WHY DO YOU DESERVE TO WIN A TRIP TO THE USA: (IN 50 WORDS OR LESS)


Terms and Conditions:

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australia. However, employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter.
3. The Promoter is David Jones (ABN: 75 000 074 573) of Level 8, 86-108 Castlereagh Street, Sydney, NSW 2000.
4. The competition commences on Tuesday 15/07/2014 at 00:01 AEST and concludes on Saturday 26/07/14 at 23:59 AEST.
5. To enter, participants must
a. Visit www.davidjones.com.au and at the bottom of the home page, click on the button marked “Register for Emails”;
b. Provide all personal information required in order to validly register to receive emails from the Promoter including (but not limited to) full name and e-mail address; and
c. Share in 50 words or less why you deserve to win this.
6. The competition is only open to existing David Jones email subscribers and those participants who subscribe to receive emails via the above mentioned process during the competition period set out in paragraph 4.
7. Entries will be judged at 09:00 AEDT on 29th July 2014 by a panel from the David Jones Marketing Team at Level 8, 86-108 Castlereagh Street, Sydney NSW 2000. Entrants’ description of why they deserve to win the trip to LA in 50 words or less will be individually judged based on their literary and creative merit and based upon the panels judgement and discretion. This is a game of skill. Chance plays no part in determining the winner. The panel will select 1 x prize winner.
8. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result. The winner will be notified on 29th July 2014 by email.
9. There is one (1) prize which consists of:
a. return economy class airfares for two (2) people with Qantas flying from the capital city of the
State/Territory in which the winner resides to Los Angeles, USA and five (5) nights’ accommodation in Los Angeles for two (2) people twin-share (total value of flight and accommodation package is up to a maximum of $7,000AUD); and
b. a set of luggage by American Tourister (luggage set valued at $478. Value based on supplier’s RRP).
10. Total prize value is up to $7,478 (including GST).
11. The winner will be instructed to contact the Promoter’s travel agent in order to book the airfares and accommodation. The winner must use the Promoter’s nominated travel agent and the origin and destination of the flights cannot be altered. The winner must book and undertake the travel within 12 months of the winner being awarded the prize by the Promoter. After this date, the travel prize will expire and may not be redeemed. The winner will have a maximum of $7,000 (including GST) to spend on the flights and accommodation. The apportionment of the prize between the flights and the accommodation costs is at the winner’s discretion. Should the flights and accommodation selected by the winner exceed the prize value of $7,000 (including GST) the winner must contribute any additional amount. Should the flights and accommodation cost less than $7,000 (including GST), the shortfall is surrendered. No portion of the prize may be exchanged or refunded for cash. The flights and accommodation may not be used for travel between 15 December to 16 January. All flights and accommodation are subject to availability. The winner is responsible for all other travel arrangements, costs and expenses associated with the redemption of the prize including but not limited to spending money, travel insurance, visas, passports, transfers and transport, food etc. The winner and their guest travel entirely at their own risk and the Promoter is not liable for any loss or damage howsoever caused arising from the travel prize. The Promoter strongly recommends that the winner obtain fully comprehensive travel insurance for the winner and their companion.
12. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. Any winner who is under the age of 18 must travel with a parent or guardian. The travelling companion of the winner must be over 18 years of age unless the winner is their parent or guardian.
13. Illegible, incomprehensible and incomplete entries will be deemed invalid.
14. Entries are limited to one entry per person over the competition period.
15. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
16. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. This includes, but not limited, to entrants using multiple email addresses. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
17. Entries must be received by 23:59 AEDT on 26/07/2014. The time of entry will in each case be the time the subscription is received. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
18. Any entry that is made on behalf of an Entrant by a third party will be invalid.
19. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.
20. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
21. The prize must be claimed by 5.00pm (AEDT) 7 days after the winner has been notified. If any prizes remains unallocated or unclaimed, the prize will be awarded to the participant who would be winner had the original winner been excluded from winning. In the event of a re-judged winner, the winner will be contacted on the following day.
22. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
23. Prize values are based upon the suppliers’ recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
24. Prizes cannot be transferred, exchanged or be redeemed for cash.
25. Cash will not be awarded in lieu of the prize or element thereof.
26. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
27. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
28. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize.
29. Independent financial advice should be sought as tax implications may arise as a result of accepting the
prize.
30. Prizes will be awarded to person named in the entry.
31. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
32. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
33. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
34. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
35. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
36. David Jones and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
37. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
38. All entries become the property of the Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses, telephone numbers and competition entry content for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to the Promoter.
39. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
