Terms and ConditionsBy entering Genea’s “The Australian Fertility Census” promotion, you are agreeing to the following terms and conditions:
1. STANDARD CONDITIONS
1.1 Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry.
2. ELIGIBILITY – WHO CAN ENTER?
2.1 Entry is free and open to Australian residents only, aged 18 years or older who complete, in full, The Australian Fertility Census during the promotional period.
2.2 Employees and immediate families of the Promoter and suppliers, providers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER
3.1 The promotion commences 17 July 2014 at 9am (AEST, Australian Eastern Standard Time) and concludes 17 August 2014 at 11.59pm (AEST, Australian Eastern Standard Time) (“the Promotional Period”).
3.2 To enter the competition, the entrant must:
i) Complete “The Australian Fertility Census” at
www.fertilitycensus.com.auii) Once completed, the entrant must complete the entry form during the Promotional Period. The form must be completed with all mandatory fields (first name, surname, date of birth, email address, postcode).
3.3 This competition is a game of chance.
3.4 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
3.5 Incomprehensible and incomplete entries will be deemed invalid.
3.6 Entrants may enter once during the promotional period for a chance to win a Minor Prize and/or Major Prize.
4. HOW TO WIN
4.1 Each entrant who has entered the competition over the Promotional Period and registered their details in accordance with clauses 2 and 3 will be entered into the prize draw.
4.2 Minor draw winners will be selected at random by a Genea Marketing Department representative at Genea, Level 2, 321 Kent Street, Sydney NSW 2000 on 25/7/14, 1/8/14, 8/8/14, 15/8/14, 22/8/14 and at 3pm.
4.3 The Major draw winner will be selected at random by a Genea Marketing Department representative on at Genea, Level 2, 321 Kent Street, Sydney NSW 2000 on 3/9/14 at 3pm.
4.4 The winners will be notified by email following the draw (within 24 hours).
4.5 Their name and postcode will be published in the “Australian” newspaper and via our social networks following acceptance of the prize. All winners will be published on 10 September 2014.
4.6 Entrants can only enter in their own name. The Promoter, reserves the right to request proof of residency at the stated address and identification for verification (to the Promoter's satisfaction in its discretion) before issuing the prize. Incomplete or incomprehensible entries will be deemed invalid. Entries containing and/or depicting illegal, sexually explicit or morally or racially offensive content will be ineligible to win. The Promoter's decision to disqualify an entry is final and no correspondence will be entered into.
5. UNCLAIMED PRIZES
5.1 If the Minor and Major prizes remain unclaimed after a period of 3 (three) months following prize notification, the original winner forfeits the prize. In this event, the Promoter will award the unclaimed prizes, if any, in a redraw which will take place on 3 December 2014 at 3pm at Level 2, 321 Kent Street, Sydney, NSW 2000.
5.2 The winner of the unclaimed prize draw, if any, will be contacted by email and published in the “Australian” newspaper on 10 December 2014.
6. PRIZE
6.1 There will be 1 (one) Major Prize Winner. The Major Prize Winner will receive: 2 (two) x economy class return tickets departing the winner’s nearest capital city including taxes flying on either Qantas, Virgin Australia or Jetstar Airlines to Cairns (to be selected and booked by the Promoter). The maximum value of two tickets is AUD$1,000 (any amount over $1,000 will be payable by the winner), 4 nights’ accommodation at Bedarra Island staying in Villa North – East including all meals and beverages valued at $5960 (if Villa North-East is unavailable on the travel dates requested accommodation will be provided in an Ocean View Villa or Ocean View Terrace Villa), return limousine transfers from Cairns Airport to Mission Beach valued at $640 and return boat transfers to from Mission Beach to Bedarra Island valued at $395. The total Major Prize value is up to $7,995.
6.2 There will be 5 (five) Minor Prize winners. Minor Prize winners will receive a $300 Visa prepaid gift card. The total Minor Prize value is $1,500.
6.3 The Minor and Major total prize value is up to $9,495.
6.4 The Promoter accepts no responsibility for any variation in the prize values.
6.5 Any additional expenses are at the cost of winner.
6.6 Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
6.7 Spending money, travel insurance, transport to and from departure point and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner.
6.8 Major Prize travel dates must be confirmed through a Genea Representative by 3 November 2014.
6.9 Permitted travel dates: 1 October 2014 – 16 December 2014, and 6 April 2015 – 30 November 2015.
6.10 Once booked and issued, all terms, conditions, travel validity & changes are subject to the Bedarra Island’s terms and conditions which can be viewed at
https://www.bedarra.com.au/booking-terms-conditions and airline’s fare rules & charges for the applicable class of travel booked. Travel is not permitted between 20 December 2014 – 5 April 2015.
6.11 Any changes to the itinerary by the Winner will be subject to standard fees & surcharges and will be the responsibility of the passenger. All components of the prize must be taken together or otherwise are deemed to be forfeited. Travel is subject to booking availability and blackout periods may apply.
7. LIABLIITY
7.1 In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.
7.2 The Promoter is not responsible for any cancellation, delay or rescheduling of flights and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner.
7.3 To the extent permitted by law, the Promoter will not be liable for any for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, misadventure, accident, personal injury, death, damage or claim which is suffered or sustained (whether or not arising from any person’s negligence) in connection with:
a. any travel connected with the Competition or any prize won;
b. any act or omission (whether negligent or not) of the Promoter, or any person employed or associated with any of them; or
c. any circumstances outside the Promoter’s reasonable control.
7.4 The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
7.5Tax implications may arise from the receipt or use of a prize. Independent financial advice should be sought. It is a condition of accepting the prize that the win ner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
7.6 If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, tec hnical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion subject to any written directions under applicable legislation. The Promoter also reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
7.7 The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, co mputer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or downloading any materials in this promotion.

8.3 Th e Promoter collects contact information about entrants in order to conduct the promotion and where appropriate award prizes. If you do not provide the information, you cannot participate.
8.4 The Promoter collects contact information about entrants in order to assist to assist the Promoter in improving goods and services and to contact entrants in the future with special offers via any medium including email and commercial electronic messages. The Promoter will not contact you without your consent.
8.5 The Promoter may partner with third parties in order to conduct the Promotion and may use information collected. The Promoter will not share your personal information without your consent.
8.6 Each entrant agrees, that the Promoters or its agents may do the following:
a) transfer personal information confidentially to the Promoters or other organisations that provide services in relation to this promotion;
b) disclose personal information to State and Territory lottery departments and/or;
c) publish the winners’ names as required under applicable law.
8.7 In accepting the Prize, the Winner agrees to participate and co-operate as required in all marketing activities relating to the promotion, including but not limited to being interviewed and photographed. The winner grants the Promoters a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and their travelling companions) will not be entitled to any fee for such use.
