of God, civil unrest and strikes);
        the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of the relevant authorities in each relevant State, if required, which includes disqualifying any individual who tampers with the entry process. The Promoter may recommence the Competition on similar terms and conditions.
    Any refund of entry fees paid is subject to the Promoter’s Payment & Refund Policy. A copy of the Promoter’s Payment & Refund Policy is available here.

 
JURISDICTION

    The state & territory laws, on behalf of cystic fibrosis organisations across Australia including Cystic Fibrosis Australia, Cystic Fibrosis NSW, Cystic Fibrosis ACT and Cystic Fibrosis VIC, apply to this Competition and these Terms and Conditions. Participants irrevocably submit to the exclusive jurisdiction of the relevant State/Territory courts in connection with this Competition.

 
THE PROMOTER

    The Promoter is Cystic Fibrosis Queensland Limited (ABN 97 010 549 667), 31 Kate St Kedron, Queensland, Australia, on behalf of cystic fibrosis organisations across Australia including Cystic Fibrosis Australia, Cystic Fibrosis NSW, Cystic Fibrosis ACT and Cystic Fibrosis VIC. Any queries regarding this Competition should be directed to admin@greataussiebreather.com.au.

    Entry to this competition is subject to the Participant’s (you) Company having agreed to the Terms and Conditions of Entry – Participating Companies and being successfully registered.
    Entry to this Competition costs AUD$10 per entry. The number of tickets that can be sold per raffle varies depending upon the state or territory in which your company is located, and is determined by the prize value. New South Wales, South Australia, Western Australia and the Northern Territory: an unlimited amount of tickets can be sold in the raffle, as the prize value is under $5,000. Queensland, Tasmania and the ACT: the prize of the day off has a deemed value of $300, and therefore the total number of tickets that can be sold per raffle is 150 tickets. Victoria: the prize of the day off has a deemed value of $300, and therefore the total number of tickets that can be sold per raffle is 180 tickets.

Your Company must be registered and nominate the draw date during this time in order for you to take part in the Competition. The raffle will close at 5pm (AEST) the day before your company's draw date.

 
HOW TO ENTER

    To enter the Competition, Participants must during the Competition Period:
        Submit a validly completed Competition Registration Form; and
        Purchase one or more entries in the Competition.
    The number of entries per Participant is unlimited.
    An entry may be deemed invalid and ineligible for entry to the Competition if all of the required fields in the Competition Registration Form have not been properly completed or correct payment has not been received by the Promoter.

 
THE PRIZE

    The Prize is a day of paid leave and is deemed to be valued at $300 based upon the average Australian wage. The cost of the leave is to be paid by the Company (Employer). Should the value of your day off be less than the deemed amount of $300, the difference will be reimbursed by the Promoter upon the Promoter receiving written notification from your Company detailing the prize amendment required.
    A ‘day of paid leave’ is classified as a full working day (7.6 hours) of paid leave, not to be taken from the Prize Winner’s regular annual, personal or sick leave allowance but provided in addition to that allowance.
    The Prize will be awarded to the Participant (Prize Winner) whose ticket number is drawn from a random number generator. This Competition is a game of chance and skill plays no part in determining the Prize Winner.
    Subject to item 11, the Prize must be taken by the Prize Winner in accordance with the usual leave policies of the Prize Winner’s Company and at a time mutually agreed with the Company. The Participant agrees that this may be more than a month after the Prize is drawn.
    The Prize will be drawn between 25-29 August 2014, the date and time to be nominated by your Company. The name of the Prize Winner from each Company will be published on the Company page of the Great Aussie Breather website on Friday, 12 September 2014.
    The Authoriser and the Company’s Champion will be notified of the Prize Winner by email so that they can liaise directly with the Prize Winner to award the Prize.
    If the Prize Winner is no longer employed or engaged by the Company at the time the Prize is drawn the Prize will be redrawn.
    The Promoter accepts no responsibility for the awarding of the Prize after notifying the Company’s Champion, the Authoriser and posting the Prize Winner’s name on the Great Aussie Breather Website on 12 September 2014. The Company has full responsibility for awarding the Prize and negotiating all terms of the day off specific to the Prize Winner’s terms of employment. The Promoter is not liable for non-receipt of the Prize for any reason.
    The Prize is not transferable and is not redeemable for cash from the Promoter.

 
USE OF ENTRIES

    All entries become property of the Promoter.
    You agree to participate in any promotional activities reasonably requested by the Promoter, including being photographed and interviewed, and irrevocably assign to the Promoter all rights in any photographs, images, quotes or other materials including or involving you and waive any claim you may otherwise have in relation to the use of that material (in both cases without further consideration being payable to you).
    You grant to the Promoter a perpetual, irrevocable, royalty-free licence to use, reproduce, modify and communicate any material submitted to the Promoter for any purpose that the Promoter may, at its sole discretion, determine appropriate, without further reference, payment or any other compensation to you for the promotion of any products or services of the Promoter.
    If you enter this Competition, the Promoter will collect personal information about you and your Company so you can participate in the Competition and the Promoter can administer the Competition. To do this, the Promoter will disclose your personal information to entities to which the Promoter outsources functions and entities associated with this Competition. If you do not provide your personal information, you cannot participate in the Competition.
    The use and disclosure of your personal information by the Promoter is subject to the Promoter’s privacy policy and the restrictions imposed by the Privacy Act 1988 (Cth). A copy of the Promoter’s privacy policy is available at here.
