TERMS AND CONDITIONS:

1.The Promoter is Mattel Pty Ltd (ABN 60 000 660 962) of 658 Church St. Richmond VIC 3121. Telephone 1300 135 312 (Promoter). 2.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 3.Entry is only open to Australian and NZ residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Employees (and their immediate families) of the Promoter’s distributors are also ineligible to enter. 4.Entrants are providing their information to the Promoter and not to Facebook. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Each entrant agrees to completely release Facebook from any and all liability in connection with this promotion. 5. The promotion commences at 11am AEST on Monday August 4 2014 and ends at 11.59pm AEST on Sunday August 31 2014 (Promotional Period). 6.To enter the promotion, entrants will be required to log onto the Thomas and Friends AU and NZ Facebook page at https://www.facebook.com/ThomasandFriends.AUNZ (website), select the “like” button on the Facebook Page (if not already done so), navigate to the promotional app (website) and complete the entry form. 7.Limit of 1 entry per person per week (Monday through to Sunday 11:59pm). Limit of 1 entry per e-mail address and facebook profile per week. 8.Entrants will become ineligible to win if they unlike the Facebook Page during the Promotional Period. 9. There will be 4 prize draws conducted and winners will be drawn at random by a representative appointed by the Promoter to conduct the draw on its behalf. The draws will take place weekly at 9am (AEST) each Monday at Communicado Marketing Communications, level 1, 544 High St. Prahran. 10.Each draw will include all entries from the week prior (Monday to Sunday 11:59pm).Entries will not roll over into subsequent draws. 11.There are 4 Thomas The Tank Engine prize packs to be won. 12.Each individual prize is valued at $451.87 AUD / $ 483.50 NZD. The total prize pool is valued at $1807.48 AUD / $1,934.00 NZD. The prize pack is not redeemable for cash. 13.If a Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 14.Winners will be notified by phone and in writing and will have their name and state/territory of residence published on the website immediately after the draw. 15.Limit of one prize per person (except for SA residents). 16.If a prize is not accepted or claimed by 12 midday (AEST) on 10/12/2014 the relevant entry winner’s entry will be deemed invalid and forfeited. The Promoter will conduct such further draws from among valid entries (being all entries made during the Promotional Period)that have not already won a prize at 2pm (AEST) on 10/12/2014 at the same location as the original draws as necessary to distribute the prize (unclaimed prize draw). Any winner in this draw will be notified by phone and in writing and will have their name and state/territory of residence published on the website as soon as the winner is drawn. 17.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence and) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 18.Incomplete, indecipherable or illegible entries will be deemed invalid. 19.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 20.The Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless stated otherwise. 21.Printing errors and other quality control matters will not be used as a reason for refusing winning entry. 22.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 23.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 24.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used. 25.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 26.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 27.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/redemption/taking of a prize. 28.All records relating to the conduct of the promotion will be retained by the Promoter or a representative duly authorised to conduct the promotion on its behalf for at least three months after the final draw (including if necessary any unclaimed prize draw). 29.Authorised under NSW Permit No. LTPS/14/05328; ACT Permit No. TP 14/02359. PRIVACY: 1. The Promoter and its related entities is collecting your personal information for the purposes of conducting, promoting and administering the Promotion. 2. The Promoter may use your personal information to: • administer your participation in the Promotion, including to notify you if you are a winner; • process any communications you send to it (for example, responding to your queries, and dealing with any complaints or feedback you have); •identify you and protect you from unauthorised access to your personal information; or •get in touch with you in relation to the Promotion. 3. The Promoter will not, unless consent is obtained, use or disclose your personal information to: •send you information about its (or its business partners)' products, promotions or competitions; or •conduct marketing and research directly with you. 4. The Promoter may disclose your personal information: •to other related entities - in connection with the above purposes; •to any agencies, contractors, professional advisers and other service providers it engages to carry out its activities (including call centres, advertising agencies and direct mail houses); •in any advertisements, publications, media statements and other promotional material it produces in relation to the Promotion. For the purposes of public media statements and advertisements, the Promoter will only publish the winner's first initial, surname and state; •to any entity to which it is authorised or required by law to disclose your personal information; and •to any specific parties it has advised you of at the time it collects your personal information By entering the Promotion, you consent to the Promoter and its related entities using and disclosing your personal information in the way described above. 5. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Australia). Personal information that you provide may be disclosed by the Promoter to other organisations outside Australia, including in the United States of America. 7.
